This is the last Will and Testament of me
Alice HANKINSON of WOOLSTON in the County of Lancaster spinster
made and published in the Thirteenth day of September in the
year of our Lord One thousand seven hundred and eighty.
I give to my Great Niece Alice HANKINSON
(Daughter of my Nephew Robert HANKINSON my Oak Desk --- All my
Linnen I give to my five Nieces, that is to say , Elizabeth
HANKINSON, Mary ROLLS, Mary BROMILOW, Margaret KEMP and Rachel
NORRIS to be equally divided among them share and share alike
and all my Wearing apparel I give to my five last mentioned
Nieces and Mary LITHERLAND Wife of John Litherland of Woolston
aforesaid Husbandman to be equally Divided among them share and
share alike.
I give devise and bequeath all my Real
Estate and also all my Personal Estate (Except what I have
herein before specifically disposed of) unto my Nephews Robert
HANKINSON of Woolston aforesaid Husbandman, Peers BROMILOW of
Rixton in the said County Husbandman Richard KEMP of
Martinscroft in the said County Husbandman and Joshua TAYLOR of
Woolston aforesaid Innkeeper their Heirs Executors
Administrators and Assigns Upon the Trusts and to and for the
several uses Intents and purposes hereinafter mentioned
expressed and declared of and concerning the same, that is to
say Upon Trust That they the said Robert Hankinson Peers
Bromilow Richard Kemp and Joshua Taylor and the Survivors and
Survivor of them and the Heirs Executors Administrators and
Assigns of such survivor shall and do immediately or so soon as
conveniently may be after my decease sell and dispose of my said
Personal estates and of the ffee simple and Inheritance of my
said Real Estates at and for the best price and prices and for
the most money that can or may be reasonably had or gotten for
the same, and I do hereby declare that the Receipt or Receipts
of them the said Robert Hankinson Peers Bromilow Richard Kemp
and Joshua Taylor or of the Survivor or Survivors of them or of
the Heirs Executors administrators or assigns of such Survivor
shall be sufficient discharge and discharges to the purchase or
purchases of my said Real or Personal Estates and after the
Payment of such Purchase money such Purchaser or Purchasers
shall not be in any wise responsible for or liable to see to the
Application of the same nor chargeable with or accountable for
any loss or misapplication thereof but shall be wholly and
entirely discharged therefrom.
And as for and concerning the Money
arising and to arise by such Sale or Sales as aforesaid . It is
my Will and Mind and I do hereby order and direct and appoint
the said Robert Hankinson Peers Bromilow Richard Kemp and Joshua
Taylor and the Survivors and Survivor and the Heirs Executors
Administrators and Assigns of such Survivor to pay apply and
dispose thereof in manner and form following, that is to say.
In the first place to pay satisfy and
Discharge all my Just Debts funeral expences and the charges of
the Probate and Execution of this my Will and the Trusts thereof
and in the next place to pay the sum of Six pounds to Sarah
ABRAHAM widow Margaret ABRAHAM and Sarah ABRAHAM Spinster all of
Warrington in the said county or the Survivor or Survivors of
them. To my Servant John LITHERLAND the sum of five pounds and
to the said Mary Litherland the Mother of the said John
Litherland One Guinea and as for and concerning the residue of
the purchase money arising and to arise by such Sale and Sales
as aforesaid from and immediately after such payments and
deductions as last mentioned.
Upon Trust to divide the same into three
equal parts or shares one third part whereof I give bequeath and
dispose of in manner and form following, that is to say, I will
order and direct the same to be placed out at Interest and the
Interest thereof to be paid and applied to the use of my Brother
Henry HANKINSON and his assigns from time to time during the
Term of his natural Life and from and immediately after his
decease I will order and direct the said principal of the said
third part and all Interest due for the same to be divided into
five equal parts or shares One fifth part whereof I order and
direct to be paid to my Nephew Peter HANKINSON his Executors
administrators and assigns one other fifth part thereof to my
said Nephew Robert HANKINSON his Executors Administrators and
Assigns.
One other fifth part thereof into and
equally amongst the Eight children of my late Nephew Henry
HANKINSON, that is to say John Hankinson Peter Hankinson Henry
Hankinson Robert Hankinson James Hankinson, Elizabeth Hankinson
Jane Hankinson and Mary Hankinson and their respective Executors
Administrators and Assigns equally share and share alike and in
case any of them shall happen to Die in the meantime unmarried
and without issue the parts or shares of him her or them so
Dying to go and be paid unto and equally amongst the Survivor
and Survivors of Them share and share alike.
One other fifth part thereof unto and
equally amongst the five children of my late nephew Thomas
HANKINSON, that is to say, James Hankinson, John Hankinson
Elizabeth Hankinson Rachel Hankinson and Ellen Hankinson and
their respective Executors Administrators and assigns equally
share and share alike and in case any of them shall happen to
Die in the meantime unmarried and without issue the part or
shares of him her or them so dying to go and be paid unto and
equally amongst the Survivors and Survivor of them equally share
and share alike.
And the remaining fifth part thereof I
order and direct to be paid to my Great Niece Elizabeth GATLIVE
the only Daughter of my late Nephew John Hankinson her Executors
Administrators and Assigns.
And as for and concerning one other third
part or share of the said money arising and to arise by such
sale and sales as aforesaid from and immediately after such
payments and Deductions as aforesaid I will order and direct the
same to be paid into and equally amongst the five children of my
late Brother John Hankinson, that is to say, James Hankinson,
John Hankinson, Thomas Hankinson, Mary Rolls and Elizabeth
Hankinson and their respective Executors Administrators and
Assigns equally share and share alike and in case any of them
shall happen to Die in the mean time unmarried and without Issue
the parts or shares of him her or them so Dying to go and be
paid unto and equally amongst the Survivors and Survivor of them
if more than one equally share and share alike.
And as for and concerning the last and
remaining third part or share of the said Money Arising and to
Arise by such Sale or Sales as aforesaid and immediately after
such payments and Deductions as aforesaid I will order and
direct the Principal of the said last mentioned third part or
share to be paid and divided into and equally amongst the five
children of my late sister Jane Kemp deceased, that is to say
Thomas Kemp, Richard Kemp. Mary Bromilow, Margaret Kemp and
Rachel Norris and their respective Executors Administrators and
Assigns equally share and share alike and in case any of them
shall happen to Die in the meantime unmarried and without Issue
the parts or shares of him her or them so Dying to go and be
paid unto and equally amongst the Survivors or Survivor of them
share and share alike and I do hereby declare it to be my Will
Mind and Intention that my said Trustees or the Survivors or
Survivor of them or the Heirs Executors and Administrators or
assigns of such Survivor shall not be answerable or accountable
for more of my said Trust Estates Monies and premises than shall
actually come to his or their respective hands nor with or for
any loss or Deficiency thereof if the same is not owing to
wilfulness or neglect nor shall they or any of them be
answerable or accountable for each other or for the Acts Deeds
or Defaults only.
And lastly hereby revoking all former
Wills and Testaments by me at any time heretofore made and I
Publish and declare this to be my last Will and Testament and
thereof nominate and appoint the said Robert Hankinson Peers
Bromilow Richard Kemp and Joshua Taylor Executors. In Witness
whereof I the said Alice Hankinson the Testatrix have hereunto
set and put my hand and Seal the day and year first before
written.
Signed Sealed Published and Declared by
the said Testatrix Alice Hankinson as and for her last Will and
Testament in the presence of us who have hereunto subscribed our
names as Witnesses to attest the same at her request and in the
