The Will of John Hingston
The last Will and
Testament of me John Hingston of Kingsbridge
in the County of Devon Gentleman who being
weak in body but of sound and disposing mind
memory & understanding do make & publish the
same this twenty eighth day of April in the
year of our Lord one thousand eight hundred
& fourteen & in the fifty fourth year of the
reign of King George the third of the United
Kingdom of Great Britain & Ireland King in
manner & form following (that is to say)
first I will & direct that all my just debts
and funeral Expences shall be fully paid &
discharged Also I give & devise unto my son
Joseph Hingston All that my Manor or reputed
Manor of Holbeton in the County of Devon
together with all the high & chief Rents
thereunto belonging or payable and also all
other my Messuages Lands Tenements &
hereditaments of what nature or kind soever
situate lying & being in the several
Parishes of Holbeton & Shaugh in the said
County of Devon To hold the same with their
& each & every of their several & respective
rights members & appurts unto my said son
Joseph Hingston his heirs & assigns for ever
subject nevertheless to the several leases
which I have granted therein Pursuant to the
power vested in me for that purpose by the
last Will & Testament of my late deceased
father Also I give & devise unto my dear
Wife Rachel Hingston all those my Messuages
or Dwellinghouses situate lying & being in
the Town of Totness in the said County of
Devon To hold the same with their and each
of their several & respective rights members
hereditaments & appurtenances unto my said
Wife Rachel Hingston & her assigns for &
during the term of her natural life and from
& immediately after her decease then I give
& devise the same unto my said son Joseph
Hingston his heirs & assigns for ever Also I
give & bequeath unto my said Wife All that
my Messuage or Dwelling house situate in
Kingsbridge aforesaid now divided into two
Dwelling houses and in the occupation of
myself and William Branscombe the Younger as
Tenant to me and also all that Messuage or
Tenement called Crispins situate in the
Parish of Churstow in the said County of
Devon and also all that Tenement called
Weymouths otherwise Cats Paths situate lying
& being within the Parish of West Alvington
in the County of Devon to hold the said
several Messuages Dwelling houses &
Tenements with their & every of their
several & respective rights members &
appurtenances unto my said Wife Rachel
Hingston and her assigns for & during so
many years of my several leasehold Estates &
Interests therein as shall respectively run
out & expire in her lifetime and from &
immediately after her decease then I give &
bequeath the same unto my Daughter Dorothy
ffox her Exors Admors & assigns for & during
all the then Residue and Remainder of my
Estates & Interests therein respectively
Also I give & devise unto my said Wife all
that my moiety or half part of all that
Messuage and Tenement called or commonly
known b y the name of Culverwell situate
lying & being in the Parish of Churstow
aforesaid To hold the same with the
Appurtenances unto my said Wife & her
assigns for & during the term of her natural
life and from & immediately after her
decease then I give & devise the same unto
my said Daughter Dorothy ffox her heirs &
assigns for ever Also I give & bequeath unto
my said Wife the use of all my household
furniture Plate Linen and China for & during
the term of her natural life and from &
immediately after her decease then I give &
devise the same unto my said Daughter
Dorothy ffox to & for her own use and
benefit Also I give & bequeath unto my said
Daughter Dorothy ffox all my Cloths &
wearing Apparel of what nature or kind
soever All the Rest Residue & Remainder of
my money securities for money Real Personal
& testamentary Estate & Effects of what
nature or kind soever not hereinbefore
specifically given devised or bequeathed I
do hereby give devise & bequeath unto my
said son Joseph Hingston and my said
Daughter Dorothy ffox Upon trust
nevertheless to put the same at Interest on
some Government or private Security or
Securities and to pay the dividends Interest
& produce thereof when & as the same shall
arise & be received unto my said Wife Rachel
Hingston for & during the term of her
natural life to & for her own use & benefit
& from & immediately after her decease then
upon trust to pay over the sum of five
hundred pounds part thereof unto my said
Daughter Dorothy ffox to & for her own use &
benefit And the Residue thereof after paying
the said sum of five hundred pounds to my
said Daughter as aforesaid to divide equally
between them share & share alike and upon to
or for no other Trust End Intent or Purpose
whatsoever and I do hereby nominate
constitute & appoint my said Son and
Daughter sole Executor & Executrix of this
my last Will & Testament upon the trusts
aforesaid provided always and I do hereby
declare it to be my will & meaning that the
Provision made for my said Wife by this my
Will is to be her ademption & full
satisfaction of the settlement made on her
previous to our marriage and which
Settlement I do hereby declare to be null &
void to all intents & purposes whatsoever In
witness whereof I have to this my last will
& Testament (written or contained in two
sheets of paper) set my hand & seal that is
to say my hand only to the first sheet & my
hand & seal to this last sheet thereof the
day & year firs before written
