The Will of John Henry Gell

 

I Jno Hn Gell of the Parish of Ickenham in the County of Middlesex hereby revoke all former Wills Codicils and Testamentary dispositions by me heretofore made & declare this to be my last Will & Testament written by my own hand I give devise and bequeath all the messuages lands tenements hereditaments monies securities for monies stocks funds shares chattels and other real & personal Estate of every kind or I am now or at any time shall be seized possessed or entitled either at law or in Equity or of which I have or at my death shall have power to dispose by Will (subject to the payment of my funeral and testamentary expences and debts or securities for debts unto and to the use of my Wife Charlotte Gell her executors administrators & assigns absolutely except the inlaid china table in the Entrance room of my dwelling house and all my Oriental China which I have long ago given to the niece of my said Wife Catherine Eliza Cowes should she be living at the time of my death and my said Wife (Provided always And I do hereby declare that if Jessie Maria Hawkins Hamilton now residing with me shall after the respective deaths of myself and my said Wife be desirous of occupying my freehold cottage adjoining my said residence with the garden & appurts to the said Cottage she shall be permitted so to do rent free she keeping the same in tenantable repair & duly insured against loss by fire & paying the rates taxes & other outgoings in respect thereof But if the said Jessie Maria Hawkins Hamilton shall not occupy the said Cottage or shall cease to occupy the same then my friend Thomas Truesdale Clarke of Swakelys if living shall be entitled within six calendar months thereafter to purchase the same at a price to be fixed by Mr Fassnidge of Uxbridge (who built the same for me) or by any other with him to be nominated by the said Thomas Truesdale Clarke and should the said Mr Fassnidge be dead then by some other to be named by my acting Exor or Executors or by an Umpire to be named by such two persons and such price shall be paid to my acting Exor or Executors for the time being & their or his receipt in writing shall be a sufficient discharge for the same and after payment of all expences the same shall become and form part of the residue of my Estate and it shall be lawful for such Exor or Exors to invest such purchase money in any funds or stock they judge fit Provided lastly that if the said Jessie Maria Hawkins Hamilton shall determine on occupying the said Cottage and my said friend Thomas Truesdale Clarke should prefer building a similar one on freehold ground or elsewhere to be approved by the said Jessie Maria Hawkins Hamilton giving in the whole half a quarter of an acre of ground & making a Conveyance of the same to my Exors he shall be at liberty to do so such new Cottage or house having the same convenience of water as the present Cottage has And I desire it to be understood that the said Jessie Maria Hawkins Hamilton should she not occupy the said Cottage shall not be at liberty to lett the same but with the consent of the said Thomas Truesdale Clarke And in the event of the said Thomas Truesdale Clarke declining either to purchase it or to build another elsewhere as aforesaid & in exchange for it the same to be sold as aforesaid hereby nevertheless giving to my said Wife should she see fit full power to revoke the permission hereby given to the said Jessie Maria Hawkins Hamilton to enjoy the said Cottage And I do hereby nominate and appoint my said Wife and my friend Robert Marsh to whom I do hereby give and bequeath Three hundred and twenty pounds of the Cloisters Westminster Abbey Executrix and Executor of this my last Will and Testament In witness whereof I have hereunto set my hand and seal this twelfth day of October One thousand eight hundred and fifty three _Jno Hy Gell
