Deborah Henty of
Marine Square in
the Parish of
White Chapple in
the County of
Middlesex Widow
being of Sound
and disposing
mind memory and
understanding do
make this my
last Will and
Testament in
manner and form
following
Imprimis I
surrender my
Soul to Almighty
God who gave it
and humbly hope
for pardon and
Salvation thro
the merits and
mediation of
Jesus Christ my
Saviour And my
body I commit to
the Earth to be
decently buryed
in the
Expectation of a
joyfull
Resurrection And
as for such
Worldly Estate
as it hath
pleased God to
bless me withall
I dispose
thereof as
followeth
Imprimis I
appoint all my
just Debts and
Funerall
Expences to be
paid Item I do
direct and
appoint that the
sume of Two
hundred pounds
which was given
to my son Samson
Henty by my
Father Samson
Fen shall
together with
Interest for the
same after the
rate of five
pounds per Cent
per Annum be
paid to my said
son And whereas
I have given to
my Daughter
Elizabeth Henty
upon her
Marriage with Mr
Francis Emerton
the sume of
Seven hundred
pounds for and
as her Marriage
Portion and have
given her and
intend to give
her divers
Cloathes
houshold Goods
and other things
which will
amount in value
to the sume of
two hundred
pounds or
thereabouts I do
hereby declare
that the same is
and shall be in
full
satisfaction and
discharge of all
such Share and
part of the
Estate of my
late husband
(and her late
Father)John
Henty deceased
as she or her
said husband can
or may Claime by
virtue of the
last Will and
Testament of the
said John Henty
deceased or
otherwise
Howsoever Item I
give and
bequeath unto my
said Son Sampson
Henty the sume
of nine hundred
pounds and to my
Son John Henty
the sume of nine
hundred pounds
to be paid him
when when he my
said Son John
Henty shall
attaine the age
of one and
twenty years but
if he shall dye
before that Age
then I give one
full and equall
moyety of the
said nine
hundred pounds
given him by my
said Son Sampson
Henty and the
other moyety
thereof unto my
Executors
hereinafter
named upon the
like Trusts as
are hereafter
limitted and
declared of and
concerning the
third part of
the remainder of
my estate
hereinafter
given to them
And I do declare
that the said
Legacye before
given to my said
sons are and
shall be in full
Satisfaction and
discharge of all
such part and
Share of the
Estate of my
late husband
(and their late
Father)as they
respectively can
or may claim by
virtue of the
last Will and
Testament but of
my said late
husband or
otherwise
howsoever And I
do also declare
that the said
Legacies given
to my said sons
and the said
sume of money
and things given
to my said
Daughter
respectively do
amount to more
than their
respective
Shares of their
late Father's
Estate do amount
unto I give and
bequeath unto my
brother Sampson
Fen the sume of
three hundred
pounds and the
sum of ten
pounds for the
mourning Item I
give and
bequeath unto my
brother Robert
Manning and to
his Wife my
Sister and to my
Cousin Humphry
South of London
Merchant the
sume of ten
pounds a peice
for mourning and
my Will and mind
is that all the
rest residue and
remainder of my
ready money
Securities for
money debts
Goods Chattells
and Personal
Estate
whatsoever shall
be divided into
three Equall
Parts and I give
and bequeath one
full and equall
third part
thereof unto my
said son Samuel
Henty and I give
and bequeath one
other full and
equall third
part thereof
unto my
Executors
hereinafter
named upon Trust
and to the
intent that they
and the Survivor
and Survivors of
them and the
Executors and
Administrators
of such
Survivors do and
shall during the
joynt lives of
my said Daughter
and her said
husband pay the
Interst and
Annuall Income
and proceed
thereof to my
said Daughter
Elizabeth and
upon this
further Trust
that in Case my
said Daughter
shall survive
her said husband
then my said
Executors and
the Survivors
and Survivor of
them And the
Executors and
Administrators
of such
Survivors shall
immediately pay
deliver and
Assigne the said
third part of
the Remainder of
my Estate and
all Interest
then due and all
Securities for
the same unto my
said Daughter to
and for her own
use and upon
