The Will of Henry Heighes

 

In the Name of God Amen I Henry Heighes of  East Worldham in the County of Southton, Gent being sick in body but of sound and perfect mind and memory thanks be unto God for it do this eighteenth day of September One Thousand Six Hundred Ninetie Two in the fourth year of the reigne of King William and Queene Mary over England so make and ordaine this my last Will and Testament reviking all former Wills by me made in manner and form following  First I give and bequeath my soule into the hands of God my Creator trusting by the merritts of Jesus Christ my Saviour and Redeemer to enjoy everlasting life and my body to be decently buried at the discretion of my ever honoured mother Mrs. Mary Heighes to whom I give and bequeath ten pounds to buy her mourning,  Item I give devise and bequeath unto my loving kindsmen Mr. Henry Christmass Rector of Itchin Abbotts, Mr. William Christmass fellow of New Colledge in Oxforde and Mr. John Cheyney of Bensted in the County of Southton Gentleman all those my Lands Tenements and Hereditaments with all and singular their appurtenances commonly called or known by the name or names Comps Cowlears and Fuhams or by what other name or neames they are called for knowne situate lying and being in the Parish of Shelborne in the said County of Southton which I lately purchased of and from the ?  of Thomas Kelsey and also all that my messuages or Tenement in Alton with three acres of Land thereunto belonging now in the possession of William Gill or his assigns all which above mentioned Messuages Tenements and Lands with all and singular their appurtenances are as above given devised and bequeathed to be sold and disposed of for the payment of my debts To have and to hold the first said Land Tenements and Hereditaments will all singular their appurtenances called Comps Cowlears and Fuhams and the said last mentioned messuage or Tenement in Alton with the said three acres of Land thereunto belonging with all and singular their appurtenances to them the said Henry Christmass, William Christmass and John Cheyney for the uses intents and purposes above mentioned also I give devise and bequeath unto my said Kindsmen Henry Christmass William Christmas and John Cheyney the Lease of the Parsonage of East Worldham the Lease of the Parsonage of Oxenbourne in the Parish of East Meon both in the said County of Southton to and for the uses intents and purposes hereafter mentioned (for and during ther terms of ten yeares first for renewing the said Leases as often as formerly they have beene done and putting the life of John Heighes youngest son of my brother Edward Heighes deceased instead of my lfie next for the raysing and paying unto my two sisters Audrey and Dorothea Heighes the sum of two hundred pounds a piece in increase and augmentation to their portions my father left them and after the payment of the said four hundred pounds the remainder of the rents of the said ten yeares the leases and Lyfes being renewed as above directed I give and bequeath unto my two nephews Thomas Braman and Nicholas Bramanto be equally divided between them and after the said ten yeares are expired I give devise and bequeath unto my nephew William Heighes/ second sonn of my said brother Edward Heighes/ his Execurtors Administrators ans Assinges the Lease of the Parsonage of East Worldham with all my rights and title thereunto belonging  And also after the said Ten years are expired I give devise and bequeath unto my said Kindsmen or Nephew John Heighes his Executors Administrators and Assignes the Lease of the Parsonage of Oxenborne aforesaid with all my rights and title thereunto belonging.  Item I give and bequeath unto my sister Ann Braman Ten pounds to buy her mourning.  Item I give and bequeath unto my sister in law Hanna Heighes Tenn pounds to by her mourning.  Item I give and bequeath unto my nephew Edward Heighes eldest sonn of my said brother Edward Heighes fourtye shillings to buy him a ring.  Item I give and bequeath unto my nephew William Braman five pounds.  Item I give and bequeath unto my uncle Mr. Henry Christmas a guiney to buy him a ring and desire him and my said Mother to overseers of this my Last Will and Testament all which said summes of money afore mentioned for mourning and rings I give and bequeath to be paid within six months after my decease always provided that incase my first said Lands Tenements and Hereditaments called Comps Cowlears and Fuhams and my messuage of Tenement and Lands in Alton and my corne in East Worldham Parsonage Barne and in the fields and in the Barnes at Comps Cowlears and Fuhams and the rents and value of the Timber due from Mr John Holloway and all other properties to belonging will not pay my debts Lagacies and Funerall expenses then my Will and meaning is that so much of the rents of the Parsonage of East Worldham and Oxenborne aforesaid shall be laid put and disbursed for the payment of mysaid debts Lagacies and Funerall expenses before the raising of the summes of two hundred pounds a piece to my said Sisters Audrey and Dorothea and likewise my meaning is that if the above said Lands and Stock and personall Estate will not amount unto the payment of my debts and Legacies and thenn pounds a piece to my said Executors hereafter named and all their just and lawfull expenses they shall and may in the first place deduct the said sum of thirty pounds and their said expenses out of the said Parsonages of East Worldham and Oxenborne and also I give and bequeath unto Mrs Audrey Fisher a guiney to buy her a ring and lastly my debts and funeral expenses discharges and my Lagacies paid I make and ordaine the said Henry Christmas William Christmas and John Cheyney my full and whole Executors of this my Last Will and Testament In Witness whereof I have hereunto sett my hand and seale the day and yeare above written.  Item I give unto my Neice Sarah Heighes onely daughter of my said brother Edward Heighes a guiney to buy her a ring.  Henry Heighes signed sealed published and declared to be his Last Will and Testament in the presence of Rich Kelsey  Mary Maynor her marke Henry Christmas.

 

Probate (in Latin) granted in London to William Christmas   John Cheyney.
