In the Name of God Amen I RICHARD GILDART of
Liverpool in the County of Lancaster Esq being of sound and
disposing mind and memory do make publish and decalre this my last
will and testament I commit my soul to Almighty God and my body I
direct to be privately and decently Buried in my Burial place or
vault in the Parish Church of Our Lady and St Michael in Liverpool
aforesaid where my dear wife and son JOHNSTON GILDART lie interred
And as for that worldly estate which it hath pleased God to bless me
with I give and dispose thereof as follows First I will and order
that all my just debts Funeral Expences and the probate of this my
last will be fully paid and satisfied and as I here ?...? tofore
advanced preserved in fortune and provided for all or most of my
younger children in my life time I give devise and bequeath hereunto
my daughter ELIZABETH GILDART her heirs executors and assigns all
those messuages dwelling houses and tenements buildings grounds and
other premises ... being in the south side of Dale Street in a
certain place called Sir Thomas's Hope Well or Buildings in
Liverpool aforesaid and now in the several tenures or occupations of
John Sweale, Richard Bury, John Moss, Peter Grund? and James
Stevenson and Co and others and which are lett by lease under the
Right Honourable the Earl of Derby made and granted to the said
ELIZABETH GILDART and wherein are the lives of the said ELIZABETH
GILDART and of my son THOMAS GILDART I also give and bequeath unto
my daughter ELIZABETH GILDART the sum of £50 in Lieu and full
satisfaction of all demands she may set up or make of my executors
touching ?....? matters of account between her and me in regard to
the Rent of the said premises and of all other her demands on me And
I hereby Give Devise and bequeath all that my messuage or dwelling
house and tenements with the Brewhouse and all other buildings Yard
Garden and Ground thereto belonging on the South side of Dale Street
aforesaid with their and every of their appurtenances now in the
possession of James ?Tutlock? Brown unto my daughter LYDIA GILDART
her heirs executors and admons I also Give and bequeath unto the
said LYDIA GILDART one moiety of half part of all my plate linen and
other household goods and furniture in my own present Dwelling
houses in Liverpool and West Derby in the County of Lancaster and
the other moiety of half part thereof I give and bequeath unto my
daughter ANN SHEERS the wife of SPENCER SHEERS merchant and direct
that my real Leashold or Personal Estates shall be applied to
execute both moieties thereof from my debts and Funeral Charges I
further give and bequeath to my said daughter ANN SHEERS the sum of
£50 I likewise Give and bequeath unto my daughter MARY OGDEN the
wife of EDMUND OGDEN merchant the sum of £50 I also give unto my
grandson RICHARD GILDART of London merchant 20 Guineas I give and
bequeath unto my grandson JOHN GILDART the son of my son GEORGE
GILDART deceased £100 I also give to my daughter ELLEN WHYTELL widow
20 guineas I give to my son FRANCIS GILDART £20 and also to my son
in law the said Mr SPENCER SHEERS I give £20 And as to the rest and
residue of my messuages lands tenements and heredits and all other
of my real and personal estates of what nature or kind soever
whereof I shall die siezed or possessed or any ways interested in or
Intitled unto in possession Remainder or Reversion save and except
such part thereof as is hereinbefore devised ... I give devise and
bequeath the same ... to my Executors hereinafter named .... upon
this Trust .... that they shall pay off and discharge all the Trust
Debts and Funeral Expences together with the above ... legacies ...
then I give devise and bequeath all the rest and residues remainder
.... unto my eldest son JAMES GILDART ... and I do hereby
consititute make and appoint the said FRANCIS GILDART, SPENCER
SHEERS and my son THOMAS GILDART executors... I hereby revoke all
other wills and testaments ... In witness whereof I have hereunto
set my hand and seal 21 September 2nd year of George III 1763

A Codicil ...... [I have] given unto my
daughter ELLEN WHYTELL of Liverpool widow the sum of £20 having
before on her marriage given her a portion but now considering her
circumstances and family I hereby give and bequeath the said ELLEN
WHYTELL .... the further sum of £200 to be paid ... within 12 months
next after my decease ..... 23 June 1764

Proved at London 23 February 1770 by the oath
of Francis Gildart son of the deceased.
