The Will of John Gorton

 

 I John Gorton the Elder of no 4 Cleveland Street Ffitzroy Square in the County of Middlesex,  smith, hereby revoking all wills by me at any time therefore made to make publish and … this my last will and testament in writing in manner following that is to say I appoint my sister Hannah King executrix and John Hall of Charles Street Hampstead Road carpenter executor of this my will I give and bequeath unto the said Hannah King and John Hall and also unto my sons Joseph Gorton and Benjamin Gorton the sum of two hundred pounds sterling upon trust to invest the same in their names in the purchase of three pounds per …consolidated Bank amenities and it is my will that they my said trustees and the survivor of them and the executors administrators and aforesaid of such survivor do and shall pay unto or …. My son John Gorton to receive the interest dividends and annual proceeds thereof upon trust and to the intent that he may apply the same in and towards the maintenance … (education?) benefit and advantage of such of the children and aim the said John Gorton as shall from time to time be under the age of twenty one years.  And it is my will and I do hereby direct that when and so soon as the youngest of the children of my said son John Gorton whether born in my lifetime or after my death shall attain the age of twenty one years that they my said trustees and the survivor of them and the executors and administrators of such survivor shall transfer the said principal start funds and promises at unto and equally between such of the children of my said son John Gorton as shall then be living if more than one and if only one then to award one child I give unto my children John Gorton Joseph Gorton Benjamin Gorton Rhoda Edwards and Mary Rosewell  the sum of one hundred pounds a piece I give unto my wife all the rest residue and remainder of such property estate and effects as I shall be possessed of or entitled unto at the time of my decease for her own use and benefit subject to the payment of my just debts funeral and testamentary expenses and my reason for not in this my will making further provision for my said wife or any provision for my daughter Elizabeth Gorton is that the former will be entitled to an annuity of one hundred and twenty pounds a year and the latter to an annuity of sixty pounds a year under the arrangement I made on giving up my trade or business unto my said sons Joseph and Benjamin and I declare that if any of my legatees shall die in my life time leaving a child or children such children or child shall receive the legacy which would otherwise have been payable to his her or their father or mother.  In witness whereof I leave hereunto I set my hand and seal this twenty seventh day of January one thousand eight hundred and forty two.  John Gorton seal.  Signed sealed and published and declared by the said John Gorton the testator as and for his last Will and Testament in the prosecute of us who at the same time at his request in his present and in the presence of … other have subscribed our names as witnesses hereto – J H Chamberlain 42 Grafton St East Fitzroy Square solicitor – Thomas Elliot Clerk to Mr Chamberlain.

 

At London the second day of March eighteen hundred and forty two.

 

I John Gorton the Elder of no 4 Cleveland Street Ffitzroy Square being desirous of altering my last Will and Testament veering the date the twenty seventh day of January last so far as regards the provision therein in favour of my son John so hereby desire and direct my trustees therein named when and so soon as the child or children which he now has by his present wife shall have all reached the age of twenty one years complete to pay over or transfer to my said son John the sum mentioned in my said will of two hundred pounds three per … consolidated Bank Annuities for his own absolute use and benefit free from any interference or participation thereon by his children or any of them their and each of their right and interest herein on the youngest having attained majority do aforesaid being hereby declared to … and determine and I declare this present writing to be a codicil to my said last Will and Testament and that the same shall be … together and in all other respects I confirm my said Will.  John Gorton - seal – signed sealed published and declared by the said John Gorton as and for a codicil to his last will and testament in the presence of us who at the same time at his request and in the presence of each other have subscribed our names as witnesses hereto – Hannah King - Joseph Gorton

 

Proved at London 18th Sept 1843 with a codicil before the worshipful Alfred Waddison … of laws and surrogate by the oaths of Hannah King widow the sister and John Hall the executors to whom Admon was granted having been first sworn duly to administer

NOTES: 

John Gorton was baptised in Rugeley Staffordshire on 11 aug 1765, son of John and Sarah.  He died on 29 march 1843 in Marylebone London. 

He was married to Mary Clements on 4 march 1794 at St Mary’s in Lichfield, Staffs.  John Gorton was a music smith, as were several of his descendants.
