The Will of Ann Gulliford
This is the last Will and Testament of me Ann
Gulliford of Trudoxhill in the parish of Nunney in the County of Somerset
Widow I appoint Joseph Crees of Berkley in the said County of Somerset
Farmer and my son Richard Charles Gulliford Executors of this my Will and I
give unto the said Joseph Crees the sum of five pounds as a slight
acknowledgement for his trouble in acting as such Executor I give unto my
daughter Sarah Jane, the wife of William Coombs three hundred pounds I give
unto my daughter Betsy the wife of William Henry Lear two hundred pounds I
give unto Benjamin White of North Brewham in the County of Somerset Labourer
fifty pounds And I direct that the foregoing legacies shall be paid out of
my personal estate within or at the expiration of twelve calendar months
from the day of my death as my Executors shall think fit I give and devise
unto the said Joseph Crees and Richard Charles Gulliford and the survivor of
them and the heirs of such survivor and their or his assigns (all of which
persons and other the Trustees or Trustee appointed under the power for that
purpose hereinafter contained or by a Court of competent Jurisdiction whilst
they or he respectively shall be acting under the trusts hereof are intended
to be included in and denoted by the expression “my trustees and trustee”
hereinafter made use of ) All that house and garden and piece of pasture
land containing by estimation one acre and two roods situate at Trudoxhill
in the parish of Nunney in the County of Somerset in the occupation of
William Case as tenant with the rights easements and appurtenances thereto
belonging And also all that orchard which I purchased of Mr Parfitt situate
at Trudoxhill aforesaid with the rights easements and appurtenances thereto
belonging And also all that cottage which i purchased of James Burlton
situate in the parish of North Brewham in the county of Somerset in the
occupation of the said James Burlton as tenant with the rights easements and
appurtenances thereto belonging Upon trust to receive the rents and profits
thereof and to pay the same unto my daughter Fanny the Wife of Luke Cannon
during her life and after her decease Upon trust to sell the same under the
power for that purpose hereinafter contained and to divide and pay the net
proceeds of the said sale unto and equally between the child or all such
children of the said Fanny Cannon who shall be living at her decease and
such issue as shall be then living of any of her child or children then
deceased and their his and her executors administrators and assigns if more
than one and so that the children and remoter issue of any deceased child
may take by substitution the share only which the present would if living
have taken And if the said Fanny Cannon shall die without leaving issue who
shall become entitled under the trust last hereinbefore contained then upon
trust to divide and pay the said net proceeds of the said sale unto and
equally between my child or all such of my children as shall be then living
and such issue as shall be then living of any of my child or child_ then
deceased and their his and her executors administrators and assigns if more
than one and so that the children and remoter issue of any deceased child
may take by substitution the share only which the parent would if living
have taken
I give and devise unto my Trustees and Trustee all that my house and lands
containing by estimation five acres and two roods situate at Kilmington in
the County of Somerset in the occupation of the said Luke Cannon as tenant
with the rights easements and appurtenances thereto belonging And also all
that portion of the property in the occupation of the said Richard Charles
Gulliford which includes all the property I purchased of the said James
Burlton situate in the parish of North Brewham aforesaid other than the
aforesaid cottage and premises hereinbefore devised for the benefit of my
daughter Fanny and her children with the rights easements appurtenances
thereto belonging Upon trust to receive the rents and profits thereof and to
pay the same unto my said son Richard Charles Gulliford and his assigns for
his life and after his decease Upon trust to sell the same under the power
for that purpose hereinafter contained and to divide and pay the net
proceeds of the said sale unto and equally between the child or all such
children of the said Richard Charles Gulliford who shall be living at his
decease and such issue as shall be then living of any of his child and
children then deceased and their his and her executors administrators and
assigns if more than one and so that the children and remoter issue of any
deceased child may take by substitution the share only which the parent
would if living have taken And if the said Richard Charles Gulliford shall
die without having issue who shall become entitled under the trust last
hereinbefore contained Then Upon trust to divide and pay the said net
proceeds of the said last mentioned sale unto and equally between my child
or all such of my children as shall be then living and such issue as shall
be then living of any of my child or children then deceased and their his
and her executors administrators and assigns if more than one and so that
the children and remoter issue of any deceased child may take by
substitution the share only which the parent would if living have taken I
