In the Name of God Amen I JOHN HUTTON of
Burton Leonard in the County of York Cordwinder [cordwainer] do make
this my Last Will and Testament in manner and form following that is
to say First I give and bequeath to my loveing wife for term of life
or so long as she keep and remain my Widow the parlour end of my
house together with my bed which is now standing therein and all the
necessarys belonging to the same and to take other necessary things
out of my furniture what she shall think proper but in case my wife
do not inhabit the above mentioned parlour herself then my mind and
will is that she shall not have power to Let the same to any other
person likewise I give and bequeath to my said Loving Wife yearly
and every year after my decease the sum of £2 5s to be paid by two
equal payments ... by my Executrix hereinafter mentioned. Likewise I
charge and make liable for the above Legacy of £2 5s my house
wherein I now dwell together with the Orchard and Garth and Gardens
and all appurtenances ... for my wife to enter of the above house
and premises for the unpayment of the above yearly legacy, but in
case my wife marry again then my mind and will is that I give and
bequeath the above mentioned parlour bed and necessaries together
with the yearly legacy of £2 5s to my daughter CATHERINE.
Item to my said daughter CATHERINE for the
term of her natural life my house wherein I now dwell with the
Orchard and Garth Gardens and the appurtenances belonging to the
same and after her decease to the heirs of her natural body lawfully
begotten ... and for the want of such heirs I give and bequeath the
above house and premises to GEORGE HUTTON son of my nephew WILLIAM
HUTTON in case he be living if not to go to the right heirs of my
nephew WILLIAM HUTTON for ever.
Item I give and bequeath to my said daughter
CATHERINE one close called the Hallpill Close ... but now as the
said close is sold and not delivered I do hereby appoint my brother
PETER HUTTON in trust by virtue of this my will to sign and seal in
Right of me as my daughter is now underage. Likewise I do make my
Brother PETER HUTTON trustee in trust to see this my will put in
execution and lastly I do make my daughter CATHERINE whole and sole
Executrix of this my Last Will and Testament In witness whereof I
have set my hand and seal this 9 November 1784.
