The Will of William Innys

In the Name of God Amen I William Innys of
London Bookseller but now Resident at my Brother in Law’s John
Cossins of Redland Court in the Parish of Westbury upon Trym in
the County of Gloucester Esquire do make and ordain this my last
Will and Testament in manner and form following first I give and
devise to my Brother Jeremy Innys of Redland aforesaid Merchant
All and singular my Messuages Lands Tenements Hereditaments and
Premises with their and every of their Appurtenances Situate
lying and being in the Parish of Northstoke or elsewhere in the
County of Somerset and also all and Singular my ffee ffarm Rents
Chief Rents Lords Rents and all other Rents issuing or Payable
out of or for any Messuages Lands Tenements Hereditaments and
Premises in the said Parish of Northstoke or elsewhere in the
County of Somerset To have and to hold the said Messuages Lands
Tenements Hereditaments and Premises with their Appurtenances
and the said ffee ffarm and other Rents subject to and charged
and .... with the Annuities Yearly Rents or Sums hereinafter
mentioned unto the said Jeremy Innys for and during the term of
his natural Life and from and immediately after the death of my
said Brother Jeremy Innys I give and devise the said Messuages
Lands Tenements Hereditaments and Premises ffee ffarm and other
Rents unto my Brother John Innys Subject to and Chargeable with
the same Annuities To hold to the said John Innys and his
Assigns for and during the term of his natural life and from and
immediately after his death I give and devise the same Premises
Subject to and Chargeable with the same Annuities to my Sister
Martha Cossins Wife of the said John Cossins To hold to her and
her Assigns for and during the term of her natural life and from
and immediately after her death I give and devise the said
Messuages Lands Tenements Hereditaments and Premises ffee ffarm
and other Rents Subject to and Chargeable with the same
Annuities unto John Brickdale Woollen draper and Slade Baker
Linnen Draper both of the said City of Bristol and their Heirs
in Trust nevertheless to and for the Several Uses Interests
Trusts and Purposes hereinafter declared concerning the same
that is to say to In Trust to lett sett manage and improve the
same Premises and to receive the Rents Issues and Profits
thereof to and for the use and Benefit of my Godson William
Baker son of the said Slade Baker during his Minority and to pay
and apply Rents Issues and Profits to and for the use and
Benefit of my said Godson William Baker in such manner as my
said Trustees shall see fit and from and immediately after the
said William Baker shall have attained the age of twenty one
years then to the use and behoof of the said William Baker his
Heirs and Assigns for ever Subject to the said Annuities But in
Case he the said William Baker shall not live to attain the age
of twenty one years then In Trust to lett sett manage and
improve the same Premises and to receive the Rents Issues and
Profits thereof to and for the use and Benefit of John Innys
Baker another son of the said Slade Baker during his Minority in
such manner as they shall see fit and from and immediately after
the said John Innys Baker shall have attained the age of Twenty
one Years then to the use and behoof of the said John Innys
Baker his Heirs and Assigns for ever Subject to the said
Annuities But in Case the said John Innys Baker shall not live
to attain the age of twenty one years then In Trust to lett sett
manage and improve the same Premises and to receive the Rents
Issues and Profits thereof Subject to the said Annuities to and
for the use of Slade Baker Youngest son of the said Slade Baker
during his Minority and from and immediately after he shall have
attained the age of twenty one years then to the use of the said
Slade Baker the Younger or his Heirs and Assigns for ever
Subject to the said Annuities But in case the said Slade Baker
the Younger shall not live to attain the age of Twenty one Years
then In Trust to lett sett manage and improve the same Premises
and to receive the Rents Issues and Profits thereof to and for
the use of Jeremy Baker eldest son of the said Slade Baker the
elder during his Minority and from and immediately after the
said Jeremy Baker shall have attained the age of Twenty one
Years then to the use of the said Jeremy Baker his Heirs and
Assigns for ever Subject to the said Annuities But if he shall
not live to attain the age of Twenty one Years then to the use
of my own Right Heirs for ever Subject to the said Annuities and
my Will is that my said Trustees or either of them their or
either of their Heirs Executors or Administrators shall not be
chargeable with or accountable for more of the Monies Rents or
Profits than he or they shall actually receive or shall come to
his or their respective hands nor with or for any loss which
