The Will of Robert Hayward
In the Name of God Amen I ROBERT HAYWARD the elder
of the City of London Silk Dyer do make and ordain this my last will and
testament
in writing as followeth
principally I recommend my Soul to the hands of my gracious God trusting
for salvation by and through the merit of the death and passion of my
Lord and Saviour Jesus Christ and my body I leave to be decently buried
at the discretion of my executor herinafter named and appointed at or in
the parish Church of All Hallows the Great in the City of London and as
to touching my worldly estate do make this my last Will and Testament as
followeth that is to say
And first I do hereby ratify and confirm three several Deeds of
Settlement relating to my Estate in the City of Bath the first bearing
date the twenty eighth day of April in the year of our Lord one thousand
seven hundred and thirty eight and made between me the said ROBERT
HAYWARD the elder of the City of London Silk Dyer of the first part and
JOSEPH HAYWARD Citizen and Cooper of London and JOHN PONSAX Citizen and
Haberdasher of London of the other part the second Deed being tripartite
bearing the date the tenth day of March in the year of our Lord one
thousand seven hundred and thirty nine and made between me the said
ROBERT HAYWARD the elder by the name ROBERT HAYWARD the elder of the
City of London Silk Dyer of the first part ELIZABETH HAYWARD my daughter
by her addition therein named of the second part and JOSEPH HAYWARD and
JOHN PONSAX by their several additions therein named of the third part
and the third Deed consisting of five parts bearing date the fourteenth
day of December in the year of our Lord one thousand seven hundred and
fourty four and made between me the said ROBERT HAYWARD the elder of the
City of London Silk Dyer of the first part ELIZABETH HAYWARD of the
parish of All Hallows the Great London, spinster daughter of the said
ROBERT HAYWARD the elder of the second part ROBERT HAYWARD the younger
of the City of London Silk Dyer of the third part EDWARD ALLAN of the
parish of St. Andrews Hubbard London Gentleman of the fourth part JOSEPH
HAYWARD Citizen and Cooper of London and JOHN PONSAX Citizen and
Haberdasher of London of the fifth part. And I do hereby give devise and
bequeath all and singular the messuages or tenements and premisses their
and every of their appurtenenances in the said three several settlements
mentioned and expressed which I have already made of the before recited
premisses to be enjoyed for the uses Trusts intents and puposes for the
several and respective term and terms and estates and under the several
charges in the same three several tenements and specified appointed
limited and declared concerning the same and according to the true
intent and meaning of the said three several Deeds of Settlement.
Item. I give and bequeath unto my son ROBERT HAYWARD in trust to and for
my said daughter SARAH GRISDALE for her own proper peculiar and separate
use and benefit the sum of two hundred pounds to be paid within three
months next after my decease excluding the said ROBERT GRISDALE her
husband or any after taken husband and that the same nor any part
thereof shall not be liable or subject to the demand debts or
incumberances of her said husband or of any after taken husband and that
the reciept or aquittance of the said SARAH GRISDALE for the same or any
part thereof or the interest or produce thereof to be paid or recieved
shall notwithstanding her coveture from time to time be taken to be as
good and effectual and binding to all intents and purposes as if the
said SARAH GRISDALE were solo and unmarried at the time of signing the
same and I do order and direct my said son to place the said two hundred
pounds out at interest upon the best security he can get if my said
daughter SARAH GRISDALE shall think proper and futher to pay as well the
said principal as the interest thereof in case my said daughter shall
require it to any person or persons or to such intents and purposes as
my said daughter SARAH GRISDALE at any time or times hereafter
notwithstanding her coverture be she solo or marryed shall by any Deed
or writing in her life or by her last Will and Testament in writing duly
executed by her in the presence of two or more credible witnesses direct
of appoint which said sum of two hundred pounds together with one
thousand pounds I gave and advanced with her on her marriage with the
said ROBERT GRISDALE shall be and is as well in full of all her right
claim and demand whatsoever as of her said husband ROBERT GRISDALE in
right of his said wife of in to or out of all my estate or estates
whatsoever and wheresoever.
Item. I give devise and bequeath unto my son ROBERT HAYWARD in trust to
and for my said daughter MARGARET BRUNSKALL for her own proper peculiar
and separate use and benefit the sum of two hundred pounds to be paid
within three months next after my decease excluding the said THOMAS
BRUNSKALL her husband or any after taken husband and that the same nor
any part thereof shall not be liable or subject to the demand debts or
incumberences of her said husband or any after taken husband and the
reciept or aquittance of the said MARGARET BRUNSKALL for the same or any
part thereof or the interest or produce thereof to be paid or recieved
shall notwithstanding her coverture from time to time be and taken to be
as good effectual and binding to all intents and purposes as if the said
MARGARET BRUNSKALL were solo and unmarried at the time of signing the
same and I do order and direct my said son to place the said two hundred
pounds out at interest upon the best security he can get if my said
daughter MARGARET BRUNSKALL shall think proper and futher to pay as well
the said principal as the interest thereof in case my said daughter
shall require it to any person or persons or to such intents and
purposes as my said daughter MARGARET BRUNSKALL at any time or times
hereafter notwighstanding her coverture be she solo or married shall by
Deed or writing in her life time or by her last Will and Testament in
writing duly executed by her in the presence of two or more credible
witnesses direct or appoint which said sum of two hundrded pounds
together with one thousand pounds I gave advanced with her on her
marriage with the said THOMAS BRUNSKALL shall be and is as well in full
of all her right clain and demand whatsoever as of her said husband
THOMAS BRUNSKALL all shall in right of his said wife of in to or out of
all my estate and effects whatsoever or wheresoever.
