The Will of Margaret Horner

 

This is the Last Will and testament of me MARGARET HORNER of Caldbergh in the parish of Coverham in the County of York Widow which I make and publish this 22 January 1848.

To my son ROBERT I give my Bible.

To my daughter DOROTHY my Clock and Best Bed.

To my son JOSEPH HORNER I give and devise all and singular my share proportion and Interest to what I am or may be entitled of in to or out of all and singular the Farms lands Tenements Hereditaments and premises situate at Maunby in the parish of Kirkby Wiske in the said County of York devised in the Will of RALPH RIDER deceased and all other my real estate whatsoever And also all the remainder of my personal Estate and effects whatsoever and wheresoever To Hold the same unto my said son JOSEPH HORNER his heirs executors and adminsistrators and assigns Upon the Trusts and for the purposes following that is to say to convert all such part of my Personal estate as shall not consist of Money into Money with all convenient speed

And as to my Real Estate to make sale and absolutely dispose of the same in the most Money that can be obtained and when sold to convey and assure the same to the ?........ hath who shall not be obliged to see to the application of the ?....hire and taken this receipt. Then Upon Trust for my said trustees his heirs executors administrators and assigns to stand possessed of the Money arising from my said Real and Personal Estate Upon Trust to pay and discharge all expences attending such sales or in.....? thereto then to pay all my just debts and the following legacies

To my Granddaughter MARGARET HORNER the daughter of my said son JOSEPH HORNER the sum of £20.

To my Granddaughter ELIZABETH HORNER the daughter of my daughter MARTHA the sum of £20

Then to divide the remainder into Seven equal parts and to pay one part thereof unto my son JOHN another to my son SIMON andother to my son ROBERT another to my daughter DOROTHY another to my daughter MARTHA another to the children of my late daughter ELIZABETH in equal shares and the remaining seventh part to be retained by my said son JOSEPH and I do hereby declare that in case any of my said children or my said grand children should die before me or before his or her share should be paid having lawful issue then shall the share or shares of him of them so dying shall be paid to such issue share and share alike such issue ?....? amongst them the share only which his her or their parents would have ?...?

...... that my said Trustee his heirs and assigns shall sell and dispose of my said Real Estate when he shall think most advantageous and until such sale shall be made and completed that the Rents and profits accruing thereupon after payment of the Interest due on any Mortgage I may have upon my Real Estate as and when the same shall be received and shall be divided into seven equal parts and paid to my said sons and daughters and the children of said daughter ELIZABETH to their ?....? share. And I do hereby further direct that all sums of money which I have advanced or may hereafter advance by me to and for my said daughter MARTHA shall be deducted from her share and be as a debt due from her to me. And I do hereby declare that in case my said son JOSEPH should decline to act or should die before the said Parts be completed then I do hereby request my said sons JOHN, SIMON and ROBERT and the survivor of them and the ?....? and assigns of such survivor to take ?....? them the Trusts of this my will with all the same powers and authorities as my said son JOSEPH had there....? And I do hereby appoint my said son JOSEPH Executor of this my will and revoking all other wills by me made at any time heretofore I do declare this to be my last will and testament In witness whereof I have hereunto set my mark the same day and year first written