shall happen without their wilful default nor the one of them
for the other of them or for the Acts Deeds or Receipts of the
other of them but each of them for his own Acts Deeds and
Receipts and that they shall and may respectively reimburse
themselves all Costs charges damages and Expences which they may
Pay bear or Sustain in the Execution of the Trusts hereby in
them reposed and I do hereby give devise and bequeath unto
Elizabeth Bowen Widow of my Nephew Andrew Bowen deceased and her
Assigns for and during the term of her natural Life one Annuity
or clear Yearly rent or Sum of ten Pounds lawful money of Great
Britain free of Taxes and all other Deductions Parliamentary or
otherwise to be issuing and Payable out of all and every the
said Messuages Lands Tenements Hereditaments and Premises at
Northstoke aforesaid and to be Paid and Payable by equal half
Yearly Payments at these two most....... ffeasts or days of
Payment in the Year that is to say the Annunciation of the
blessed Virgin Mary and Saint Michael the Archangell the first
Payment thereof on the first of the said ffeasts which shall
happen next after my decease and from and immediately after the
decease of my said Neice I give devise and bequeath unto
Elizabeth Bowen Daur of my said Neice and her Assigns for and
during the term of her natural Life one Annuity or clear Yearly
rent or Sum of ten Pounds of like lawful money free of Taxes and
all other Deductions Parliamentary or otherwise to be issuing
out of the said Messuages Lands Tenements Hereditaments and
Premises at Northstoke aforesaid to be Payable in the same
manner as the Annuity above mentioned to her Mother and I do
hereby charge and Subject all and every the same Messuages Lands
Tenements and Hereditaments with the Payment of the said several
Annuities of ten Pounds accordingly and my Will is that in Case
the same Annuities or any Part thereof shall be behind and
unpaid by the Space of thirty days next after either of the said
days fixed for the Payment thereof then and so often as it shall
and may be lawful to and for the said Elizabeth Bowen the Mother
and Elizabeth Bowen her Daughter and their Assigns respectively
to enter upon all every and any Part of the said Premises
charged with the said Annuities as aforesaid and distrain for
the same or so much thereof as shall be so in Arrear and all
Costs and Charges occasioned by non Payment thereof and to deal
with such Distress or Distresses as in cases of Distress of Rent
Item I give and bequeath the sum of twenty Pounds lawful money
of Great Britain to the said John Brickdale in case he shall
accept and take upon him the Execution of the trusts aforesaid
to be paid him out of the Rents and Profits of the said
Messuages of Tenements Lands and Premises aforesaid upon his
acceptance of the said Trust and I charge my said Messuages
Lands Tenements and Hereditaments at Northstoke aforesaid with
the Payment of the said Legacy Item I give and bequeath the sum
of one hundred pounds of like money unto the managers or
Trustees of Christs Hospital in London for the use and benefit
of the same Hospital and I will that the Receipt of three or
four of such managers or Trustees shall be a Sufficient
discharge to my Executors for the same Item I give and bequeath
unto my Brother Jeremy Innys and to his Wife to the said John
Cossins and to my Sister his Wife to the said John Innys Slade
Baker the elder my Nephew William Morris and to his Wife and to
my Partner Joseph Richardson and to his Wife the Sum of Twenty
Pounds each to buy them Mourning Item I give and bequeath unto
my Maid servant Mary Skurry one year’s Wages over and above what
shall be due to her at my decease and Mourning at the discretion
of my Executor and all the rest residue and remainder of my
ready Monies Securities for Monies in the Public ffunds Private
Securities or otherwise Stock in trade debts Household Goods
Plate Linnen.... all other my Personal Estate whatsoever I give
and bequeath unto my said two Brothers Jeremy Innys and John
Innys and to my said Sister Martha Cossins to be equally divided
between them share and share alike and I hereby nominate and
appoint my said Brother John Innys Executor of this my last
Willa and Testament hereby revoking and making void all former
Wills by me made and do declare this to be my last In Witness to
which I have to this my last Will and Testament contained in
five Sheets of Paper to the first Second third and fourth Sheets
thereof set my hand and to the fifth and last Sheet thereof Sett
my hand and seal the thirteenth Day of September in the
thirtieth Year of the Reign of our Sovereign Lord George the
Second by the Grace of God of Great Britain ffrance and Ireland
King Defender of the ffaith and so forth and in the year of our
Lord one thousand seven hundred and ffifty six Wm Innys