give and devise unto my Trustees and Trustee All that my Farmhouse and lands
containing by estimation Thirty three acres or thereabouts situate at
Trudoxhill aforesaid in my own occupation with the rights easements and
appurtenances thereto belonging Upon trust to receive the rents and profits
thereof and to pay thereout unto my said daughter Fanny an annuity of ten
pounds for her life to be paid by two equal half yearly payments the first
of such payments to be made at the expiration of six calendar months from my
decease with a proportionate part thereof from the half yearly day of
payment next preceding the death of the said Fanny Cannon to the day of her
death and subject to the said Annuity Upon trust to pay the rents and
profits of the said last mentioned Farmhouse and lands after paying thereout
all repairs insurance and other outgoings in respect of the same unto my
said son Frederick Gulliford and his assigns for his life And after his
decease Upon trust to sell the same under the power for that purpose
hereinafter contained and to divide and pay the net proceeds of the said
sale unto and equally between all my grandchildren who shall be living at
the decease of the said Frederick Gulliford other than the child or children
of the said Fredrick Gulliford by his present Wife I give devise and
bequeath all the residue of my real estate chattels real and personal estate
and effects whatsoever and wheresoever including therein all lapsed and void
gifts and devises unto my Trustees and Trustee In trust to call in and sell
and convert into money all such parts thereof as shall not consist of money
and thereout to pay my debts funeral and testamentary expenses and legacies
and the costs incurred in and about the execution of the trust of this my
Will and subject thereto In trust for and equally between my child or all
such my children as shall be living at my decease and such issue as shall be
then living of any of my child or children then deceased and their his and
her executors administrators and assigns if more than one and so that the
children and remoter issue of any deceased child may take by substitution
the share only which the parent would if living have taken And I declare my
Will to be that in order to give effect to the trusts for sale hereinbefore
contained my Trustees and Trustee shall have power from time to time to sell
and dispose of the property subject thereto by Public Auction or Private
Contract in one lot or in several lots and subject to any conditions as to
title or otherwise and generally in such manner as my Trustees and Trustee
shall think fit and to convey the lands and hereditaments and property so
sold respectively to the respective purchasers thereof and to give receipts
for the purchase money which shall effectually discharge such purchaser and
purchasers fromthe moneys expressed in such receipts to have been received
and from any liability to see to the application thereof And also that any
legacy gift or devise hereinbefore given to or in trust for any woman who is
or shall be under coverture is to be for the separate use and benefit of
each such married woman apart from her husband for the time being and, that
no such married woman who shall become entitled during the time within which
property may be lawfully rendered inalienable is to anticipate the said
legacy or gift or the moneys payable to her under any trust hereinbefore
contained or to charge the same by way of anticipation and that the receipt
of each such married woman shall alone notwithstanding coverture be a
sufficient discharge for any money payable to her And I declare that
vacancies occurring in the Trusteeship under this my Will from death in my
lifetime or otherwise disclaimer resignation unfitness or incapacity may
from time to time be supplied by the other Trustee for the time being or if
none such then by the disclaiming or resigning Trustees or Trustee or their
or his Executor or Executors administrator or administrators respectively
And I exempt every trustee of my Will from liability for losses occurring
without his own wilful default and authorise him to retain and allow his
Co-trustee or Co-trustees any expenses incidental to the Trusteeship And I
declare that the powers and discretions hereinbefore vested in my Trustees
hereinbefore mentioned shall be exercisable by the Trustees or Trustee for
the time being of my Will In Witness whereof I have hereunto set my hand
this twenty seventh day of December One thousand eight hundred and seventy
nine

to be her last Will and Testament in the presence of us who
being
present together at the same time have hereunto at her request
in
her presence and in the presence of each subscribed our names
as Witnesses ......... the words in the 7th 8th and 9th lines
from the
end of the 1st page having been first struck out and the same
having
been previously read through to her and she appeared
thoroughly to understand the same

Proved at Wells the 14th day of June 1880 by the Oaths of Joseph Crees and
Richard Charles Gulliford, son of the deceased, the Executors named in the
Will, to whom Administration was granted:-
The Testatrix Ann Gulliford was formerly of Trudox Hill in the Parish of
Nunney but late of North Brewham both in the County of Somerset Widow and
died on the 4th day of May 1880 at North Brewham aforesaid
