The Will of Ellen Huntington

 

This is the last Will and Testament of me Ellen Huntington of number 17 Elm Grove Holt Hill in Birkenhead in the County of Chester Spinster made this second day of December one thousand eight hundred and ninety. I direct my executrix hereinafter named to expend the sum of one hundred pounds in the purchase of an annuity from the British Government or some other responsible public body for the benefit of my Cousin Anna Maria Flavelle daughter of the late John Flavelle deceased for her life. I bequeath to my niece Iretta Eleanor Scott the daughter of my sister Maria Scott my gold watch and jewellery and to my sister Sarah Hening Huntington my silver plate, household and personal goods and chattels and all other my personal property (except stocks funds shares monies and securities for money) absolutely. I devise and bequeath all my real property and the residue of my personal property to my sisters Sarah Hening Huntington and Maria the wife of Peter Henry Scott of Birkenhead aforesaid Accountant and my nephew Cyril Henry Huntington Scott Upon trust to sell my real estate and to convert and get in my residuary personal estate and (after payment of my just debts and funeral and testamentary expenses to invest the proceeds of such sale and conversion hereinafter referred to as my trust fund) in their names in the public funds or on Government securities of the United Kingdom or on the bonds debentures or debenture stock or guaranteed or shares of any Roadway dock or Water Companies in England Wales or Scotland which shall at the time of such investments be paying dividends out of income upon their ordinary capital or in real securities in England or Wales with liberty to change such investments at their discretion for any other or others of the kind, prescribed and with power to permit any part of my personal estate invested at my decease to continue in the same state of investment so long as they shall think fit. And upon trust to permit my said two sisters Sarah Hening Huntington and Maria Scott and the survivor of them to receive the income of my said trust fund as separate property in equal shares without power of anticipation or alienation and after the death of either of them to permit the survivor to receive the whole of such income in like manner and after the death of such survivor Upon trust as to the capital and income of the said trust find for such child or children of the said Maria Scott living at the death of such survivor and such issue then living of the child or children of the said Maria Scott then deceased as either before or after the death of such survivor remain being living males or a male shall attain the age of twenty one years or living females or a female shall attain that age or marry as tenants in common in a course of distribution according to the stocks the issue of deceased children of the said Maria Scott taking by substitution as tenants in common the respective shares only which their respective parents would if living have taken and the shares of such objects as may be married women to be paid to them as their separate property. I empower the trustees or trustee for the time being of this my Will with the consent of my said, two sisters or the survivor of them and after her decease in their her or his discretion and notwithstanding any of the trusts hereinbefore declared of the said trust fund to apply any part or parts not exceeding in the whole one fourth part of the capital of the fund or share to which each or any of the children or render issue of my said sister Maria Scott shall be entitled or contingently entitled in or toward the advancement in life or otherwise for the benefit of the same child or issue, whether such child or issue shall be under the age of twenty one years or not I appoint my said sisters Sarah Hening Huntington and Maria Scott and my nephew Cyril Henry Huntington Scott to be trustees and Executrixes and Executor of this my Will And lastly I revoke all former Will. In witness whereof I have hereunto set my hand the day and year first above written - Ellen Huntington -

Signed by the said testatrix Ellen Huntington as and for her last Will and Testament in the presence of us present at the same time who at her request in her sight and presence and in the presence of each other have subscribed our names as attesting witnesses --- Edw. At Chester on the 25th August 1891 Probate of this Will was granted to Cyril Henry Huntington Scott one of the Executors
