The Will of Henry Heighes

 

In the name of God Amen I Henry Heighes of East Worldham in the Countie of Southton, Gent and being infirm and weake in body but of sound perfect and disposing minde and memory (thanks be given to God)  be this present fifteenth day of Januarie Anno Domini One Thousand Six Hundred Eighty and in the two and thirtieth year of the now   ?   reign King Charles the second over England  so make and declare this my last Will and Testament in manner and form following (vis) Imprimis I command my soule unto God my Creator hopeing through the merritts of Jesus Christ my Saviour to receive and pardon for all my sins and to be made  partaker  of life everlasting and my body I commit to the earth whom it so as made to be devoutly interred at the discretion of my Executors hereinafter named.  And as to that Estate who so withit hath pleases God to intrust mee I give and devise the same as followeth (vis)   I Will that all my just debts bee payd and satisfied as soone as with and convenience may be done.  Item I give and bequeath unto my foure younger daughters Elizabeth, Lucy, Maria  and Dorothea Heighes three hundred pounds a piece of lawfull money of England to bee payd them within three years after my decease or at their respective dayes of marriage which shall first happen provided that they do marry with the good liveing and consent of Mary Heighes their Mother if she be then liveing And if either of them happen to dye before the said  Legacys shall become due and payable  Then I will that the portion of such so dying shall be equally divided amongst the survivor and survivors of them  And my Will and meaning is that the said several and respective legacys shall be raised out of my stock goods chattels and personall estate and by sale thereof and if that be not sufficient to do the same then I do hereby charge all my part and share of the Lodge Lands Grounds and Parke called Worldham Parke all my terms rest in forest and Estate therein situate in East Worldham in the countie of Southton and also all the tythes of corn comming arising and increasing within the Parish of East Worldham aforesaid with them and everie of their appurtenances and all my Estate and Terms therein with the payment of the residue And do hereby give and grante unto my Executors herein after named full power and authorisation to make up the said portions three hundred pounds a piece out of the rents issues and profit of the said grounds and Tithes and to take and apply the terms for that purpose.  And I do hereby devise my said Executors to add one hundred and fifty pounds a piece more to each respective daughter for increase of her said portion incase my said Executors can or shall receive the same out of the rents issues and profits of the said parke grounds and tythes in the Parish of East Worldham aforesaid.

Item I give and devise unto my sonne Henry Heighes and his heirs and assigns All the tythes of corn and grayns arising recurring and increasing within the Tything of Oxenbourne part of the Rectoree in East Meon in the said Countie of Southton which I hold by a Lease for lives from the Lord Bishop of Winchester and all the    ?  lands and appurtenances thereto belonging and all my rights tithes terms and Estate therein. 

Item I give and devise unto my said sonne Henry Heighes and his heirs all my messuage or Tenement with the land thereto belonging situate and lying in Alton in the said Countie of Southton late in the   ?   or occupation of Richard Fisher and now in the possession of William Markes and John Morgan.  Item I give and devise unto my loveing wife Mary Heighes and her assigns during the term of her natural life the messuage and lands which I hold by lease from the College of Winchester and after her decease I Will the same shallbe and remaine unto my grandchild Edward Heighes for the remainder of my terms therein then to come.  But if he should happen to dye without issue before the said Mary Heighes his grandmother then I give the said College Lease and promises after the decease of the sayd Mary Heighes unto my sonne Henry Heighes his Executors Administrators and Assignes with the full benefitt of the receiving thereof.

Item I give and devise unto my oldest sonne Edward Heighes and his heirs all those four acres of Arable land be they more or lesse lying in Hartley Mauditt in the Countie of Southton.  Item I give and devise unto my Executors herein after named and their heirs All those lands lying neare Riverhill in the Parish of Binstead  in the said Countie of Southton which I lately purchased from Nicholas Hurst and William Venables upon trust that my said Executors or the survivor of survivors of them make sale of the same towards the raising of my said daughters portions. 

Item I will and devise that after my debts and Legacys shall be raised fully satisfied and payd the said Lands and grounds called East Worldham Parkes and my part and share therein shallbee and remains unto my sonn Henry Heighes his Executors and Administrators for the remainder of the terms therein thoucome and ?   And my tithes corns and grains in East Worldham aforesaid shall goe and remaine unto the said Mary Heighes my wife for her life for the better   ?    and support of her so keeping for her selfe and children And after her death I give the said Tythes and the Lease thereof to my said sonn Henry Heighes his Executors and Assigns for the remainder of my Terms and Estate therein And I doe hereby make and ordayne my said loveing wife Mary Heighes and my two sonns Edward Heighes and Henry Heighes Executors of this my last Will and Testament (hereby revoking all former wills by mee made)  and I doe devise my worthy friends Sir John Norton Barrton   Samuel Woodford Horton of Divinitie    William (?)indott Esq. and my brothers in law Mr Henry Christmas and Mr Charles Cheney to be sponsors thereof and to be ayding and assisting to my said wife and children and for their care therein I give unto both of them twentie shillings to buy them rings.

Item I give to the poore of the Parish of East Worldham aforesaid ffourty shillings and to each of my grand children five shillings a piece.  In Testemonie whereof I the said Henry Heighes have to this my last Will and Testament contayned in two sheets of paper sett my hand and seale the day and yeare first above written Henry Heighes signed sealed and declared by the said Henry Heighes his testator to be his last Will and Testament in the presence of Charles Cheney, Eli Shelley, Richard Redmond, the mark of William Hickory  

 

A Codicil to be added to my Last Will and Testament and to be taken as part thereof

Imprimis I do hereby give and bequeath unto my daughter Anne Braman for her sole and separate use and benefit without her husband the sum of one hundred pounds to be payd unto her if living if not her children out of my part of the Parkelands after her sisters have received all their portions if her husband Thos Braman do upon demand give my Executors    ?    not to     ?  therewith if not, the said one hundred pounds not to be    ?   now payd at all.   Item is hereas I have given by my Will unto my sonn Henry the   ?    of the said parkelands paying his sisters portions I do hereby declare and this my now intend and meaning that if my sonne Henry do not pay them attending to my Will together with the one hundred pounds above mentioned then my Executors shall have liberty to pay the same.  And I give unto my Executors the   ?   thereof paying the said Legacys in the Will and the said   ?   above mentioned  And my Will and Meaning further is that incase my personal Estate not bequeathed will not hold out to pay my Legacys of three hundred pounds a piece to my daughters then I do hereby direct and appoint my Executors to receive the rents and profits of the said Parkelands until they have raised the same before my daughter Elizabeth do receive any.  Item I give unto my sisters tenn shillings a piece to buy them rings and the like to my loveing friends Matthew Hawkins and Widdow Marks ?  ?  to buy them rings and do order and appoint the two hundred pounds and Interest due from my cousin Mary Heighes on her coppihold to be received and go towards payments of my Legacys in witness whereof I have hereunto set my hand and seale the foure and twentieth day of March one thousand six hundred Eighty  Anno (Latin)   Henry Heighes sealed delivered published and declared in the presence of the marke of Thomas Smith the marke of William Piper.

 

Probate in Latin  granted in London to Maria Heighes   Edward Heighes  Henry Heighes.
