The Will of William Hues

 

I William Hues in the parish of Witham Friary in the county of Somerset farmer hereby revoking every other do make publish and declare this to be my last will and testament in manner and form following that is to say I direct that all my just debts funeral and testamentary expenses be paid by my executors hereinafter named as soon after my decease as possible I give devise and bequeath unto Henry Austin of Truddoxhill in the parish of Nunney in the aforesaid county of Somerset all my leasehold dwelling house and premises situate at Witham Friary aforesaid now held by me under the Duke of Somerset for all my Estate and interest therein Upon trust nevertheless to permit and suffer my wife Sarah to receive and take the rents and profits thereof during her life if my estate and interest therein shall so long continue or to reside therein free of rent if she shall think proper. I also give and devise unto the said Henry Austin all and singular my monies in the funds or other securities upon trust to permit and suffer my wife to receive and take the dividends and annual proceeds thereof during her life. I give and devise unto the said Henry Austin all the rest and residue of my estate and effects of what nature or kind soever and wheresoever not hereinafter disposed of Upon trust to sell and dispose of the same and place the money arising by sale thereof on Government or other security and pay the interest dividends and annual proceeds arising from the money made by such sale unto my said wife Sarah for and during her life. I also direct the said Henry Austin after the death of my said wife Sarah to pay the interest dividends and annual proceeds arising from the money made by the sale of my estate and effects unto my sons Robert Hues and John Hues and to my grandson Uriah Hart and William Hues Hart sons of my daughter Betsy and to my grandsons Benjamin Hues William Hues John Cheddy Hues and Robert Hues sons of my daughter Ann their heirs and assigns for ever share and share alike as tenants in common and not as joint tenants. I also give devise and bequeath unto the said Henry Austin the sum of fifty pounds in the Savings Bank at Frome Selwood in the aforesaid county of Somerset towards payment of my funeral and testamentary expenses the remainder (if any) to be paid to my said wife. I also give devise and bequeath unto my said wife Sarah all my household goods and furniture plate linen and china which I may be possessed of at the time of my decease to and for her own sole use and benefit. And I nominate and appoint the said Henry Austin Executor of this my Will In Witness whereof I the said William Hues have hereunto set my hand and seal the twelfth day of June one thousand eight hundred and thirty four The mark and seal of the Testator X William Hues Signed sealed published and declared by the as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses James Taunton West Moses Ashford The mark X of Elizabeth Ashford

Proved at London 7th December 1835 before the Judge by the oath of Henry Austin the sole Executor to whom Admon was granted having been first sworn by Comon duly to administer
