The Will of Anthony Gell

 

This is the last Will and Testament of me Anthony Gell of the Little Cloisters Westminster Abbey I desire to be buried in the Great Cloisters Westminster Abbey ........ in a private manner at the discretion of my Executrix & Executors hereinafter named & whereas I did several years ago give up unto my eldest son John Henry Gell the Office or business of secretary  to the present Bishop of Winchester & the Income & Profits arising therefrom by means whereof & by his unremitting attention to the business of his profession he has succeeded to various other lucrative offices & is in a very prosperous way & already in possession of a very good income which he very deservedly merits & is entitled to & whereas he may at my decease if he chooses & can make it convenient succeed me in divers appointments & situations which would prove to ... a further considerable & lucrative addition to his present yearly Income I feel it is in every way incumbent upon me & which is my sincere wish & intention to make the best provision in my power for the comfortable support of my dear Wife ffrances Gell (the eldest daughter of Joseph Dalby late of Welbeck Street Cavendish Square Surgeon & Apothecary) 7 the rest of my family & first I give & bequeath unto my said  dear Wife ffrances Gell & her assigns so much Stock Part of my Property standing in my name in the five per Cent Real Bank Ann. Or on the three per Cent Consolidated Bank Annuities or in any other of the Public ffunds which at the time of my decease will produce ffifteen hundred pounds Stock in three per Cent Consolidated Bank Annuities to be transferred to her absolutely within two months next after my decease by my Executors & Trustees hereinafter named & the like sum of ffifteen hundred pounds Stock in the said three per Cent Consolidated Bank Annuities to be by them in like manner to my said Daur ffrances Kynninmond absolutely within six months next after my decease for her own proper use & benefit Also I give & bequeath unto my two sons John Henry Gell & William Egerton Gell all that my dwelling house with the Appurts situate in Old Palace Yard & Poets Corner Westminster which I hold on lease for forty years from & under the dean & Chapter of Westminster In trust to pay the net  yearly Rent & Rents which they my said Sons & Trustees may receive from time to time after my decease to my said Wife ffrances Gell or her assigns during the term of her natural life & after her decease I give & bequeath the said house & lease thereof unto my said Son William Egerton Gell his Exors Admors & Assigns for his & their own proper use & benefit together with all right & benefit aforesaid And my Will is that my said Executors & Trustees John Henry Gell & William Egerton Gell shall from time to time during the life of my said Wife ffrances Gell renew the said lease of the said House with the said Dean & Chapter whenever fourteen years shall be elapsed therein if a less term shall be therein elapsed at the time of the decease of my said Wife then to fill up the sd term to forty years & that all Expences attending such renewal be paid out of my Personall Estate or any part thereof as shall be thought most proper & convenient to be done Also I give & bequeath to them the said John Henry Gell & William Egerton Gell All that my dwelling house with the Orchard Garden Coach House Stable & all other the Premises with the Appurts thereunto belonging which I hold on lease from John Pratt Esq for a long term of years situate & being in the Clapham Road now called & known by the name of Clapham Rise in the County of Surry In Trust for the benefit & accommodation of  my said Wife ffrances Gell for her life if she chooses to live therein but if she should not chuse to occupy the same then my will is that my said Trustees do & shall let the said house & Premises on lease or other devise for the highest Rack Rent that can be gotten annually for the same & pay the rent & produce thereof half yearly or as soon as conveniently may be after receiving the same unto my said Wife or her Assigns during her life & after her decease my Will is that my said Trustees or the Survivor of them do sell & dispose of the said lease House & Premises for the remainder of the term of Years then to come therein & unexpired for the best & highest price either by private Contract or Public Auction at any time thereafter at their discretion that can or may be had & obtained for the same & vest the whole Purchase Money & all Profits may happen to derive & arise from the time of the decease of my said Wife (after deducting all charges & expences that may happen on that account) in their joint names or the name of the survivor in the five per Cent Real Bank Ann. Or in any other of the Public ffunds & transfer the said Stock & pay the Interest & Dividends arising from time to time half yearly or as soon as conveniently may be to such persons & in such proportions as are hereinafter mentioned that is to say to transfer one Moiety or half part of the sd Stock & pay the dividends thereof unto my Daur ffrances Kynninmond for her own proper use & benefit & as to the remaining Moiety of the sd Stock my Will is that my said Trustees do from time to time pay one moiety of the said moiety of the dividends which may arise & become due thereon unto my said daur ffrances Kynninmond to be by her applied towards the maintenance & education of her Daur & my Granddaughter ffrances Anne Kynninmond until she shall have attained the age of one & twenty years & when she shall be twenty one years then my Trustees to assign & transfer the said moiety of the said moiety of the sd Stock & all Dividends due thereon unto my said Granddaughter ffrances Anne Kynninmond for her own proper use & benefit & if my said daur ffrances Kynninmond should die before  my said Granddaughter ffrances Anne Kynninmond should attain the age of twenty one years then my Trustees to apply the Interest & Dividends arising thereon from time to time towards the maintenance & education of the said ffrances Anne Kynninmond until she shall be twenty one years & when she shall arrive to the age of one & twenty years then to transfer the said moiety of the said Moiety of the said Stock & pay all Dividends that shall be due thereon unto my said Granddaughter ffrances Anne Kynninmond for her own proper use & benefit & in case