The Will of Samuel Jebb

 

In the Name of God Amen I Samuel Jebb late of Stratford in Essex and now of Chesterfield in the County of Derby Doctor of Physick do make and ordain this my last Will and Testament as follows My Soul I resign into the Hands of God that gave it trusting in his Mercy through the Merits and Mediation of X for the pardon and forgiveness of my Sins at the great Day of Retribution when it shall be again reunited with my Body which I will to be privately deposited in the Church Yard of West Ham in Essex in the same Grave as my Dear Wife without pomp or Pall Bearers To my Brother John Jebb and my Son Richard Jebb I give Devise and bequeath all and every my Messuages Lands and Hereditaments in the Parish of Northwingfield in the County of Derby Upon Trust to the Uses Intents and Purposes following That is to say to the Use and Behoof of my said Daughter Ann Jebb and her Assigns for and During the Term of her natural Life without Impeachment of Waste And from and after her Decease to the Use and Behoof of all and every the Child and Children of my said Daughter Ann Jebb lawfully to be begotten to be divided between and amongst them in equall Shares and Proportions and of the Heirs of their respective Body or Bodies lawfully issuing such Children if more than one to take as Tenants in Common and not as joint Tenants and for want of such Issue then to the use and behoof of my Son Richard Jebb and his Heirs and Assigns for ever I Do also give and bequeath to my Brother John Jebb and my Son Richard Jebb eighteen hundred pounds Upon Trust to lay out and invest the same in the public ffunds or Government or other good Security At Interest and to pay the Dividends in Trust and proceeds thereof to my Daughter Ann Jebb or to permit her to receive the same during her Life and after her Decease Upon Trust to pay assign or transfer the same principal Money or the Security to be taken for the same unto and amongst the Child and Children of my said Daughter in equal Shares and Proportions if more than one and if but one then to such only Child and in Case the said Ann Jebb shall happen to die without Issue then upon Trust to pay assign or Transfer one Moiety of the said principal Sum of Eighteen Hundred pounds or the Security to be taken for the same unto my Son Samuel Jebb and the remaining Moiety to my Son Avery Jebb and my Will and Mind is that the before mentioned Legacy shall have Preferrance to the Legacies herein after mentioned and be laid out and invested as above Directed within four Months next after my Decease I Do also give and bequeath to my Daughter Ann Jebb five hundred pounds willing that it shall be in such manner employed and Disposed of by my Executors as shall be most expedient for her emolument and advantage and in Case the said Ann Jebb shall happen to Die without Issue and the said sum of ffive hundred pound or any part thereof shall remain undisposed of in the manner above mentioned then to the use of such Person or Persons as she shall think proper to give the same unto in whole or in part To my Son Samuel Jebb I give one thousand pound to my Son Avery Jebb I give One thousand pound To my Brother John Jebb and to my Son Richard Jebb I give and bequeath the principal Sum which shall arise from the dividend of my Son Avery’s Estate Upon Trust for the following Uses Intents and Purposes ffirst for making Good the Deficiancy of the Debt contracted by him with his Aunt Ann Jebb and secondly for making Good the Deficiancy of the Debt contracted by him with Mr Humphries and if after the Discharge of these Debts there be any Surplusage remaining then to the sole Use of my said Son Avery Jebb to my Daughter Ann Jebb I further give all my Household Goods and ffurniture with all my Pictures Prints and Books in English which shall have her own Name or the Name of her Mother written in them together with all my Sheets Table Linen or other Linen all my China Wares earthen ware Glasses and Plate with whatever was her Mother’s To each of my Children I likewise give twenty Pounds for Mourning To my Brother John Jebb I give twenty pounds To all other my Brothers and Sisters I give rings of the Value of one Guinea each and to Mr Wall of Stratford, all the Rest and Residue of my Estate I give Devise and bequeath to my Son Richard Jebb And I do hereby appoint and constitute my said my Son Richard Jebb and my Brother John Jebb Executors of this my last Will and Testament hereby revoking all other Wills by me made And my Will further is that neither my said my Son Richard Jebb nor my Brother John Jebb nor the Executors or Administrators of either of them shall be accountable for any more money than shall come to their Hands and Possession respectively nor with or for the Acts Receipts or Defaults of each other and that they shall respectively be reimbursed all such Costs Damages and expences which they may sustain or be put unto in the Execution and performance of the Trusts hereby in them reposed In Witness whereof I have hereunto put my Hand and Seal this fourth Day of June in the Year of our Lord One Thousand seven hundred and seventy one Samuel Jebb