this further
Trust that in
Case my said
Daughter shall
dye before her
said husband and
shall leave one
or more Child or
Children of her
body begotten
then my said
Executors and
the Survivors
and Survivor of
them And the
Executors and
Administrators
of such
Survivors do and
shall pay divide
deliver and
Assign the said
third part and
the Interest
thereof and the
securities taken
for the same to
and amongst such
Children and the
Survivors and
Survivour of
them if there
shall be more
than one equally
share and share
alike or to such
only Child if
there shall be
but one when
they shall
respectively
attaine the age
of one and
twenty years and
shall and may in
the mean time
pay the said
Interest to the
said Mr Emerton
to be by him
applyed in or
towards the
maintenance and
Education of the
said Child or
Children
respectively or
otherwise for
their benefit as
he shall think
fit and my Will
is that each
Child’s part or
share of the
said third part
and the Interest
shall be paid to
him or her when
he or she shall
attaine the Age
of one and
twenty years And
upon this
further Trust
that in Case my
said Daughter
shall dye before
her said husband
without any
Issue of her
body then living
or in Case she
shall leave any
Issue of her
body then living
and all such
Issue shall dye
before they or
any of them
shall attaine
the Age of one
and twenty years
then my said
Executors and
the Survivours
and Survivour of
them And the
Executors and
Administrators
of such
Survivour shall
pay deliver and
Assigne the said
third part and
the Interest
thereof and all
Securities taken
for the same to
my said sons
Samson Henty and
John Henty
Equally Share
and Share alike
or to the
Survivour of
them who shall
then be living
and I hereby
give the other
third part of
the said
remainder of my
said Estate unto
my said son John
Henty when he
attains the age
of one and
twenty years but
in Case he shall
dye before he
shall attaine
that age then I
give one full
and equall
moyety of the
said last
mentioned third
part and of the
Interest thereof
unto my said son
Samson Henty and
the other Moyety
thereof I give
and bequeath
unto my said
Executors upon
and Subject to
the like Trusts
as are herein
before limitted
and declared of
and concerning
the said third
part of the
remainder of my
Estate
hereinbefore
given and
bequeathed to
them And I do
hereby give and
bequeath unto my
said Executors
and to the
Survivours and
Survivour of
them the
Guardianship of
my said son John
Henty untill he
shall attaine
the age of one
and twenty years
and do desire
and impower to
take care of his
maintenance and
Education and to
lay out such
Sume and Sums of
money in or
about the same
and in or about
the placeing him
out to be an
apprentice as
they shall think
fit And I do
hereby authorize
impower and
desire my said
Executors and
the Survivours
and Survivour
and the
Executors and
Administrators
of such
Survivour from
time to time and
in such manner
as they shall
think fitting to
place out at
Interest upon
any Fund or
Funds Security
or Securities in
the Government
or any other
Securities my
said Estate or
any part thereof
in the purchase
of any Share or
Shares of or in
any publick
Stock or Stocks
Company or
Companye Fund or
Funds Annuity or
annuities
already given
erected or
established by
the Government
and my will and
mind is and I do
direct and
appoint that
they or any of
them shall not
be liable to pay
for any loss
which shall or
may happen to my
said Estate or
any part thereof
by bad
Securities or
otherwise
without their
respective
willfull default
and that they
and every of
them shall be
paid and may
retaine out of
my Estate all
such Costs
Charges and
Expences to the
full as they or
any of them
shall pay
sustain or be
put unto by
reason or means
of the Trust
hereby in them
reposed and I do
hereby nominate
constitute and
appoint the said
Humphry South
and my said
brother Samson
Fen and my said
son Samson Henty
Executors of
this my last
Will and
Testament and I
do hereby revoke
annull and make
void all former
and other Wills
by me at any
time heretofore
made and do
declare this to
be my last Will
and Testament In
