The Will of Elizabeth Horn

 

This is the Last Will and Testament of me ELIZABETH HORN of Middleham spinster.

To MARY HANLEY daughter of GEORGE HANLEY of Middleham aforesaid Baker I give and devise my closes or parcels of meadow ground situate in Middleham and now in the occupation of GEORGE HANLEY called Doghill and ?whernhill? and after her decease I give the said closes to my kinsman the Honourable and Reverend WALTER HUTCHINSON ASTON Lord Aston his heirs and assigns forever. To this same I also give and devise the messuage or dwelling house with the buildings garden and appurtenances belonging and now occupied by me the writer and all that close called Kiln or Kilner ?...? now in the occupation of GEORGE HANLEY ... and all other real estate in Middleham to hold to the same Lord Aston. I give and bequeath my household goods and furniture, plate, china, linen and wearing apparel to the several persons named in a paper writing left with this will and direct that the same as specified in such paper writing shall be delivered to the several persons therein mentioned as soon as convenient to my executors after my decease. All the rest and residue of such furniture plate china linen and wearing apparel as shall not be specifically mentioned in such paper I give and bequeath to the said Lord Aston ..... To the said Lord ASTON, THOMAS WRATHER of Masham gentleman, CHRISTOPHER TOPHAM the elder of Middleham gentleman I give and bequeath all my monies and securities for money and all other personal estate and effects not hereinafter disposed of To hold to the said Lord ASTON, THOMAS WRATHER and CHRISTOPHER TOPHAM upon these trust charged and chargeable with the several legacies and annuities hereinafter mentioned and expressed that is to say Upon Trust with all convenient speed after my decease to call in ?....? and receive all and every my said monies and personal estate and after first paying my just debts and funeral expences and the charge of proving and registering this my will to pay to the several persons hereinafter named the several sums of money of legacies hereinafter mentioned that is to say

To ELIZABETH the wife of THOMAS CLARKE of Wigmore Street London £500

To ELIZABETH the wife of TIMOTHY HUTTON of Clifton Castle £100

To JENNY the wife of CHRISTOPHER TOPHAM £100

To CATHERINE ELIZABETH TOPHAM the daughter of CHRISTOPHER TOPHAM £100

To ALICE DAWSON of Middleham widow £100

To EMMA REBECCA LAMB daughter of THOMAS LAMB of Middleham surgeon £100

To the said THOMAS WRATHER and CHRISTOPHER TOPHAM £50 each as and for a compensation for their trouble in he execution of the trusts of this my will all which said legacies or sums of money above mentioned I will and direct shall be paid tot he several legatees at the expiration of six calendar months next after my decease also the sum of £200 after he decease of my servant MARY COOPER to such person or persons as she by her last will and testament shall give and appoint to have and receive the same and for her good and faithful service I will order and direct that my said trustees shall place out or continue at Interest upon the pursuit of security thereof so much money as will enable them to pay to my said servant MARY COOPER the clear annuity of £20 for the term of her natural life to be paid to her half by two even and equal portions the first half yearly payment to begin and commence at the end of six ?..? months to be computed from the day of my death.

To MARGARET ALLEN of Masham widow I give and bequeath the interest of £100 to also be placed out at interest during her natural life and from and after her decease I give the said sum of £100 [and] £50 to THOMAS COULMAN and ROBERT JOHN COULMAN nephews of the said MARGARET ALLEN....

I will and direct that my funeral may be conducted with proper decency by my said trustees THOMAS WRATHER and CHRISTOPHER TOPHAM and also Lord ASTON if he shall happen to be at Middleham at my decease, that ten poor men shall be appointed underbearers to whom I wish to be paid 10 shillings each and also I will and order that my said trustees shall on the evening of the day after my funeral pay to such poor persons residing in Middleham as I shall name in writing and leave with this my will the following sums of money namely to such poor persons as have families consisting of two or more persons .. 20 shillings and to such as consist of only one person the sum of 10 shillings to each single person

I request I may be buried near to the grave of my late dear mother and the present Tombstone may be removed and a new good and decent Tombstone be ordered in the stead to the memory of my said Mother and myself with such Inscriptions as my trustees shall think fit and proper . And after paying and discharging all my debts legacies and sums of money mentioned I give and bequeath the surplus and remainder of all my money and personal estate ... to Lord ASTON .... whom I hereby appoint my sole residuary Legatee .... And lastly I do hereby nominate and appoint the said Lord ASTON, THOMAS WRATHER and CHRISTOPHER TOPHAM joint executors ..... In witness whereof I have ... set my hand and seal the 1 August 1829

Codicil to the last will and testament of me ELIZABETH HORN of Middleham in the County of York spinster Whereas I have in and by my last will given only ther interest of £100 to Mrs MARGARET ALLEN for life and after her decease to THOMAS COULMAN and ROBERT JOHN COULMAN I do hereby will that the said legacy of £100 shall be paid to the said MARGARET ALLEN at then end of six calendar months after my decease ....

Proved at London with a codicil 11 November 1830 by the oath of the Right Honourable and Reverend Walter Hutchinson Lord Aston, Thomas Wrather and Christopher Topham the executors

Monumental Inscriptions at Middleham

Here lies the body of Dorothy wife of Francis Horn who died April 3rd 1810 aged 85 years. In the same grave lies her only child Elizabeth who walked in integrity of heart and in uprightness shewing sincerity towards God and man. Aged 72 years. The Prayer of the upright is His delight. Proverbs xv: 8