Item. I give and bequeath unto my kinswoman MRS. SARAH GOODALL the sum
of forty pounds of like lawful money to be paid her by my said executor
within three months next after my decease.
Item. I give and bequeath unto each of my kinswomen MRS. ELIZABETH
GOODALL ANN GOODALL and MARY ELKINGSTONE the sum of twenty pounds a
piece of like lawful money to be paid to each of them by my said
executor within three months next after my decease.
Item. I do hereby give and bequeath unto my said son ROBERT HAYWARD the
younger his executors administrators and assigns the Messuage or
Tenement Dyehouse and premises wherein I now dwell in All Hallows Lane
together with the lease of the same and all my estate right title and
interest therein or thereto together with all coppers and other
implements in trade and stock in trade.
Item. I give and bequeath unto my three grandchildren sons and daughter
of my daughter MARGARET BRUNSKALL the sum of one hundred pounds of
lawful money of Great Britain a piece.
Item. I give and bequeath unto my daughter ELIZABETH HAYWARD all and
singular my household goods linen plate and furniture whatsoever which
shall at the time of my decease be in the house at Hackney wherein I now
dwell all the rest residue and remainder of my estate both real and
personal whatsoever and wheresoever I give devise and bequeath unto my
said son his heirs and assigns for ever saving and exept what I have
made the settlements of as in the said three several Deeds of Settlement
are hereinbefore mentioned and except what I have herein before given
ordered or bequeathed subject to the payment of the several legacys and
my just debts and funeral expenses.
Item. It is my will and mind and I do herby order direct and declare
that the said rent charge of seventy pounds a year to my daughter
ELIZABETH HAYWARD mentioned in the last Deed of Settlement together with
the four hundred pounds mentioned to be raised in and by the said last
mentioned Deed of Settlement and the household goods to her herby
devised shall be and is in full of all her right claim and demand
whatsoever of into or out of all my estate or estates whatsoever and
wheresoever.
And it is my further will that if the said ROBERT GRISDALE and SARAH his
wife or either of them sue molest or impeach or endeavour to impeach or
disturb my said son ROBERT HAYWARD or any of them their or any of their
executors or administrators for or concerning the said ratified
settlements or any of them or anything therein or in any of them
contained limited or expressed or the disposition of my estate or any
part thereof in and by this my last will and testament given and devised
that then and in such case I do hereby limit and appoint that my said
son ROBERET HAYWARD shall have recieve retain and take to his own proper
use and behoof the said sum of two hundred pounds as devised in trust
for her the said SARAH GRISDALE as aforesaid any custom law or usage or
any thing herein contained to the contrary thereof in anywise
notwithstanding.
And it is my further will that if the said THOMAS BRUNSKALL and MARGARET
his wife or either of them do sue molest or impeach or endeavour to
impeach or disturb my said trustees or my said son ROBERT HAYWARD or any
of them or their executors or administrators in for or concerning the
said ratified setlement or either of them or anything therein contained
limited or expressed or the disposition of my estate or any part thereof
in and by this my last will and testament given and devised that then
and in such case I do hereby limit and appoint that my son ROBERT
HAYWARD shall have recieve retain and take to his own proper use and
behoof the said sum of two hundred pounds so devised in trust for her
the said MARGARET BRUNSKALL as aforesaid any custom law or usage or
anything herein contained to the contrary thereof in anywise
notwithstanding.
And I do hereby nominate and appoint my said son ROBERT HAYWARD full and
sole executor of this my last will and testament in writing and lastly
do hereby revoke make null and void all former and other wills by me at
any time heretofore made. In witness whereof I have set my hand and seal
this fourteenth day of December in the year of our Lord one thousand
seven hundred and forty four.
ROBT. HAYWARD-- signed sealed published and declared by the said ROBERT
HAYWARD the testator the words following (Debts pounds the younger and
the household goods to her promised) being first interlined in the first
skin of the within written will and the words forllowing from I give and
bequeath unto my three grandchildern sons and daughter of my said
daughter Margaret Brunskall the sum of one hundred pounds of lawful
money of Great Britain a piece from I give and bequeath unto my daughter
Elizabeth Hayward household goods and furniture being also first wrote
upon the several --------s in the said first skin of the said will and
also the words following said thing proper being also first interlined
in the second skin of the said will. As for his last will and testament
and we whose names are hereunto written have at his request and in his
presence and in the presence of each other of us subscribed our names as

This will was proved at London before the Worshipful Edward Skinaston
Doctor of Laws Surrogate of the Right Worshipful John Bettesworth also
Doctor of Laws Master Keeper or Commisssary of the Prerogative Court of
Canterbury lawfully constituted the twenty second day of January in the
year of our Lord one thousand seven hundred and forty five by the oath
of ROBERT HAYWARD the sole executor naned in the said will to whom
administration was granted of all and singular the goods chattels and
credits of the deceased being first sworn duly to administer.