she should die before she is twenty one years then this bequest shall merge & sink into the Residue of my Personal Estate & as to the remaining Moiety of the moiety of the said Stock my Will is & I do hereby direct & desire that my said Trustees do from time to time apply the Interest & Dividends arising thereon for and towards the maintenance & education of my Granddaughter Octavia Baulard until she shall have attained the age of one & twenty years & when one & twenty years that my said Trustees do assign & transfer the said moiety of the said moiety of the said Stock & all Dividends that shall be due thereon unto the said Octavia Baulard to & for her own proper use & benefit but if she should die before she attains the age of one & twenty years this bequest shall cease & merge into the Residue of my Personal Estate & if that event shall take place my will is that my Exors & Trustees shall pay unto her ffather Joseph Charles Bauland one hundred pounds sterling for his own use & benefit also I give & bequeath unto my said Wife ffrances Gell All my Household ffurniture Linen Plate China Glass Books Prints Wine & every other Article & thing of what nature quality or value soever belonging to me or in her possession or on any part of the Premises at Clapham Rise or in any other house or houses she may happen to live for her own sole proper use & benefit & all Money & Property which she may have in her possession Also I give & bequeath unto my said Son William Egerton Gell all the household ffurniture Linen Plate Glass Wine & any other article & thing whatsoever belonging to me situate in my house in the little Cloisters Westminster as Receiver in the Dean & Chapter of Westminster also I give & bequeath to my said Son John Henry Gell all my Books in the Office there which are in general respecting Ecclesiastical Business  & also all manuscripts precedents & documents relative thereto or otherwise & all other Papers Books & Articles whatsoever there belonging to me & my Will is that no part of the Property which I have already given & bequeathed or may hereafter give & bequeath by this my last Will & Testament unto my said daughter ffrances Kynninmond or my said Granddaughter ffrances Anne Kynninmond shall be liable or subject to the Debts or Controul of any Husband or Husband with whom they or either of them may respectively intermarry but that their Respective Receipts & Releases alone shall be proper discharges to my Exors & Admors for the same & all profits arising therefrom & with respect to Carminative Medicine called and universally known by the name of Dalby’s Carminative  I do hereby give & deliver up agreeable to the wish & request of my said Wife ffrances Gell the receipt given to her by her father the said Joseph Dalby for compounding preparing & making the said Medicine unto my said sons John Henry Gell & William Egerton Gell in order that they may be legally authorised & enabled from time to time to compound & prepare the same as they have for several years heretofore done for my said Wife ffrances Gell & supply Mrs ffrances Newbury therewith pursuant to certain articles of agreement entered into by & between the said Joseph Dalby & the said ffrancis Newbury I do give & bequeath unto my said sons John Henry Gell & William Egerton Gell the whole annual Profits arising from the Sale of the said Medicine in by them to the said ffrancis Newbury In trust for the following purposes namely ffirst to retain to each of themselves annually for their time & trouble in preparing & supplying the said ffrances Newbury therewith one.... part of the net Profits arising from the Sale of the said Medicine & then to pay the remainder annually to my said Wife ffrances Gell from time to time during her life & from & after her decease to pay the same from hereinafter stated namely to the said William Egerton Gell two tenth parts ffrances Anne Kynninmond two tenth parts & the said Octavia Bauland One tenth part of the net proceeds thereof making together the whole of the net annual profits arising from the Sale thereof If either of my said Sons should decline to compound & prepare the said Medicine & supply the said ffrances Newbury or his assigns therewith as heretofore has been done my Will is that my other Son shall & may compound & prepare the whole of the said Medicine & shall receive to & for his own proper use & benefit the said tenth part of the said net profits thereof as above given to each of my said Sons for their trouble in preparing the same & if both of my said Sons shall find it inconvenient to contrive to prepare the said Medicine & & supply the said ffrancis Newbury his Sons or assigns therewith then my Will is that the receipt for compounding & preparing of the same be offered to the said ffrances Newbury or his Assigns in order that he or they may have the refusal of purchasing the same at a fair & proper valuation which if he or they desire then that it be disposed of to any other person or persons & that the amount of that purchase money after deducting all charges & expences attending the same be divided & paid to & amongst the several following persons namely the said ffrances Kynninmond three tenth parts ffrances Anne Kynninmond three tenth parts the said Octavia Bauland one tenth part the said John Henry Gell one tenth part & the said William Egerton Gell two tenth parts also I give & bequeath unto my said sons John Henry Gell & William Egerton Gell their heirs & assigns all that my one thirty second share of the Lord M...... at Wirksworth in Derbyshire called Ranter otherwise Ravenhard with all Profits which may from time to time arise thereout or therefrom all the rest & residue of my Estate & Property of what nature soever I give & bequeath unto my said sons John Henry Gell & William Egerton Gell & my daughter ffrances Kynninmond & Grand daughter ffrances Anne Kynninmond to be equally divided between them share & share alike & lastly I do hereby nominate & appoint my said Wife ffrances Gell Executrix & my said sons John Henry Gell & William Egerton Gell Executors & Trustees of this my Will In Witness whereof I have to this my said last Will written upon five sheets of paper concluded on part of this fifth sheet set my hand at the bottom of each sheet & at the bottom of this testimony have set my hand & Seal this 14th day of June in the year of Our Lord 1815 Anthy Gell
