The Will of Thomas Hunter

 

 I Thomas Hunter of Bowberhead in the Parish of Ravenstonedale, County of Westmorland, yeoman, being weak in health but of sound and disposing mind memory and understanding do this 19th day of March 1840 make this my last will and testament in manner and form following.

First I give and bequeath unto my wife Ann Hunter all my household furniture for her use occupation during the term of her natural life provided she shall so long continue my Widow and from and after her decease or second marriage I give and bequeath the aforesaid household furniture unto my four daughters viz Nanny the wife of James Cleasby, Mary the wife of Septimus Parkin Udale, Sarah the widow of John Cleasby and Margaret Hunter share and share alike.

Also I give devise and bequeath unto my aforesaid wife Ann Hunter the interest and dividends arising from the sum of two thousand pounds three per cent Consuls during the term of her natural life provided she shall so long continue my Widow and from and after her decease or second marriage I give and bequeath the said principal sum of two thousand pounds and the funds or securities upon which the same is invested unto my aforesaid four daughters (….)and my two grandsons Robert Thompson and Thomas Thompson their heirs executors or assigns share and share alike.

Also I give and bequeath unto my youngest daughter Isabella Hunter the interest and dividends arising from the sum of two thousand pounds three percent Consuls now standing in my name during the term of her natural life and from and after her decease I give and bequeath the said principal sum of two thousand pounds and the funds or securities upon which the same is invested unto my aforesaid four daughters (….)share and share alike.

Also I give and bequeath unto my daughter Nanny Cleasby all my Customary estate called or commonly known by the name of Pennystone Green situate on the North side of Stainmore in the parish of Brough County of Westmorland and at present in the occupation of Thomas Calvert as farmer thereof to have and to hold the said Customary estate with the land and appurtenances thereunto belonging unto my said daughter Nanny Cleasby her heirs and assigns for ever.

Also I give and bequeath unto the said Nanny Cleasby the sum of five hundred pounds three per cent Consuls now standing in my name her heirs executors admins or assigns.

Also I give devise and bequeath unto my daughter Mary Udale all my freehold estate called or known by the name of Weasdale with the land and appurtenances thereunto belonging situate in the parish of Ravenstonedale County of Westmorland to have and to hold forever.

Also I give and bequeath unto the said Mary Udale the sum of one thousand pounds three per cent Consuls.

Also I give devise and bequeath unto my grandson Robert Thompson the son of my deceased daughter Elizabeth Thompson all that my freehold estate called or commonly known by the name of Lythside in the parish of Ravenstonedale county of Westmorland and Fell Lane in Kirkby Stephen at present in the occupation of William Shaw as farmer thereof to have and to hold. And if Robert Thompson should die without issue then the aforesaid estate is bequeathed to my grandson Thomas Thompson, and if he should die without lawful issue then the estate is bequeathed to my four eldest daughters share and share alike.

Also I give devise and bequeath unto my grandson Thomas Thompson the son of my deceased daughter Elizabeth Thompson all my freehold estates called Elmpot situate in Fell End Angle in the parish of Ravenstonedale in the county of Westmorland and at present occupied by myself and also my estate called Dovingill in the aforesaid Fell End Angle and at present in the occupation of Robert Tunstall as farmer to have and to hold, subject nevertheless to the following conditions, that is to say I give devise and in bequeath unto his father Robert Thompson senior during the term of his natural life all that my messuage and tenements with the three fields adjoining situate at Low Dovengill in the parish of Ravenstonedale bounded on the east by the lane leading to Robert Hunters dwellinghouse and his garden on the north by Robert Hunters Land on the west by the same persons and on the south by the lane leading to Sprintgill and in case the before mentioned Thomas Thompson should die without issue then I bequeath the said estate to my grandson Robert Thompson and in case he should die without issue then I bequeath the sad estates unto my four oldest daughters (…) their heirs executors etc.

Also I give and bequeath unto my aforesaid two grandsons Robert Thompson and Thomas Thompson all my live store of cattle consisting of cows horses and sheep together with all the implements of husbandry and all the crops of hay and herbage until the end of the year after my decease but to be subject to the payment of all rents and rates.

And I do hereby nominate and appoint my wife Ann Hunter and my two daughters Sarah Cleasby and Margaret Hunter their heirs and assigns to be Trustees for my daughter Isabella Hunter and to have full power to … her interest and dividends and apply the same towards her support.

And as to all the rest residue and remainder of my Estate and effects whatsoever and wheresoever and of what nature or kindsoever not hereinbefore disposed of after payment of all my just debts funeral and testamentary expenses and the aforesaid legacies I give devise and bequeath the same and every part unto and equally betwixt my two daughters Sara Cleasby and Margaret Hunter their executors administrators and assigns to and for their own absolute use and benefit and I do hereby nominate constitute and appoint my two daughters aforesaid Sarah Cleasby and Margaret Hunter to be Executors for carrying this my last will and testament into effect and hereby revoking ll former or other wills by me at any time made.

I declare this to be my last will and testament. In witness whereof I have hereunto set my hand and seal this 19th day of March 1840.  Thomas Hunter.  Signed by the said Thomas Hunter in the presence of us being present at the same time Willm Shaw, John Fawcett.

 

Proved at London 27th August 1840 by oaths of Sarah Cleasby and Margaret Hunter the daughters the Executrixes to whom admon was granted having been first sworn by Comon duly to administer.
