The Will of Roger Harrocks

 

In the name of God Amen the eighteenth day of July in the twentieth year of the reign of our most Gracious Sovereign Lord Charles the second by the Grace of God king of England Scotland France & Ireland Defender of the Faith and Anno Domini one thousand six hundred sixty eight years I Roger Harrocks of Aughton in the county of Lancaster husbandman being sick & weak of body but of good and perfect memory (thanks be to Almighty god for the same) and  int? to  avoid all birons? of strifes, troubles and controversy amongst my wife and children after my death I do hereby revoke and renounce all former & other wills & testaments whatever heretofor by me made by word writing or otherwise and I make and ordain this to be my very hour? last and only will and testament in manner and form following.  And first I commend my soul into the hands of Almighty god my heavenly father by whom of his mercy? and only grace & mercy I trust to be saved and writ? into eternal life through the ? of the death and passion of my saviour and redeemer Jesus Christ in whose purbried blood I set the whole and only hope of my salvation my mortal and frail body (in hope of a joyful resurrection) I remit to this earth to be buried in the parish church of Aughton on such decent and convenient manner as my executors hereafter named shall think fit.  And as touching the disposition of all such temporal estate both real and personal as it hath pleased god to bless me with I give devise and bequeath of the former in manner and form following.  And first as touching the disposition of all that messuage and tenement, wherein I now live and hold by lease from Lawrence Ireland of Lydiate in the county of Lancaster Esq for forty four and nineteen years leherminal? and upon the lives of me the said Roger Harrocks Margaret my now wife and of Thomas Harrocks my eldest son and of the life of the longest liver of us, I give devise and bequeath the moiety and one half of the said messuage & tenement houses premises and buildings closes parcels of land & ?ises with the appurtances to the said moiety and one half belonging unto Margaret my said wife & her assigns for and ? such ? of the said ? of forty four and ninteen years as at my death shall be unexpired (if she the said Margaret Harrocks my said wife shall happen for long to live, and from and after the death and decease of Margaret my said wife it is my will and mind and I give devise and bequeath the moiety and one half of the same messuage and tenement lands and premises (for ? unto my wife as aforesaid) unto the said Thomas Harrocks his executors and assignes from the death of my said wife for and int? all the rest residue and remainder of the said lease granted in ? by the said indenture of lease as aforesaid. And as concerning the other moiety of the said messuage tenement lands premises & here ? with the appurtances thereunto belonging I give devise and bequeath thew same unto my said son Thomas Harrocks his executors and assigns for sand ? all the w? and remainder of the said lease of forty four and nineteen years ? able as aforesaid (and granted by the said I? Of lease as aforesaid) as at my death shall be unexpired and not ?mined. And that he the said Thomas Harrocks or his assigns shall immediately upon his ? into possession of the said moeity of the messuage and tenement after my death will and hereby content ? & ? unto James Harrocks and John Harrocks my two younger sons the sums of ten pounds equally to be divided between them.  And for my goods chattels and personal estate not disposed of as aforesaid it is my will and mind that my debts, funeral expenses and charges of the probate of this my last will shall be taken out of my said whole personal estate, and after my said debts paid, funeral expenses and charges of probate hereof defrayed it is my will and mind that the remainder thereof shall be divided into two equal parts, the one moiety whereof I give and bequeath unto my said wife Margaret Harrocks and the other moiety thereof I give and bequeath unto James Harrocks and John Harrocks my two younger sons and equally to be divided between them share and share alike; and for the av? Of differ? Between the said wife and sons Thomas Harrocks in this division of my said will estate after my death I appoint my loving brother George Harrocks and my loving B?man John Leatherbarrow of Aughton believing them to make division of the said messuage & tenement between my said wife and sons Thomas share and share like arrou?ing? To this my said will.  And lastly I give unto Roger Barton son of Richard Barton of Aughton my godson the sum of twelve pennies? And lastly I name constitute assign and appoint Margaret Harrocks my said wife sole executrix of this my said last will and testament hoping she will see the same in all things well and faithfully performed as my trust is reposed in her. And in witness thereof I the said Roger Harrocks have hereunto set my hand and seal the day and year first above written.
