The Will of Charles John Hemmings

 

This is the last Will and Testament of me Charles John Hemmings of Regent Street Westminster Mason I give devise and bequeath all my Personal Estate whatsoever of what nature or kind the same may be unto my Brother William Hemmings of Vincent Square Westminster aforesaid Mason Upon Trust to sell and convert the same into money when and as he the trustee of this my Will shall in his discretion deem it expedient or advantageous so to do And upon further Trust after payment of my just debts funeral and testamentary expences to apply the whole of my estate as far as the same will extend in or towards the maintenance and education or otherwise for the benefit of my three children Charles Sarah and Mary at such times and in such sums manner and proportions as my said trustee shall in his own sole and uncontrolled discretion think fit And whereas I am interested with my Brother s and Sisters under the Will of my late ffather Samuel Hemmings in certain leasehold premises therein bequeathed Now I do hereby authorize and empower my said trustee o concur with the executors and other parties interested under the said Will in seizing and converting into money all property to which I may be so interested under such Will as my Trustee in his discretion shall think fit And I empower my Trustee to give receipts for all monies and effects to be delivered to such trustee by virtue of this my Will and declare that such receipts shall exonerate the person taking the same from liability to see to the application thereof or disposition of the money or effects therein mentioned And I empower my said trustee to compound or allow time for the payment of any debt or debts due to my estate and to settle all demands against my estate and adjust all accounts between me and any person or persons on such terms as my said trustee shall in his discretion think expedient and to refer any matters in difference relating to my affairs to arbitration And I appoint the said William Hemmings Executor of this my Will And I revoke all former and other Wills In witness whereof I have hereunto set my hand this seventeenth day of January one thousand eight hundred and forty nine  _  Charles John Hemmins
