The Will of William Hendley

 

The last will and Testament of me William Hendley of Lamberhurst made and declared concerning my estate as well reall as personall this thirteenth day of December 1652 Imprimis I doe give to the poore people of the parish of Lamberhurst six pound Alsoe I give to every of the children of my sister Russell And to every of the children of my sister Overy the Sume of five pounds a peece to be paid to them respectively as they shall accomplish theire severall ages of one and twenty yeares Item I give unto my loveinge neighbor Edward Gayle the pyd colt he lately gave to me I doe alsoe will and appoint that myne executrixes hereafter named shall pay to him the said Edward Gayle the Some of five pounds which I Intreat him to accept of in satsfaction of money due to him for a horse Item I give to my sister Hellen Handley and my sister Mary Hendley one third of all my household goods usually standinge either in under or over the two chambers called the Kitchings and the two bakehowse chambers to be equally devided betweene them Item I give to Elizabeth the Daughter of my brother John the Sume of forty pounds to be paid to her when Shee Shall come to the age of one and twenty yeares All the residue of my goods and chattells I will shall be taken and dispersed of amongst my foure Sisters aforenamed viz my Sister Russell my Sister Overy my Sister Mary Hendley and my Sister Hellen Hendley whom I make joynt executrices of this my Will and I doe Alsoe appoint that they my said foure Sisters the Survivor and Survivors of them theire and her Assignes shall take up all the profitts of the lands hereby given to any and every of the Sonnes of my brother John Hendley deceased untill William Hendley his eldest Sonne doe or might come to the age of fower and twenty yeares and that out of the Land profitts they pay what shalbe necessary for educatinge of all the children of my said brother John and that they allsoe pay to the said Elizabeth the Some of twenty pounds when shee shall come to the age of one and twenty yeares Item I give to my said Sister Hellen and her heires all my lande both rough and plaint called Whitelands and the one halfe of Mursall Feild vizt that part which hath next to the gate upon condition that shee imploy none of my personall estate towards payment of any debt due from me to her and upon condition that shee doe alsoe discharge myne other executrices of all sch debts And I doe give to my Sister Mary Kendrer and her heires the howse and outhouse and meadowse att the backside of my howse where William Brooke liveth conteyninge two acres and a halfe I doe allsoe give unto her my Said Sister Mary and her heires my feild called the Hamme and my howse in the occupation of Mary Paddowe with the two peeces of ground thereto belonginge the said peece called the hamme and the other two peeces ..... about tenn Acres of land I doe allsoe give unto her my said Sister Mary and her heires the other halfe of my feild called the Mowsall feild upon condition that she accept it in full discharge of all debts due from mee I doe allsoe give unto my said Sisters Hellen Hendley and Mary Hendley dureinge theire naturall lives and duringe the life of the longer liver of them upon condition that they continue unmarried but if any of them shall happen to be married then and from thence I give unto her that continueth unmarried Soe longe as shee shall continue unmarried all that my passage or entrie in the howse where I live betweene the doore called the entrie doore and the Court paved with bricks with the said court and all the buildinges under the said entrie and all the buildinges at the North and West Side of the said entrie and court and alsoe my malt houses and roomes adjoyninge with the upper garden the drawe well and elsewhere that is (exceptinge libertie to such as as shall have the other part of the said howse to fetch water at the said drawe well and allsoe the ould orchard adjoyneinge to the said.....newe outhouse joyninge to the said .....newe outhouse joyneinge so the said old orchard wth new orchard conteyneth about three acres wth three peeces of land in the occupation of John Allen with the way there comonly used and one peece of Woodland joyninge to two of the said peeces with the pitter and shurves belongeinge to the said peice conteininge in or about seaven acres and a halfe and allsoe one peice of land adjoyneinge thereto called Newland conteyninge about fourer acres Item I give unto John Hendley Sonne of my said brother John Hendley to him and to his heires all their my fower peeces of land called the Collin Croft the Well Mitchell the french land and a litle peice of land lyeinge betweene the said peeces called the well Michell and the french land Item I give unto Thomas Hendley Sonn of my said brother John to him and his heires all that peece of Woodland called Brookereed Wood and the two crofts called brooke reed Croft allmost encompassed by the said peice of Woodland conteyninge about twenty fowre acres Item I give unto Walter Hendley the youngest sonne of my said brother John Hendley to him and to his heires all these my lands called the .... Sheapherds croft the churchfeild the pond feild with the shawes and gilles to them belonging Provided alwayes that if William Hendley the eldest sonne of my said brother John Hendley pay unto every or any of his brothers John Thomas or Walter the Summe of one hundred pounds in Six monthes after hee or they shallto theire severall ages of fower and twentie yeares Then I doe hereby give unto him the said Walter Hendley and his heires the land soe given to him All the rest of my said....I give unto the said Walter Hendley sonne of my brother John to him and to his heires when hee shall come to the age of fower and twenty yeares And I doe give allsoe to him the said William when he shall come to the age of fower and twenty the profitt of the plaine lande given unto hbis younger brother untill they shall come to their severall and respective ages of twenty and fower yeares upon condition that he allowe them sufficient maintenance out of it in the meane tyme Notwithstandinge anythinge herein mentioned I doe give out of the lande given to the said William Hendley the annuall Some of twenty shillingses a peece to my cosens Thomas Payne and Mary Garthford with power to Distreyne in case of non piment In witness that this is my last Will and Testament beinge interlined att eight places or thereabout I have hereunto sett my hand and seale in the presence of (William Hendley) John Pattenden John Pauly Thomas Allin
