The Will of Daniel Hall

 

In the Name of God Amen I Daniel Hall of Dorking in the County of Surrey Cooper being in good health of body and sound and disposing mind and memory but being very aged and Considering the uncertainty of this mortal life doe therefore make this last Will and Testament and ffirst and principally I commend my soul unto the hands of my Creator hopeing for a full pardon of my Sins through the Intercession of my Redeemer and a Joyfull Resurrection at the last Day my body I Committ to the Earth to be decently buryed at the Discretion of my Executor hereinafter named and as for those worldly Goods and Estate wherewith it hath pleased Allmighty God of his Goodness to bless me I dispose thereof as followeth Imprimis I give and Devise unto the poor of the parish of Dorking the sume of ffive pounds either to be paid in money or distributed in bread at the discretion of my Executor Item I give and devise unto my Sister in Law Christian Ede one Annuity or yearly Sume of fforty Shillings to be paid unto her by my Executor yearly and every year during her Naturall life at Michals and Lady Day be even and equall portions the ffirst payment to begin at such of the days as shall first happen after my Decease and Whereas Peter Ewes of Cranley in the County of Surrey Wheelwright by his Deed of Trust bearing Date the first day of December one thousand seven hundred and thirteen hath declared that all that Messuage ffarming Lands Tenements and hereditaments with the Appurtenances commonly called or known by the name of Glyndens......Land and Heathfeild situate lying and being in the parish of Shipley in the County of Sussex were conveyed unto him the said Peter Ewes and his Heirs upon Trust that he the said Peter Ewes and his heirs shall Convey the same to such person and persons and for such Estate and Estates as I the said Daniel Hall should by my Deed or last Will duely executed in the presence of three Credible Witnesses direct and Appoint I do by this my last Will and Testament Direct and Appoint the said Peter Ewes to Convey the said Messuage and Lands with the Appurtenances unto Henry Billinghurst of Wonersh in the County of Surrey Yeoman and William Gardiner of Dorking aforesaid Maltman and their heirs to and for the uses of the said Peter Ewes for and during the Term of his naturall life and from and after the Decease then to the use of Peter Ewes the younger John Ewes and Daniel Ewes Sons of the said Peter Ewes the Elder and their Heirs and Assigns for ever Item I give and devise all that Messuage of Tenement Barn ffarm Lands and Hereditaments to and with the Appurtenances commonly called or known by the Nameor Names of Pollingfold and Millfeilds alias Haynes Situate lying and being near Oatwood Chappell in the Parish of Abinger als Abingworth in the said County of Surrey and all those my three Messuages or Tenements Barn Gardens and Orchards with the Appurtenances Situate lying and being in Dorking aforesaid unto the said Peter Ewes the Elder his heirs and Assigns for ever Subject Nevertheless and lyable unto the charges Legacies and Trusts hereinafter mentioned that is to say upon Trust that the said Peter Ewes his heirs and Assigns shall out of the rents and proffitts of the said Messuages and Lands well and truly pay the Sume of ten pounds free of all Taxes yearly and every year during the Joint lives of Thomas Briggs of Horsham and my Neice Mary Briggs his Wife by equall Quarterly payments the ffirst payment to begin at the end of three months next after my Decease to such person and persons for such uses as the said Mary Briggs by any Note in Writing by her to be signed in the presence of two credible Witnesses separate and apart from her said Husband shall direct and Appoint to the Intent the Same may not be Subject or lyable to the intermedling debts or Engagements of the said Thomas Briggs her Husband Provided always that the receipt of the said Mary Briggs in Writing under her hand for the same or so much thereof for which such receipt shall be given Shall be a sufficient Discharge unto the said Peter Ewes his Heires and Assignes and in case the said Mary Briggs shall Survive her said Husband then the said Peter Ewes his Heires and Assignes shall pay unto her the clear yearly Sume of ffifteen pounds dureing her naturall life by Equall quarterly payments as aforesaid Item I give and devise unto Daniel Briggs Jane Briggs and Mary Briggs Son and Daughters of my said Neice Mary Briggs the Sume of Two Hundred Pounds apiece to be paid unto them by the said Peter Ewes the elder his Heires and Assignes out of the said Messuages and Lands herein before Devised at their Severall and Respective ages of four and twenty years and if any of them shall happen to die before their said age of four and twenty years my Will is that their Legacies shall not be paid to their Executors or Administrators and it is my Will that the said Peter Ewes his Hieres and Assignes shall pay Interest for the said Legacies after the rate of four pounds per Cent per Annum to be by him and them applyed towards the Education and Maintenance of the said Daniel Briggs Jane Briggs and Mary Briggs or putting them out to Trades so that their ffather or Mother shall not intermeddle with the same Provided always and it is my Express Will that if the said Mary Briggs my Neice shall directly or indirectly abstruct or hinder the Proof or Execution of this my last Will and Testament then she shall lose and be absolutely debarred from the Estates and Legacies herein before devised unto her all the reast and Residue of my Messuages Lands Goods Chattells Leases Mortgages reall and personall Estate whatsoever not hereinbefore disposed of I give and Devise unto the said Pater Ewes the Elder his heires Executors and admonistrators respectively and Lastly I make Constitute and Appoint the Said Peter Ewes the Elder Sole Executor of this my last Will and Testament and have published and Declared the same Conteining three sheets of paper and to every of the said Sheets have sett my hand and seale this Ninth day of July in the twelth year of the Reigne of our Soveraign Lord George by the Grace of God of Great Brittain ffrance and Ireland King Defender of the ffaith Anno Domini 1726  Daniel Hall
