The Will of Mary Gittins

 

This is the last Will and Testament of me Mary Gittins of Wem in the County of Salop Widow whereas my late dear husband Edward Gittins in and by his last Will and Testament in Writing bearing date the twenty second day of October one thousand eight hundred and fourteen directed that from and immediately after my decease his Trustees therein named or the Survivor s or Survivor of them or the executors or Administrators of such Survivor did and should raise and levy by and out of the rents issues and profits of certain hereditaments and Premises situate in Tewksbury in the County of Gloucester mentioned and comprised in a certain term of five hundred years therein set forth or by sale or mortgage thereof or of a competent part there of for all or any part of the said term the Sum of Seven hundred pounds and pay and apply the same to such person or persons or uses as I should in and by my last Will and Testament in Writing direct and appoint the same the same Now I do in and by this my last Will and Testament direct and appoint give and bequeath the said Sum of Seven hundred pounds to the persons hereafter mentioned and in the shares and proportions following (that is to say) To my son Edward Gittins fifty eight pounds part thereof To my daughter Mary fford ffifty eight pounds other part thereof To my son William Gittins ffifty eight pounds other part thereof To my son Thomas Gittins ffifty eight pounds other part thereof To my son Richard Gittins ffifty eight pounds other part thereof To my daughter Hannah Gittins one hundred and forty pounds other part thereof To my son Philip Gittins ffifty eight pounds other part thereof To my son Josiah Gittins twenty pounds other part thereof To my said son Thomas Gittins the Sum of thirty eight pounds part thereof Upon Trust to pay the same to my Grandson Edward Johnes Gittins son of my son Josiah Gittins in his attaining the age of twenty one years and to apply the Interest thereof in the mean time from my decease towards the maintenance and education of my said Grandson Edward Johnes Gittins Provided always and my Will is that in case my said Grandson Edward Johnes Gittins shall die without attaining the age of twenty one years Then upon Trust to pay the said Sum of Thirty eight pounds unto my said Son Josiah Gittins if he shall be alive and living in England at the decease of my said Grandson Edward Johnes Gittins but if he shall be then dead or living beyond the seas then Upon Trust to pay the same sum of thirty eight pounds unto all and every of my Children who shall be living at the decease of my said Grandson Edward Johnes Gittins their Executors Administrators & Assigns share and share alike and as to fifty eight pounds other part of the said Sum of Seven Hundred Pounds In Trust to pay the same to my Son James Gittins I give and bequeath unto my said Daughter Hannah Gittins all my household goods and furniture plate linen and china I give and bequeath to my Executors and Executrix hereinafter named the Sum of three Pounds each as an acknowledgement for the trouble they may have in the execution of the trusts hereby in them reposed And as to all the Rest and residue of my Personal Estate and Effects of what nature or kind soever and wheresoever including the part of the said Sum of seven hundred Pounds not hereinbefore specifically bequeathed and appointed I give bequeath and appoint the same subject to the Payment of all my just debts funeral Expences and the Costs of proving this my Will unto my said daughter Hannah Gittins for her own use I nominate constitute and appoint my said Son Thomas Gittins and my said Daughter Hannah Gittins Executors and Executrix of this my Will And I hereby revoke all my former Wills and Testaments Provided also and my Will is that my said Trustees and Executors shall not be answerable the one for the other of them nor for any involuntary loss In Witness whereof I have to the first sheet of this my Will set my hand and to this second and last sheet thereof my hand and seal this twenty fourth day of July one thousand eight hundred and twenty Mary Gittins
