The Will of Richard Hingston

 

I Richard Hingston of the Burrough of Penryn in the County of Cornwall Surgeon being the ffourth of the ffourth Month (called June) in the Year 1748 weak of Body but through Mercy Endued with perfect Mind and Memory do make and ordain this my last Will and Testament in manner and form following Imp I recommend my Soul into the Hands of my great Creator trusting in the Mediation of his dear Son the alone way to the ffather to be received into the Mansions of bliss when my few fleeting Moments in this Transitory Life shall terminate and come to an end I desire that my Body may be Interred in the Burying Ground of my Dear ffriends the People called Quakers between the remains of my two beloved Wives Item I give unto my Brother Andrew Hingston my undivided Moiety of the Garden held by Lease from Philip Collier or his Heir during his natural life But in Case our Right to the said Garden shall not determine at the time of his death then the said Moiety shall revert to my Children Item I give to my son Andrew Hingston as much Money as my Executor in Trust hereafter to eb mentioned shall find necessary to give with him to some honest able Surgeon for his Accomplishment in that Business all my other Effects & Goods Estate or Money or Debts due to me after the above Deductions and Payments of my Debts I give and bequeath equally between my nine Children who are living at this present time And in Case any or either of my said nine Children shall dye in their Minority such Child or Childrens part shall be equally divided between the whole number of the Survivors unless any just reason shall appear to my Executors in Trust to withhold part of the said Dividend from any Child that shall prove wicked or refractory for which purpose I leave a Discreationary power to my Trustees to withhold the Part of such Childs Dividend but not to lessen such Childs proper Portion of his or her ninth part of my said Effects as above mentioned I constitute and appoint my ffather in Law Nathaniel Steele of ffalmouth my Brother Andrew Hingston of Penryn Robert Scantlebury of Mavegissey And my Daughter Mary Hingston Executors in Trust of this my last Will and Testament giving them full Power and Authority to Act as it shall seem necessary to the Majority of them for the good and lawful benefit of my said Children And that they shall give my daughters their respective Portions when either of them shall be Married provided its with the consent and good liking of the Majority of my said Trustees but if otherwise any of them shall Marry contrary to their good liking such Childs Portion shall not be paid her till she shall arrive at the Age of twenty five Years And as to my Sons I desire that they may have their Portions at the Conclusion of their Apprenticeships when they are about to begin Business for themselves And if my Daughters or either of them shall remain unmarried at the Age of Twenty five Years then they are to have their respective Portions And I hereby Authorize and desire my Trustees to put out and continue at Interest the Portions of such Children as are under Age until such time as they shall be entitles to the same on the best Security according to their Judgments In Testimony hereunto I have set my Hand the Day and Year above written     Richd Hingston
