This is the Last Will and
Testament of me JOHN HEAD of No 29 Cumming Street Pentonville in the
County of Middlesex and of Kirby Ravensworth in the North Riding of
Yorkshire Esquire I desire that I may be buried in the Church of
Kirby Ravensworth aforesaid in such decent and respectable manner as
my Executors hereinafter named shall in their desire then think
proper. I give and devise all and singular my lands tenemants and
hereditaments whatseover and wheresoever whether freehold copyhold
or customary or any other tenure unto and to the use of the Reverend
JOHN SHAW of Cottingham[Conington] in Cambridgeshire and WILLIAM
DUNN of Newsham near Richmond in Yorkshire gentleman and JOHN HIND
of Gales near Richmond aforesaid their heirs and assigns ... and I
give and bequeath all and singular my Personal estate which shall
remains after payment of my debts and funeral and testamentary
expences unto the said JOHN SHAW, WILLIAM DUNN and JOHN HIND ... And
I direct that the said JOHN SHAW, WILLIAM DUNN and JOHN HIND ...
shall stand seized and possessed ... of my said real and personal
estates upon trusts hereinafter declared... that is to say Upon
trust .. to pay out of my personal estate the several legacies after
mentioned that is to say to JAMES SHAW, WILLIAM SHAW, JOHN SHAW,
FANNY SHAW and Mrs TUCKWOOD respectively sons and daughters of the
Reverend THOMAS SHAW deceased by his wife MARY the sum of £100 each
and to such children of GEORGE SHAW deceased who was also a son of
the same Reverend THOMAS SHAW as shall be living at the time of my
decease the sum of £100 equally to be divided month them .... to
GRACE HUSBAND the widow of WILLIAM HUSBAND late of Sedbury in
Yorkshire deceased the sum of £100 ; To DAVID ARMSTRONG late of St
Trinians near Richmond the sum of £100; To JOHN JOHNSON of Kirkby
Hill near Ravensworth the sum of £100 ; to such of the children of
EDWARD JOHNSON late of Gilmonby deceased as shall be living at the
time of my decease the sum of £100 to be equally divided among them
... to the said WILLIAM DUNN the sum of £200 and to each of his the
said WILLIAM DUNN’s two sisters ALICE and ELLEN respectively the sum
of £30 ; to JOHN HEAD and ELIZA HEAD the son and daughter of SAMUEL
HEAD late of North Cote near Masham deceased respectively the sum of
£5 each and I declare that I have not given more to the said JOHN
HEAD and ELIZA HEAD because they have already during my life time
received several Thousand Pounds from me ; To ANN WILKINSON who now
lives and resides with me the sum of £100 and I desire the same may
be paid to the said ANN WILKINSON as soon as possible after my
decease And if my residuary personal estate shall be insufficient
for the payment of all my debts and funeral and testamentary
expences and of the several legacies or sums of money hereinbefore
mentioned then I charge my said freehold and copyhold estates with
the deficiency and I authorise my trustees .... to raise the same by
sale or mortgage ..... and as to my house at No 29 Cumming Street
Pentonville in which I am now residing and all my plate linen books
and furniture which may be therein at the time of my decease upon
trust to permit and suffer the said ANN WILKINSON to use and occupy
the said house free from rent and repairs and without impeachment of
waste during all the rest and residue of ther term therein now to
come and unexpired if the said ANN WILKINSON shall so lone live and
continue unmarried and to permit her to have free use of the said
plate linen books and furniture during the term of her natural life
if she shall continue unmarried subject nevertheless to the payment
by the said ANN WILKINSON from time to time ... of the ground rent
payable in respect thereof .... And after the determination of the
interest hereby given to the said ANN WILKINSON in the said house
plate linen books and furniture respectively Upon Trust to and
dispose of the same respectively by public sale or private contract
and to hold the money to arise from such sale upon the trust and for
ther purposes herein declared ..... and I direct that my said
trustees .... for the time being shall stand and be seized and
possessed of my said lands tenements and hereditaments .... for the
intents and purposes hereinafter declared that is to say Upon Trust
to collect and receive the rents issues and profits and thereto to
pay the expences of repairing and keeping in repair the buildings
upon the said lands tenements and hereditaments and my said house in
Cummings Street .... to pay the said ANN WILKINSON and her assigns
during her natural life one annuity of £200 ... by equal half yearly
payments on 24 June and 25 December .... and if the said annuity or
any part thereof shall at any time be in arrears I direct that the
said ANN WILKINSON and her assigns may enter unto and distrain upon
the said lands tenements and hereditaments ..... And I direct that
my said Trustees ... shall ... stand be seized of all and singular
my said lands tenements and hereditaments hereby devised in trust
for JOHN SHAW the younger eldest son of the said Reverend JOHN SHAW
..... for and during the term of his natural life .... and after his
decease in trust for the first and every other son of the said JOHN
SHAW the younger .... according to seniority of age and priority of
birth in tail male with remainder in trust for BOWYER EDWARD SHAW
the second son of the said Reverend JOHN SHAW and ... after his
decease for every son of the said BOWYER EDWARD SHAW .... with
remainder in trust for CYRIL JAMES SHAW the third son of the said
reverend JOHN SHAW ... and after his decease in trust for the first
and every son of the said CYRIL JAMES SHAW ... and in default of
such issue in trust for THOMAS HEAD SHAW the fourth son of the said
Reverend JOHN SHAW and his assigns ... and after his decease in
trust for the first and every son of the said THOMAS HEAD SHAW ...
and the remainder in trust for GEORGE JOHN SHAW the fifth son of the
said Reverend JOHN SHAW and... after his decease in trust for the
first and every son of GEORGE JOHN SHAW ..... [details of the entail
and investment of funds for the trusts] ....And I do hereby revoke
all former wills by me at any time heretofore made and do declare
and publish this as my last Will and Testament and I appoint the
said Reverend JOHN SHAW WILLIAM DUNN and JOHN HIND Executors of this
my will in Witness whereof I the said JOHN HEAD the Testator have to
this my last Will and Testament set my hand and seal ... 16 January

This is a Codicil to the Last
Will and testament of me JOHN HEAD of Cumming Street Pentonville in
the county of Middlesex.... Whereas I have given devised all and
singular my lands tenements and hereditaments ..... unto and to the
use of the Reverend JOHN SHAW of Cottenham in Cambridgeshire and
WILLIAM DUNN of Newsham near Richmond in Yorkshire gentleman and
JOHN HIND of Gales near Richmond .... Now I do hereby revoke the
said devise .. and do hereby give devise and bequeath the same...
unto the said Reverend JOHN SHAW .... for the same ends intents and
purposes .... and whereas I have given unto GRACE HUSBAND the widow
of WILLIAM HUSBAND... £199 and to DAVID ARMSTRONG £100 ... both of
which legacies I hereby revoke ... and whereas I have given and
bequeathed to JOHN JOHNSON £100 which I do hereby reduce to the sum
of £50.... and whereas I have given and bequeathed to WILLAIM DUNN
£200 and to each of his sisteres ALICE and ELLEN £30 ... I hereby
revoke the said last mentioned bequests and in lieu thereof I given
and bequeath unto WILLIAM DUNN £50 only ..... and whereas I have
directed my trustees to pay unto ANN WILKINSON who now lives with me
... an annuity of £250 paid by Reverend JOHN SHAW , WILLIAM DUNN and
JOHN HIND ... now I revoke the said appointment and in lieu thereof
do hereby appoint the said Reverend JOHN SHAW be my sole executor
... in Witness whereof I have hereunto set my hand and seal 6 June
1839
