In the Name of God Amen I John Gardner of
Uphampton in the Parish of Ombersley in the County of Worcester
ffarmer being of Sound and disposing mind memory and
understanding (thanks be to God) Do make this my last Will and
testament in manner following (that is to say) ffirst I will and
direct that all my just debts ffuneral and testamentary expences
are fully Paid and Satisfied out of my Personal Estate
hereinafter bequeathed unto my dear Wife Ann I give devise and
bequeath unto my said dear wife Ann All that Plot Piece or
Parcel of Land contained in about three quarters of an Acre
Situate and being at or near the top of Oldfield in the Parish
of Ombersley aforesaid allotted to me by the Commissioners named
and appointed in and by Act of Parliament passed for inclosing
Waste lands at or upon ffield Common To hold to her my said dear
Wife her heirs and Assigns for ever I give and bequeath the
Clear Sum of One thousand Pounds unto my Six Nephews and Nieces
namely William Lawrence John Lawrence Thomas Lawrence Joseph
Lawrence Harriot the Wife of William Buggins and Charlotte Wife
of James Sanders to be paid to and among them and the Survivors
of them Share and Share alike within twelve Calendar months next
after my decease Also I give and bequeath all my Household Goods
and ffurniture Plate China Linen and Woollen brewing Utensils
and barrells (both empty and full) unto my said dear Wife and my
Brother Thomas Gardner to be divided between them equally Share
and Share alike immediately after my decease to and for her and
his own absolute use and benefit Also I give and bequeath
immediately upon my decease unto my said Brother Thomas all and
Singular my ffarming Stock implements in Husbandry grain
thrashed and in the Straw ricks or Stacks of Hay and other my
ffarming Chattels to and for his own use and benefit but
nevertheless Subject and upon condition that he my said brother
do immediately upon my decease pay to my said dear Wife the Sum
of One hundred and ffifty Pounds of give his Note of hand for
the same Payable to her my said dear Wife at the expiration of
twelve Calendar months after my decease but without interest but
in case my said brother should refuse to take the said ffarming
Stock implements in Husbandry and other my ffarming Chattels and
Effects as aforesaid then and in such case I give and bequeath
the whole the said ffarming Stock implements in Husbandry and
other my ffarming Chattels and Effects unto my said dear Wife
absolutely to and for her own use and benefit And as to all the
rest and residue of my Personal Estate Chattels and Effects
(including my ready Money Securities for money moneys out at
interest and in the ffunds Mortgages or bonds bills of exchange
Promissory Notes and debts) not hereinbefore disposed of I give
and bequeath the same and every part thereof unto my said dear
Wife absolutely to and for her own use and benefit And I do
hereby declare that my said dear Wife will be handsomely further
Provided for by her ffree.... in my Copyhold Estates And lastly
I hereby nominate and appoint my said dear Wife And my said
Nephews John Lawrence and Thomas Lawrence Executrix and
Executors of this my last Will and Testament hereby revoking and
making void all former and other Will and Wills by me heretofore
made and do declare this only to be my last Will and testament
In Witness whereof I the said John Gardner have to this my last
Will and testament contained in two Sheets of Paper to the first
Sheet thereof Subscribed my hand and to this Second or last
Sheet Subscribed my hand and Seal this first day of January one
