The Will of Joseph Hopkins

 

I Joseph Hopkins of Cholsey in the County of Berks Esquire being of sound and disposing mind memory and understanding thanks be to God for the same do make and declare this present writing to be my last Will and Testament
Imprimus I give and desire unto my son Richard Hopkins all that my Messuage or Tenament in Cholsey aforesaid wherein I ? ?with the outhouses buildings orchards gardens courts arable lands ? Grounds commons and all other the ? and ? thereto belonging and also the stable and buildings by me ? at or near to a place called Bols Bridge within the parish of Cholsey aforesaid with the garden and appurtanances thereto belonging to hold the said Messuage or Tenement Lands Stable and all and singular other the premises with the appurtanances unto my said son Richard Hopkins his heirs and assigns to and for his and their own proper use and behoof for ever from and immediately after my decease
Item I give and bequeath unto my said son Richard Hopkins all the household goods and furniture cattle cow implements of husbandry and all other my goods and chattels whatsoever which at the time of my death shall be standing growing remaining or being in upon or about the farm and premises in Cholsey aforesaid now in the occupation of my said son to hold the same and everypart thereof with the appurtanances unto my said son Richard Hopkins his executors administrators and assigns for ever from and immediately after my decease
Item I give and bequeath unto my said son Richard Hopkins the sum of One thousand and five hundred pounds of lawful money of Great Britain to be paid by my executor hereinafter named within one year next after my decease
Item whereas I have a mortgage on the Messuage and Tenement and premises of John Blackall Yeoman situate and being in Cholsey aforesaid together with a bond for better serving the payment of the money due and to become due on the said mortgage now I do give devise and bequeath unto my said son Richard Hopkins the said Mortgage and Bond with all the money which at the time of my decease shall be due to me on security of the said mortgages premises and do hereby direct and appoint that my executor within the month next after my decease shall execute ? assignment of the said mortgage and bond unto my said son Richard Hopkins his executors administrators and assigns and at the same time deliver the said mortgage and bond with the title deeds of the said mortgaged premises unto my said son Richard Hopkins his executors administrators or assigns
Item I give and bequeath unto my said son Richard Hopkins all my household goods furniture excepting my household dinner which at the time of my decease shall be in or about my now dwelling house in Cholsey aforesaid together with all my plate and also all my stock of wheat drink and firing which shall be in or about my said dwelling house to be all delivered to him by my said executor immediately after my decease but I do hereby charge the said last mentioned household goods together with the said plate with the payment of ten pounds apiece of lawful money of Great Britain to each of my three daughters named Martha White Mary Hopkins and Ann Toovey which sums of ten pounds apiece I do hereby give and bequeath unto my said three daughters and do order the same to be paid by my said son Richard Hopkins immediately after my decease I do also give and bequeath unto each of my said three daughters the further sum of ten pounds apiece of like money to be paid by my executor hereinafter named immediately after my decease
Item I do give and bequeath all my household dinner unto my two daughters Mary Hopkins and Ann Toovey to be equally divided between them and to be delivered unto them by my executor immediately after my decease
Item I give and bequeath unto my said son Richard Hopkinshis executors and administrators one annuity or that yearly sum of ten pounds of lawful money of Great Britain to be paid by my said executor at one entire payment in each year during the natural life of my said daughter Martha White free of all taxes and deductions the first payment thereof to be made at the end of twelve calendar months next after my decease upon trust nevertheless that he the said Richard Hopkins his executors and administrators shall from time to time pay the same to the proper hands of my said daughter Martha White to and for her own sole and separate use and benefit and disposal and so as that her husband Mr William White his executors or administrators or any of them shall in no wise intermed? therewith nor the same or any part thereof be subject to or assorted by this their any or either of their control disposal or engagements
Item I give and bequeath unto my said son Richard Hopkins his executors and administrators one other annuity or ? yearly sum of ten pounds of like lawful money to be paid by my said executor at one entire payment in each year during the natural life of my daughter Mary Hopkins free of all taxes and deductionsthe first payment thereof to be made at the end of twelve calendar months next after my decease upon trust nevertheless that he the said Richard Hopkins his executors and administrators shall from time to time pay the same to the proper hands of my said daughter Mary Hopkins to and for her own sole and separate use benefit and disposal and so as that her husband Mr Benjamin Hopkins his executors or administrators or any of them shall in no wise intermidable therewith nor the same or any part thereof be subject to or assorted by his their any or either of their control disposal or engagements and it is my express will and direction that the receipts of my said daughters Martha White and Mary Hopkins alone and without their respective husbands from time to time shall be valid to my said son Richard Hopkins his executors and administrators for so much of the annuities as such receipts shall severally express
