Transcript Will of Aaron HOLLINPRIEST
of HEATON NORRIS. 1704.

In the name of God Amen The ieghth day of
February in the Year of our Lord One Thousand Seven Hundred and
Four I Aaron HOLLINPRIEST of HEATON NORRIS yeoman being at
present somewhat indisposed as to my bodily health yet of sound
and perfect disposing mind and memory blessed be Almighty God
for the same, do make and ordain this my last will and testament
in manner following hereby revoking all former wills and
testaments by me at any time heretofor made.
And first and principally I commend my soul into the hands of
God who gave it, hoping in and through the meritorious death and
passion of My Lord and Saviour Jesus Christ to have free and
full pardon and forgiveness of all my sins and to inherit
everlasting life. And my body I commit to the earth to be
decently buried at the discretion of my Executors hereafter
named.
And as touching the disposition of all such temporal estate as
it hath pleased God to bestow on me I give and dispose thereof
as followeth - And first my will and mind is that all my debts
justly due or of right owing to any person or persons at the
time of my death (if any such there be) together with my funeral
expence and the charges of the probate of this my will shall be
paid and discharged by my Executors out of my goods and personal
estate.
Item it is my will and mind and I hereby give devise and
bequeath all my messuages, tenements lands and hereditaments
whatsoever situate and being in Manchester at or near a place
called Withengreave and in Burnage within Withington in the said
County of Lancaster and in Saddleworth in the County of York and
in every or any of them heretofore purchased by me the said
Aaron Hollinpriest and whereof or wherein I have any estate of
inheritance with their and every of their appurtenances unto my
son Aaron Hollinpriest and heires of his body lawfully issueing
and for default of such issue then to all and every child and
children of my daughter Mary COLLYER on her body begotten and to
be begotten by her husband Thomas Collyer which shall be living
at the time of the death of my said son Aaron to hold as tenant
in common and not as joint tenants and to the heirs of her and
their respective body and bodies. And for default of such issue
then to the right heirs of me the said Aaron Hollinpriest for
ever.
Item I give devise and bequeath unto my said son Aaron
Hollinpriest (for and during all my estate and interest therein)
all that my messuage and tenement situate and being in Heaton
Norris aforesaid and now in the possession of me the said Aaron
Hollinpriest and which was heretofore demised and granted unto
me by Sir Edward MOSLEY late deceased for an estate or term (a
great part whereof is yet to come and not expired), he the said
Aaron my son and his assigns yielding and paying in respect of
the said last mentioned messuage and tenement unto Anne my
loving wife and to her assigns during her natural life, if she
so long remain a widow, the clear yearly sum or annual payment
of four pounds of good and lawful money of England by four
quarterly payments (that is to wit) upon the four and twentieth
day of June, the twentyninth day of September, the fifth and
twentieth day of December and the fifth and twentieth day of
March by even and equal payments, the first payment thereof to
be made upon such of the said days of payment as shall first and
next happen after my death and that without any deduction
abatement or diminution to be made out of the same for respect
of any leys, taxation or other imposition whatsoever.
And if the said yearly sum or annual payment of four pounds per
annum or any part thereof shall happen to be behind or unpaid by
the space of ten days at any time after any of the said days
appointed for payment thereof then in such case it is my mind
and will and I do hereby direct charge and declare that it shall
and be lawful to and for the said Anne my wife and her assigns
from time to time so often as the yearly sum or annual payment
of four pounds or any part thereof shall be so in arrears and
unpaid into the said last mentioned messuage tenement and
premises in Heaton Norris aforesaid to enter and distrain for
such arrearages and the distress and distresses there found to
lead drive or take or carry away and the same to impound and
impound to detain and f until the arrearages thereof shall be
fully paid and satisfied provided always and it is my will and
mind and intention that the aforesaid legacy of the said yearly
sum of four pounds per annum before herein mentioned to be here
bequeathed to the said Anne my wife as aforesaid is and shall be
in lieu and full satisfaction of and for her dower and thirds
and all such other claim title and interest whatsoever which she
the said Anne my wife hath or can or in any way or means may
claim challenge or pretend to have in or out or unto all or any
my lands tenements or premises. And if she refuses to accept
thereof and demand her dower or make claim or title to any other
my lands or tenements than what is so devised to her aforesaid
then in such case it is my will and mind that she the said Anne
shall not have any legacy hereby intended or given her.
