The Will of Ann Fullager

 

I ANN FULLAGAR late Of Homerton in the parish of Hackney in the County of Middlesex and now of Newport in the Isle of Wight Widow and Relict of JOHN FULLAGAR late of Homerton aforesaid Esquire deceased hereby revoking all former Wills by me made do make and publish the following to be my last will and Testament and I do appoint          of Cheshunt Park in the County of Hertford Esquire and my Dear Son JOHN FULLAGAR Executors hereof And whereas under and by virtue of the settlement made previous to my marriage with my said late husband bearing date on or about the thirteenth day of July one thousand seven hundred and sixty two I as having survived my said Husband have a power of disposing by my last Will and Testament in writing to be subscribed in the presence of and attested by two credible witnesses of the sum of four thousand pounds ------ Bank Annuities hertofore Consolidated four pounds per cent Bank Annuities to and for the benefit of all and every our child or children in such parts shares and proportions and for such Estates and ------- as I shall think proper Now I do by this my last will and Testament subscribe by me in in the presence of and attested by the two or more persons whose names are intended to be ------- or written give direct limit and appoint the sum of two hundred pounds part of the said Bank Annuities unto my Dear Daughter HARRIET COOKE and the remaining part thereof unto my said Son JOHN FULLAGAR And I give and divise of my own property as follows I give and devise my ffreehold Dwelling House and my Leasehold  Chaise House stable and garden with their respective appurts. situate in the parish of St. Nicholas near Newport aforesaid and all other the premises which I lately purchased of Richard Brown and Thomas Pluppand or either of them unto my said son JOHN FULLAGAR his Heirs Execs Admins and assigns I give to the said Mr.           and my said               three per cent Consolidated Bank Annuities And in case I shall not die posessed of such a sum of the said Bank Annuities then I direct my said Trustees to purchase the same or so much as shall be necessary to stand possessed thereof Upon Trust to pay the dividends and proceed thereof unto or to permit or refer the same to be recieved by such person or persons and for such intents and purposes as my said Daughter HARRIET COOKE shall at any time or times during her life notwithstanding her Coverture by any writing or writings under her hand Direct or appoint and whom as such direction or appointment shall be made or in force In Trust to pay the same unto the proper hands of my said Daughter for her own sole and separate use and to the intent that the same may not be subject t or liable to the Debts Control or engagements of her present or any future Husband I direct that the reciept or reciepts of my said Daughter or such person or persons as she shall appoint to recieve the same shall from time to time notwithstanding her coverture be a good and sufficient discharge or discharges for the same And upon my said Daughters decease Upon Trust to transfer the said         Bank Annuities unto and among all and every such children of my said Daughter as shall be living at the time of her decease equally tto be divided amongst them share and share alike if more than one and if only one such child to such only child the shares of sons to be transferred and assigned to them upon the attainment of their respective ages of twenty one years and of Daughters upon their attainment of such age or marriage which sahll first happen And in case any of such children being Sons depart this life under the said age of twenty one years and or being Daughters under the said age and unmarried then In Trust to assign and transfer the share or shares of such deceased child or children unto the survivors or survivor of such children ------ his her  or their original share or shares shall become payable and --- --- herewith And I do hereby direct my said Trustees from time to time during the Minority of the said child or children to lay out and invest the Dividends or proceed thereof in their own names ---- and as the same shall in their own discretion amount to a competent sum in the public ffunds or of other Government Securities at their discretion in order that the same may accumulate and increase for the benefit of the said children such accumulations or savings of the said Dividends or proceed to be transferred and paid unto the said children or child together with their his or her respective shares of the said Bank Annuities But in case my said Daughter HARRIET COOKE shall depart this life without leaving any children or child by her present or any future Husband or leaving such they shall all depart this life being Sons under the said age of twenty one years and being Daughters under the said age and unmarried then I give the said             three per cent Consolidated Bank Annuities and the accumulations of the Dividends or proceeds thereof unto my said Son JOHN FFULAGAR for his own use and benefit I give to my Son in Law Mr. WILLIAM COOKE the sum of           hundred pounds sterling I desire Mr. CROMWELL to accept fifty pounds I give to my sister MRS. CROMWELL twenty guineas for Mourning to my Nephew JOHN MARCH twenty guineas for Mourning and to my Niece MRS. RUSSELL ten guineas for Mourning To MRS. COOKE of Newport twenty guineas for Mourning I give to my said Daughter HARRIET COOKE my own watch and seal and all my jewels rings Trinkets and personal ornaments of every kind and her ffather's picture in a Bracket and all my own Linen wearing apparel also my Shagreen Tea Chest with Silver Cannisters my Silver Spout --- with handles I give to my said Son JOHN FULLAGAR  the larger picture of his late father and my own picture which I ----- request he never will part with All the rest and residue of my estate and effects not herein before disposed  of after payment of my just debts  funeral and testamentary expenses I give and bequeath unto my said Son JOHN FULLAGAR for his own absolute use and benefit And I do hereby declare that it shall and may be lawful to and for my said Trustees and the survivor of them or such other Trustee or Trustees as shall at any timeeafter be chosen by virtue and in pursuance of the power hereinafter contained for that purpose during the continuance of the Trusts hereinbefore created to sell and dispose of the said sum of             three per censt consolidated Bank Annuities and to place and lay out the monies to arise therefrom in other Government or Public or upon Real Securties and from time to time as often as they shall see fit and such securities when so taken and all interest and dividends to grow due for the same shall be upon the same Trust as herein before ------- and declared concerning the said Bank Annuities or such of those as shall then remain unperformed And I do hereby declare that either of them my said Trustees nor their respective heirs Execs or Admins or any Trustee or Trustees hereafter to be chosen and appointed by virture of the power and authority hereinafter contained for that purpose oe their respective heirs Execs or Admins shall be chargeable with or accountable any more money than what they shall respectively actually recieve nor shall any of them or their heirs Execs or Admins be chargeable with or  for the acts reciepts or defaults of the other of them his Heirs Execs or Admins but each of them for himself and for his own acts reciepts and defaults only nor r any loss which may happen in or to the said Trust monies so that the same happen without their wilfull default nor for any other involuntary loss whatsoever And that it shall and may be lawful for my said Trusteees and the survivor of them and such other new Trustee or Trustees so to be appointed as aforesaid at all times in the first place to reimburse themselves out of the monies which they shall recieve by virture or this my will all such sum or sums of Money Costs and charges and Expenses as they or any of them shall or may at any time or times hereafter bear pay or be put unto in the execution of the Trusts hereby as the ------- in ----- in anywise relating them to And in case either of them the said            shall depart this life before the Trusts emposed in them by this my will shall be fully executed and performed then I direct the survivor of them by writing under his hand attested by two or more credible witnesses to nominate and appoint another person to be a Trustee for the purposes aforesaid in the place of such deceased Trustee and to and from time to time as often as then shall be occasion so that there may be always two Trustees of the said Trust ----- and when and so often as any new Trustee shall be chosen as aforesaid  the said Trust Monies or the stock ffunds or other Securites in which the same shall be then vested shall be thereupon ----------- with all------  ------- transferred and assigned so as that the same may be legally and officially vested in the surviving Trustee and such new chosen Trustee upon the Trusts aforesaid and every such new chosen Trustee shall and may act in the execution of the Trusts aforesaid in conjunction with the surviving Trustee as fully and effectually as if he or they had been appointed a Trustee or Trustees for the purpose aforesaid by this my will In witness whereof I have to the five ------ sheets of this my will and to a Duplicate thereof each contained  in six sheets of paper set my hand and to the sixth and last sheet thereof my hand and seal the third y of April in the Year of our Lord One thousand eight hundred and two  ANN FULLAGAR signed sealed published and declared by the said Ann Fullagar the Testatrix as and for her last will and testament in the presence of us who in her presence at her request and in the presence of each other subsribed our names as witnesses hereto