Item I give and bequeath unto my said daughter Martha White the sum of One hundred and fifty pounds of lawful money of Great Britain to be paid by my executor hereinafter named
Item I give and bequeath unto my said daughter Mary Hopkins the sum of one hundred and fifty pounds of like lawful money to be paid by my said executor
Item I give and bequeath unto my said daughter Ann Toovey the sum of one hundred and fifty pounds of like lawful money to be paid by my executor and it is my express will and direction that the said legacies or sums of one hundred and fifty pounds apiece to each of my said three daughters shall be paid taken and accepted in full satisfaction and discharge of all such claims and demands as they respectively or their respective husbands may have upon or against me my executors or administrators to ? or ? the real and personal estate of my late father in law Henry Harvey deceased or any part thereof or the rents or profits thereof or of any part thereof and that my said daughters together with their respective husbands at or immediately before the payment of the siad respective legacies shall execute and deliver unto my said executor such good and sufficient release and discharge as he shall reasonably require or as council shall aspire of all such claims and demands as they respectively may have or be entitled to make by or under the will of my said father in law ? any way to ? or ? his real or personal estate or any part thereof or the rents or other profits thereof or any part thereof and in case only that such good and sufficient releases and discharges shall be duly executed and delivered unto my executor I do appoint the said several legacies or sum of one hundred and fifty pounds each to be paid unto my said daughter in law the wife of my son Joseph Hopkins and to my son in law William White and to Martha his wife and to my son in law Benjamin Hopkins and to my said daughter Mary his wife and to my son in law William Toovey and to my said daughter Ann his wife and to my said son Richard Hopkins and to my brother John Hopkins and to my sister in law his wife and also to the Maidservantwho shall be living with me at the time of my death to each and every of them one gold ring of the price of one guinea each
Item I give and bequeath unto the churchwardens and overseers of the poor of the parish of Cholsey aforesaid five pounds of lawful money of Great Britain to be paid to them by my executors and to be distributed according to their discretion among the poor people of Cholsey aforesaid within one month next after my decease
Item I give and bequeath unto the Church Wardens and overseers of the poor of the parish of Steventon in the said county of Berks five pounds of like lawful money to be paid to them by my executors and to be distributed according to their discretion among the poor people of Steventon aforesaid within one month next after my decease
Item I give and bequeath unto the churchwardens and overseers of the poor of the parish of Ipsden in the county of Oxford five pounds of like lawful money to be paid to them by my said executors and to be distributed according to their discretion among the poor people of Ipsden aforesaid within one month next after my decease
Item I give devise and bequeath unto my said son Joseph Hopkins all my leasehold farm estate and premises in Cholsey aforesaid commonly called or ? by the name of Chishurst with the appurtanances to hold unto my said son Joseph Hopkins his executors administrations and assigns from the time of my decease for and during all the rest and residue of my estate term of years and ? therein which shall be then to reuse and unexpired
Item I leave all such parts of my real estate as are not hereinbefore disposed of to ? unto my said son Joseph Hopkins his heirs and assigns
Item I give and bequeath unto my said son Joseph Hopkins all my ready money securities for money stock in the publick stocks or funds and all other my goods chattels and personal estate and estates whatsoever and wheresoever and of what nature sort and kind soever excepting the said security from John Blackall and such other parts of my personal estate as are hereinbefore disposed of to hold the same and every part thereof except as aforesaid unto my said son Joseph Hopkins his executors administrators and assigns to and or his and their only proper use and benefit and behoof for ever subject to and I do hereby charge the same with the payment of the annuities and legacies hereinbefore by me given and bequeathed together with all my just debts and funeral and testamentary expences and lastly I do nominate constitute and appoint my said son Joseph Hopkins full and sole executor of this my last will and testament contained in three sheets of paper hereby revoking and making void all other and former wills by me at any time heretofore made or declared in witness whereof I have to each sheet herof set my hand and put my seal this twenty fifth day of February in the year of our Lord One Thousand seven hundred and Eighty Eight. Joseph Hopkins this will being contained in three sheets of paper each sheet hereof was signed and sealed and all together published and declared by the said Joseph Hopkins the testator as and for his last will and testament in the presence of us who have hereunto subscribed our names as witnesses in his presence and in the presence of each other Joseph Clarke, William Moore, John Searle.