And as for and concerning the disposition of all such goods and
chattels and personal estate whereof I shall be possessed or
entitled unto at my decease I do dispose thereof as follows :
And first I give and bequeath unto my said son Aaron
Hollinpriest the sum of one hundred pounds of lawful money of
England to and for his own personal use.
Item I give to the said Anne my wife one brass pot, one kettle,
one chair, two stools, three pewter dishes, one pair of tongs
and such other my household goods and necessaries as she shall
make choice of not exceeding with the said other goods
particularly herein mentioned the value of five marks in money.
And moreover also I give to her my said wife the bed with the
bedding and furniture thereunto belonging as the same is and are
now standing and being in the parlour below the entry of my said
now dwelling house and also one cow such as she shall make
choice of.
And whereas my son in law Thomas Collyer now is and standeth
duely indebted to me the sum of fourscore pounds principal money
or thereabouts it is my will and mind that the growing interest
thereof shall from time to time for and during so long time as
my said daughter Mary Collyer shall happen to live shall be paid
to such person and persons as my said daughter by writing under
her hand shall from time to time direct or appoint in trust to
be applied for and towards the better education and bringing up
or other benefit and preferment of all and every or any the
children of my said daughter which she now hath or hereafter
shall be born of her body to be proportioned in such manner and
for such child or children as she shall direct or appoint in
that behalf.
Item it is my further will and mind that the aforesaid debt or
sum of money to me due and owing from my said son in law as
aforesaid shall after the death of my said daughter be retained
employed and disposed of by my son Aaron in trust for the use
and benefit of such and those the child or children of my said
daughter which shall be living at her death equally to be
divided amongst them share and share alike if more than one.
Item I give and bequeath unto my son Aaron the sum of five
pounds of good money of England in trust to be employed for the
use and benefit of my grandson Aaron COLLYER in such manner as
he my said son in his discretion shall think meet.
Item it is my will and mind and I do give unto my son Aaron the
sum of three pounds per annum to be taken and received out of my
personal estate yearly during so long time and until my grandson
Thomas Collyer shall have accomplished his age of ten years if
he should happen to live so long to live upon trust and to the
intent that the said sum of three pounds shall be yearly
employed by my said son during the said term for the better
education and preferment of my said grandson Thomas Collyer in
such manner as to my son Aaron shall be thought fit.
Item all the rest and remainder of my said goods and chattels
and personal estate of what nature or quality soever which shall
remain over and besides the payment and discharge of my debts
funeral expences and legacies formerly herein mentioned and
bequeathed I do give leave and bequeath the same to my son Aaron
Hollinpriest and my daughter Mary Collyer to be equally divided
betwixt them.
And I do nominate and appoint constitute and make my son Aaron
Hollinpriest and my son in law Thomas Collyer executors of this
my last will and testament hoping they will carefully perform
the same according to the trust in them by me reposed.
Provided always and it is my will and mind that all such
household goods as I heretofore bought (of my son in law Thomas
Collyer- erased) and which are now standing and being in (his-
erased) the dwelling house within Heaton Norris of my son in law
Thomas Collyer shall remain continue and be in the said dwelling
house as heirlooms for the use of my said grandson Thomas and of
such person as for the time being shall be owner and possessor
of the said house.
In witness whereof I the said Aaron Hollinpriest have hereunto
set my hand and seal the day and year above written.

Memo That I Aaron Hollinpriest the testator within named do by
this present endorsement which I make as a codicil to my said
will within written do give and devise all that the room called
the parlour within mentioned to be below the entry of my now
dwelling house and the room called the kitchen adjoining to the
same parlour unto the within named Ann my wife for and during so
long time as she the said Anne shall remain and continue a widow
for her own habitation only but not to set let or dispose of the
same or any part thereof or of either of them to any person or
persons for any term or time whatsoever. And I do hereby ratify
and confirm my said will in all other things,. In witness
whereof I have to that endorse set my hand and seal the three
and twentieth day of February Anno Domini 1704.
