In the Name of God Amen. JOSEPH GARTH of Great
Queen Street Lincolns Inn Fields Coach Maker of St Giles Parish
being sound in health and mind blessed be God for the same do make
and publish this my last will and testament in manner and form
following that is to say First I bequeath my Soul into the hands of
Almighty God that gave it and as touching my temporal Affairs I give
and bequeath the same as follows to my daughter MARY ROUSE twenty
thousand pounds including the five thousand I settled on her for her
natural life and ?ayres? [heirs?] if she has any or?Faler?[failing?]
to my Sister's Children ? nowe ANN BIRBECK of Low Whitaside JANE
FURNOS of Healaugh and ELIZABETH DOWNS of Cover Head ?....? to them
or their Children share and share alike and to SHARLOT ASHBEY my
Companion five thousand pound for her life of her ayre forever.
Appeared personally RICHARD RUDD of Great
Queen Street in the parish of St Giles in the Fields in the County
of Middlesex Gentleman and ROBERT KILBYE COX of the same place
Esquire severally made oath that they knew and were well acquainted
with JOSEPH GARTH late of the said parish of Saint Giles in the
Fields in the said County of Middlesex deceased for Several Years
before and to the time of his death and during that time have
frequently seen him write and subscribe his name and thereby came to
know and be well acquainted with his manner and character of hand
writing and subscription and having viewed and carefully perused the
paper writing hereto annexed purporting to be the last will and
testament of the said deceased beginning this "In the Name of God I
Joseph Garth of Great Queen Street Lincolns Inn Fields coachmaker"
and ending thus : "and to Sharlot Ashbey my companion five thousand
pounds for her life or her ayre for ever" and without any date
thereto do depose that they verily and in their consciences believe
the whole ?S... and contents of the said paper writing to be of the
proper handwriting of the said JOSEPH GARTH. Richard Rudd, R K Cox.
Same day the said Richard Rudd and Robert
Kilbye Cox were duly sworn to the truth of this affidavit ...
then in the margin , lots of notes in very
tiny writing -
Oath 15 Day of December 1812 admin.... goods
and chattels and credits of Joseph Garth late of the Parish of St
Giles in the Fields in the County of Middlesex.... left Mary waring
(wife of Charles ?...? waring Esq) heretofore Rouse (Wife of the Rev
Ezekiel RouseClk) the natural and ?.....? and only child ofthe....?
deed since... and was granted to Elizabeth Waring spinster the
sister and sole Executrix of the will of the said Charles P...?
Waring deceased whilst living the Husband and ?...? of the Will of
the ?said? Mary Waring being first sworn ?.....? ..... and the said
Mary Waring formerly Rouse being ....? the Personal estate and
effects of the said deceased in ?...? he had died intestate.
On the 19 June 1782 administration with the
Will annexed of all and singular the Goods and Chattels and credits
of JOSEPH GARTH late of the Parish of Saint Giles in the Fields in
the County of Middlesex a widower deceased was granted to MARY ROUSE
wife of the Reverend EZEKIEL ROUSE Clerk, the natural and lawful
daughter of the said deceased and only child of the deceased she
having been first sworn duly to administer there being no executor
or Residuary Legatee named in the said will.
