The Will of James Jeffs

 

This is the last Will and Testament of me James Jeffs late of Hook in the Parish of Kingston upon Thames in the County of Surrey but now of Tolworth in the parish of Long Ditton in the same County Victualler which I make publish and declare in manner and form following that is to say I direct my just debts funeral expenses and testamentary charges to be in the first place fully place fully satisfied and paid I give devise and bequeath All those my several messuages cottages or tenements situate at Hook aforesaid with their and every of their rights members and appurtenances And all other my real estates whatsoever and wheresoever the same may be also all my household goods furniture or household plate linen china wearing apparel wines liquors and all other my effects and things which shall be at the time of my decease in and about my dwellinghouse and all other my personal estate and effects whatsoever and wheresoever the same may be unto my wife Mary Jeffs and her assigns for the term of her natural life and after her decease I give and devise All those two messuages or dwellinghouses blacksmiths shop and other buildings situate at Hook aforesaid late in the occupation of myself and Charles Stanford and now of Henry Beeching and Charles Stanford (subject to one third of the debt which I my owe on mortgage of the same and other premises at the time of my decease)unto and to the use of my son James Jeffs his heirs and assigns for ever Also I give and devise all those eight Cottages or dwellinghouses adjoining each other situate at Hook aforesaid in the several occupations of Sarah Prescott, William Lee, Samuel Ealing, William Bignell and William Jefferies and three unoccupied (subject to one third of the debt which I my owe on mortgage of the same and other premises at the time of my decease) unto and to the use of my daughter Christianna Ansell the wife of David Ansell of Bermondsey in the said County of Surrey her heirs and assigns to and for her and their own sole and separate absolute use and benefit Also I give and devise all those eight Cottages or dwellinghouses situate at Hook aforesaid late in the several occupations of Samuel Townsons, Charles Lawson, John Berry and Ruben Rice and now of John Rapley, John Berry and William Carpenter and one unoccupied And also all those four Cottages or dwellinghouses adjoining each other situate at Hook aforesaid now in the several occupations of Mrs Eggleton, James Eggleton John Mott and Mrs Phillips And also those two Cottages or dwellinghouses situate at Hook aforesaid late in the several occupations of John Stokes and one unoccupied (subject also to one third of the debt which I my owe on mortgage of the same and other premises at the time of my decease) unto and to the use of my daughter Elizabeth Jeffs her heirs and assigns to and for her own absolute use and benefit And as to the rest and residue of my real estate if any not hereinbefore specifically devised I give and devise the same ( subject to the life estate therein of my said Wife as aforesaid) unto and to the use of my Said son James Jeffs and two daughters the said Christianna Ansell and Elizabeth Jeffs their heirs and assigns equally to be divided between them share and share alike as tenants in common and not as joint tenants And as to all my personal estate and effects whatsoever and wheresoever including the Goodwill of my business as a Publican ( subject to the life estate therein of my said Wife as aforesaid) I hereby direct my executor hereinafter named to sell and dispose of the same at the decease of my said wife and call in and convert the same into money and the money arising therefrom to be paid and applied in part discharge of the mortgage debt owing by me and secured upon my real estate hereinbefore specifically devised And in case my said Wife shall deem it best to dispose of the Goodwill of my business as a Publican during her lifetime then and in such case I hereby direct that the money arising therefrom shall be paid out and applied immediately on the receipt of the same in part discharge of the said mortgage debt And I do hereby nominate and appoint my friend John Humphrey of Chessington in the said County of Surrey Farmer and my said wife Mary Jeffs Executor and Executrix of this my Will hereby revoking all former Wills by me at any time heretofore made In Witness whereof I the said James Jeffs have to this my said Will and Testament subscribed my hand the ninth day of February in the year of our Lord One thousand eight hundred and forty six James Jeffs

Furthermore on this Codicil made this 27th day of January 1854 I James Jeffs aforesaid direct that in the event of my son James Jeffs being beyond seas (he being now in America) at the time of the death of my said Wife Mary Jeffs the whole proceeds rents and profits accruing or to accrue from all the freehold property and premises which I have by my Will within written given and devised to my aforesaid son James Jeffs shall be received by my two daughters Christianna Ansell otherwise Hansell and Elizabeth Phipps and shall be applied by them in equal parts for their sole use and benefit and their receipt or the receipt of one of them shall be a sufficient discharge until such time as my son James Jeffs shall either personally or by writing make a legal claim to the aforesaid property so devised to him and in the event of my son James Jeffs dying without lawful issue then all and every of the said messuages tenements land & property with all rents profits & rights of every kind thereto belonging I give and bequeath at the death of my wife Mary Jeffs aforesaid to my said daughters Christianna Ansell otherwise Hansell and Elizabeth Phipps an equal moiety to each their heirs and assigns absolutely & for ever In Witness whereof I James Jeffs have to this Codicil subscribed my hand at Hook in the County of Surrey this twenty seventh day of January 1854 James Jeffs
