The Will of Nicholas Gotty
In the name of God Amen
I Nicholas Gotty of Cowden in
the County of Kent Yeoman being
of a sound mind memory and
understanding praised be to God
for the same do make publish and
declare this to be my last Will
and Testament in writing in
manner and form following (that
is to say ffirst I will order
and direct that all such just
debts which I shall owe at the
time of my decease my funeral
expenses and the charges of
proving this my will shall be
paid and discharged by my
executors hereafter named out of
my personal estate Also I give
and devise unto my loving wife
Elizabeth and her assigns for
and during the term of her
natural life if she so long
continues my widow and unmarried
all and every my messuages lands
tenements and hereditaments
whatsoever with their
appurtenances wheresoever the
same shall be situate lying and
being she my said wife keeping
all and every the Buildings
thereunto belonging in good and
tenantable repair and from and
after the decease or marriage
which first shall happen Then I
do hereby give and devise one
moiety or equal half part
thereof with the appurtenances
unto my daughter Elizabeth now
the wife of Edward Hall of
Hartfield in the County of
Sussex Yeoman and her assigns
for and during the Term of her
natural life and from and after
her decease I give and devise
the moiety unto and amongst all
and every the child and children
as well sons as daughters of my
said daughter Elizabeth and to
their heirs and assigns forever
equally to be divided between
them share and share alike as
tenants in common and for want
of such child or children Then I
give and devise the same moiety
unto my own Right heirs forever
I also give and devise the other
Moiety or equal half part
thereof with the appurtenances
unto my daughter Sarah and her
assigns for and during the term
of her natural life and from and
after her decease I give and
devise the same unto and amongst
all and every the child and
children as well sons as
daughters of my said daughter
Sarah and to their heirs and
assigns forever equally to be
divided between them share and
share alike as Tenants in common
and for want of such child or
children then I give and devise
the same unto my own right heirs
forever Also I give and bequeath
unto my Brother Edward Gotty and
Joseph Smelling of East Grinsted
in Sussex Miller and to the
survivor of them and the
executors and administrators of
such survivor all and every my
goods chattels and personal
estate whatsoever which I shall
be possessed off at the time of
my decease Upon Trust that they
my said executors or the
survivor of them or the
executors or administrators of
such survivor shall and do with
all convenient speed after my
decease make sale of all and
every of my said Goods and
Chattels which I shall dye
possessed off or be any ways
intitled unto and the money
arising by such sale after my
just debts funeral expenses and
the charge of proving this my
will shall be fully paid and
satisfied shall and so together
with all my ready money put and
place the same out of Interest
upon some Government or other
Real Security and after the same
shall be so put and placed out
at Interest shall and do yearly
and every year pay the interest
and produce thereof unto my said
loving wife Elizabeth and her
assigns for and during the Term
of her natural life if she so
long continues my widow and
unmarried by two half yearly
payments in the year The first
payment thereof to begin and be
made on the next half year day
after the same shall be so put
and placed out at interest as
aforesaid and from and after the
decease or marriage of my said
wife which shall first happen
then I do give and bequeath the
principle money arising by the
sale of my said Goods and
Chattels together with my ready
Money so put and placed out at
Interest as aforesaid and the
Interest thereof unto my said
Two daughters Elizabeth the wife
of Edward Hall and Sarah Gotty
and to their executors and
administrators equally to be
divided between them share and
share alike And I do hereby
desire my said Trustees
immediately to take an inventory
of all my Goods Chattels and
personal Estate after my decease
and I do hereby make nominate
and appoint them the said Edward
Gotty and Joseph Smelling Joint
executors of this my last Will
and Testament desiring both of
them to see the same only
performed and I do hereby divert
and order that my said Trustees
and Executors shall not be
accountable for the loss of any
of that Trust Money so to be put
out by them as aforesaid at
Interest without the same is by
his or their wilfull neglect or
default only and that they shall
retain to him or themselves all
such reasonable costs and
charges which they or either of
them shall bear pay or be put
unto upon account of the Trusts
hereby reposed in them or either
of them and I do hereby revoke
all former Wills by me at
anytime heretofore made and do
declare this only to be my last
Will and Testament In Witness
whereof I have to this my last
Will and Testament contained in
two sheets of paper to each
sheet thereof set my hand and
seal this thirtieth day of May

the said Nicholas Gotty the
Testator as and for his last
Will and Testament in the
presance of us who in his
presence and at his Request
