This is the last Will and Testament of me
John Ince of Melbourne in the County of Derbyshire yeoman made
this ffifteenth day of January in the Year of our Lord one
thousand eight hundred and twenty three ffirst I order and
direct that all my just debts funeral and Testamentary expences
be fully paid satisfied and discharged by my Executors
hereinafter named out of my personal estate and effects Then I
give and devise unto my son Thomas Ince his heirs and Assigns
All that my ffreehold house Messuage or Tenement with the Garden
Croft Orchard Outbuildings and Appurtenances thereunto belonging
situate lying and being in Kings Newton in the said County of
Derby and now used as a Public House and known by the sign of
the Pack Horse which Premises are now in the possession of my
said Son Thomas Ince And also that Copyhold Close Piece or
Parcel of Land or ground situate lying and being in a certain
late ffield before the Inclosure of Melbourne and Kings Newton
aforesaid called Shaw field containing by estimation two Acres
or thereabouts and which I bought and purchased of and from
Thomas Hollingsworth of Melbourne aforesaid ffarmer which last
mentioned plot piece or parcel of Copyhold land is now in the
possession of George Peat and was surrendered to the use of my
Will To hold all and singular the aforesaid freehold and
Copyhold premises To him my said Son Thomas Ince his heirs and
Assigns for ever Then I give and devise to my son in law the
said George Peat his heirs and Assigns All that my ffreehold
Close piece or parcel of land or ground situate lying and being
in the said ffield called Shaw ffield and containing by
estimation three or thereabouts be the same more or less and now
in the possession of my said Son Thomas Ince To hold to him my
said son in law the said George Peat his heirs and Assigns for
ever Then I give and devise unto my Grandson Thomas Ince (the
Son of my late Son John Ince) his heirs assign All those my two
houses or Tenements with the the Appurtenances thereunto
belonging situate standing and being in Kings Newton aforesaid
and now in the possession of John Earp and John Warral To hold
unto him my said Grandson Thomas Ince his heirs and Assigns for
ever Then I give and bequeath unto my Grandaughter Mary Clarke
(the Daughter of my late Son John Ince deceased) the Sum of One
hundred pounds And I order and direct the same to be paid to her
the said Mary Clarke her Executors or Administrators within
twelve months next after my decease by my Executors hereinafter
named out of my personal estate and Effects and subject thereto
and to the payment of my debts and expences as hereinbefore
mentioned I give and bequeath All the Rest Residue and Remainder
of my Personal estate and Effects whatsoever and of what nature
or kind soever the same may be or consist of unto and amongst my
said Son Thomas Ince my Daughter Mary the Wife of the said
George Peat my said Grandson the said Thomas Ince and my said
Grandaughter the said Mary Clark equally to be divided between
them share and share alike as Tenants in common and to their
respective Executors and Administrators And lastly I nominate
constitute and appoint my said Son in Law the said George Peat
and John Pegg of Melbourne aforesaid Turner joint Executors of
this my last Will and Testament hereby revoking and making void
all former and others In Witness whereof I the said John Ince
the Testator have to this my last Will and Testament written or
contained in two sheets of paper to the first sheet thereof set
my hand and to the second and last sheet set my hand and seal
