The Will of Henry Harvey

 

In the Name of God Amen
I Henry Harvey of Little Stoke in the County of Oxford Malster being in good health of Body and of sound and perfect memory and understanding thanks be to God for the same calling to mind the uncertainty of Life and that it is appointed for all fflesh ours to ? do make and ordain this my last Will and Testament in writing in manner following that is to say ffirst and principally I commend my soul into the Hands of Almighty God who gave it hoping for Eternal Bliss in the Kingdom of Heaven by and thro this alone ? and Intercession of my blessed Saviour and Redeemer Jesus Christ and my body I commit to this Earth from where it was taken to be decently buried by my executors herein afternamed near my ffather and Mother in the Middle Alley Leading to the Belfry in the parish church of South Stoke in the said county of Oxford and I desire my executors herein afternamed may set up with a monument with such Inscription thereon as they in their judgement shall think fit and proper against the Northside of the said Church and as touching such Worldly Estate as the Lord in Mercy hath bestowed upon me i do give and despose thereof as followeth

Imprimus Whereas I have given unto my late daughter Martha the late Wife of Mr Joseph Hopkins the Sum of ffive hundred and Eighty Pounds as her Marriage Portion and I being possessed of an Estate in South Stoke aforesaid which I hold by copy of Court Roll of the manner of South Stoke aforesaid for the Term of my Life and of the lives of my daughters Mary Harvey and Dinah the wife of Mr Thomas Hudson which Estate after my decease will go to my said daughter Mary as the next life named in the said Copy and after her decease to my said daughter Dinah as the third and last Life named in the said Copy and whereas I have given unto my said daughter Dinah the sum of ffour hundred and ffifty pounds as her portion upon her Marriage and it being my mind and intention to make all my three daughters or their representations equal in point of ffortune I do therefore give and bequeath unto my said daughter Mary the Legacy or sum of ffour hundred and Eighty of lawfull money of Great Britain to be paid unto her by my executors herein afternamed immediately after my decease

Item I give and bequeath unto my said daughter Dinah the Legacy or Sum of ninety pounds of like Lawfull Money to be paid unto her by my executors herein afternamed immediately after my decease Which said sums so given to my said daughters Mary and Dinah together with their respective Interests in my said Copyhold Estate I look upon to be equal with the sum given unto my said late daughter Martha

Item I give and bequeath unto my granddaughter Martha Hopkins the legacy or sum of twenty pounds of like Lawfull Money to be paid unto her at the age of one and twenty years or day of Marriage which shall first happen and in the mean time and until the same shall become payable I do order it to be paid to or retained by her ffather Mr Joseph Hopkins

I do hereby nominate constitute and appoint my said sons-in-law Mr Joseph Hopkins and Mr Thomas Hudson the Executors of this my last Will and Testament and for their trouble to be had therein i do hereby give unto each of them the legacy or sum of Ten Pounds of like Lawfull Money

Item all the rest and residue of my Goods Cattle Chattels ready money debts owing and personal Estate whatsoever not herein before by me given and disposed of my Debts Legacys and ffuneral and Testamentary Expenses being first paid and discharged I do order to be divided into three equal shares One whereof I give and bequeath unto and amongst all my grandchildren the children of my said late daughter Martha Hopkins deceased equally to be divided between them share and share alike and to be paid unto them respectively at their respective ages of one and twenty years and if any or either of my Grandchildren shall happen to dye before they shall attain their said age then I do give and order the share of him her or them so dying to go and be paid unto and amongst the survivor or survivors of them share and share alike and my Will is and I do hereby order that the said share so given unto my said Grand Children shall be paid unto my said son-in-law Mr Joseph Hopkins who shall have the use and benefit thereof until it becomes payable as aforesaid

Item One other share thereof I give and bequeath unto my daughter Mary to be paid or delivered unto her immediately ater my decease by my Executors herein afternamed and the other and last share thereof I give and bequeath unto my said daughter Dinah but my Will is and I do hereby expressly order and direct that before the said share be paid or delivered unto my said daughter or her said husband ? the said Thomas Hudson to give and enter into bond unto the said Joseph Hopkins in double the sum the said share shall amount unto with condition for him to leave the Interest thereof unto his said wife during her Life and after her decease to leave the principle to and amongst her children in such shares and proportions as he shall think proper to be paid unto them immediately after the decease of them the said Thomas Hudson and Dinah his Wife and for want of such I ? them to pay the same immediately after the decease of the survivor of them the said Thomas Hudson and Dinah his Wife unto such person or persons and in such shares and proportions as my said daughter Dinah by any Deed or Writing or by her Last Will and Testament in Writing attested by two or more Credible Witnesses shall notwithstanding her Coverture give direct or appoint the same and for want of such Gift Direction appointment to pay the same unto the Executors or Am'ors of my said daughter Dinah and Lastly I do hereby revoke all former Wills by me heretofore made either by Word or in Writing and do declare this to be my Last Will only In Witness whereof I the said Henry Harvey the testator have hereunto set my hand and seal this twelfth day of September in the Year of our Lord One thousand seven hundred and Sixty three the Mark of Henry Harvey this Will containing two sheets of paper each sheet was signed and sealed and both together published and declared by the said Testator as and for his last Will and Testament in the presence of us who suscribed our names as Witnesses hereunto in the presence of the said Testator and of each other Ben Hodges Richard Toovey
