The Will of George Gravatt

 

This is the last Will and Testament of me George Gravatt of Ewhurst in the County of Surrey Farmer ffirst I direct all my just debts funeral expences and testamentary charges to be paid as soon as conveniently may be after my decease And I bequeath unto my daughter Mary the wife of George West the sum of nineteen shillings and unto my daughter Mary the wife of Thomas Copping the sum of ten pounds and I direct the said legacies to be paid within twelve calendar months next after the decease of my wife Mary but to be vested immediately on my decease and I devise and bequeath unto my brother in law John Blanch and my son George Gravatt all my real estate whatsoever and wheresoever and also all my goods chattels rights redits moneys securities for money Personal Estate and Effects whatsoever which I may be possessed of at the date of my decease to hold the same (aforesaid) to the nature and tenure thereof respectively unto them the said John Blanch and George Gravatt their heirs executors administrators and assigns upon trusts following (that is to say) upon trust that they or he my said trustees or trustee shall and may exercise and carry out or not as their or his own discretion may think fit and if at all for so long a time only as they or he may think proper my trade or business of a ffarmer and do and shall employ therein such sums of money by way of capital or otherwise as they or he may think necessary and do and shall sell and convert into money such of my said personal estate and effects as may be necessary from time to time for carrying on my said trade or business and collect get in and receive all moneys owing to me at the time of my decease and do and shall lay out and invest the moneys to arise in the manner aforesaid from my said personal estate in their or his names or name in or upon the public stocks or funds or other Government securities or any real securities in Great Britain (but not in Ireland) with full power from time to time as often as occasion may require to vary or transfer all or any of such stocks bonds and securities And upon trust to receive and take the rents dividends interest proceeds and profits of all my said real and personal trust estates moneys business and premises s and pay the same unto my dear Wife Mary Gravatt or empower her to receive the same during her natural life for her own absolute use and from and immediately after the decease of my said wife I direct that the said John Blanch and my said son George Gravatt or the survivor of them his heirs executors administrators and assigns to stand seized and possessed of all my said real and personal trust estate and premises and the stocks funds and securities in or upon which the same personal estate or any part thereof may be invested and all other my trust property (subject to the aforesaid legacies) In trust for my said son George Gravatt and my son Henry Gravatt in equal shares as tenants in common and their respective heirs executors administrators and assigns absolutely Provided always and I declare that notwithstanding anything hereinbefore contained it shall be lawful for the trustees or trustee of this my will at any time or times and from time to time during the life of my said wife at their or his absolute discretion to advance and pay unto and for the benefit of my said wife out of the principal of any trust monies or securities which for the time being may be vested in them or him under or by virtue of this my will any sum or sums of money they or he may think proper And I do declare that no trustee of this my will shall be personally responsible for any loss except such as may happen by his wilful neglect and every trustee shall be allowed his full costs and shall allow the same to his cotrustees And I appoint my said brother in law John Blanch and my said son George Gravatt joint Executors of this my Will and Lastly I hereby revoke all former wills In witness whereof I have hereunto set my hand this ninth day of January one thousand eight hundred and fifty
