The Will of William Irons

 

This is the last Will and Testament of me William Irons of Swerford in the County of Oxford Gentleman I give devise and bequeath unto my Sister Ann Smith all that my undivided moiety of and in the Hereditaments and Premises situate at Boroughbridge in the County of Somerset which was given to me by my Sister Mary Sullivan to hold to my said Sister Ann Smith her Heirs Executors Administrators and Assigns for and during all my Estate and Interest therein I give and devise to my Wife Ann Irons all those my Messuages or Tenements and Premises situate at Swerford in the County of Oxford in the several occupations of myself and others for her life provided she resides therein and remain a Widow and after her Marriage neglect of residence or decease I give and devise all the Premises at Swerford unto my Nephew William Irons his Heirs and Assigns for ever I give to my said Wife the Bed Bedding and all the ffurniture in the Room wherein we usually sleep and two pair of Sheets for her own use I give and bequeath to Jabez Kimber of Little Tew in the County of Oxford Gentleman and John Warmington of Hook Norton in the County of Oxford Gentleman their Executors Administrators and Assigns the sum of three hundred Pounds of lawful British Money to be paid to them by my Executors within six Calendar Months next after my decease upon Trust that they my said Trustees or the survivor of them his Executors or Administrators do immediately on the receipt thereof place out the same at Interest upon Real Security in England and from time to time call in and place the same on such Security again as occasion shall require and do and shall pay the Interest thereof to my said Wife during her life as the same shall be received and after her decease then the said sum of three hundred Pounds and the Interest thereof to be in Trust for my Residuary Legatees in such manner as as the residue of my Estate is hereinafter disposed of and my Will is that if my said Wife shall neglect or refuse to execute a release of her dower nor to any Estate I am or may be seized of in fee simple or fee Tail then I will and direct that the Interest of the said sum of three hundred Pounds shall cease and be no longer paid and payable to her I give and bequeath to the said Jabez Kimber and John Warmington their Executors Administrators and Assigns the further sum of two hundred Pounds of like Money to be paid to them as aforesaid within twelve Calendar Months next after my decease upon Trust that they my said Trustees or the survivor of them his Executors or Administrators do and shall on the receipt thereof invest the same in the Public ffunds of Great Britain and ….stand possessed thereof and the dividends thereof and the dividend thereof In Trust for my Nephew William Smith now or late of the Island of Barbados in the West Indies provided he shall return to England within ten years next after my decease but if my Nephew William Smith shall not return to England within the time aforesaid then do and shall stand possessed of the said two hundred Pounds and the dividends therefrom in Trust for all the Children of my said Sister Ann Smith in equal shares I give and bequeath to my Nephews George James and Charles Smith the sum of three hundred Pounds apiece of like Money as aforesaid to be paid to them respectively within twelve Calendar Months next after my decease and in case any or either of them shall die without lawfull Issue before this or their Legacy shall become payable that then the Legacy or Legacies of him or them so dying shall be paid to the survivor in equal Shares if more than one but in case of one survivor only to such survivor…….. I give and bequeath to my Niece Ann irons the sum of three hundred Pounds of like Money to be paid to her within twelve Calendar Months next after my decease I give and bequeath to my Sister Elizabeth Watton the sum of twenty Pounds of like Money and to my Niece the sum of two Hundred Pounds of like Money to be paid to them respectively within twelve Calendar Months next after my decease and I direct that the receipt of my Sister Elizabeth Watton alone notwithstanding her Coverture shall be a good and effectual discharge to my Executors or either of them I give to the said Jabez Kimber and John Warmington the sum of twenty pounds each as a token of remembrance and for the trouble they may have in the execution of the Trusts of this my Will I give and bequeath to my said Niece Ann Irons the Bed Bedding and all the ffurniture in the best Room I give and bequeath to my Nephew William Irons the sum of ffour hundred Pounds to be paid to him within one year after my decease and all my Books (except account Books) to his own use and the residue of my Monies Securities for Money debts Effects and Personal estate whatsoever and wheresoever I give and bequeath to my Nephews Thomas Smith and George Smith their Executors Administrators and Assigns in equal shares subject to the payment of my debts ffuneral and Testamentary expences and I do nominate constitute and appoint my said Nephews the said Thomas Smith and George Smith the Executors of this my last Will and Testament and I do hereby expressly declare that my said Trustees shall not be charged or chargeable with or accountable for more Money than they shall actually receive or shall come to their hands by virtue of the Trusts of this my Will or with or for any lass which may happen without their wilful neglect or default and also that it shall be lawful for my said Trustees respectively out of the said Trust Money to reimburse themselves and himself all such loss costs damages and expences which they or he shall sustain expend or be put unto in the execution of the Trusts of this my Will or relating thereunto In Testimony whereof I the said William Irons the Testator have to the two first sheets of this my Will contained in three sheets of paper subscribed my name and to the third or last sheet my subscribed my name and affixed my Seal this twenty second day of October in the year of our Lord one thousand eight hundred and eleven Wm Irons