I ANN FULLAGAR of Newport in the Isle of Wight do make this codicil to my will I give to Mr. WILLIAM COOKE my Son in Law fifty pounds instead of the five hundred pounds which I have given him by my will which legacy  of 500 pound I do hereby revoke I give to my Daughter HARRIET COOKE his wife my silver coffee Pot and little waiter instead of the shagreen Tea Chest with the Silver Cannisters which I have given her by my will which legacy of the teas chest and Cannisters I do hereby revoke and I do give such Tea Chest and Cannisters to my Son JOHN FULLAGAR I desire to be buried in Bunhill ffields in the vault where the remains of my dear affectionate Husband and four children are interred

I ANN FULLAGAR of Newport in the Isle of Wight do make  this Codicil for my will which is the Second I have written My Linen Wearing Apparel and jewels I give to my Daughter HANNA SCALES FULLAGAR instead of my Daughter HARRIET COOKe as given by my will likewise I do hereby revoke what is mentioned in my will aboput the Trust and I give the Money therein mentioned to my Son JOHN FULLAGAR whom I now appoint my sole Executor and ----- by law the 3rd Day of March 1809    ANN FULLAGAR

 

I ANN FULLAGAR revoking the Duplicate of my will dated April 1802 confirm the will as altered by my Codicils

Dated May 1807 and March 1809  ANN FULLAGAR August 1809

 

In the Prerogative Cout of Canterbury 20th april 1814

On which day appeared personally Samuel Jones of Tower Street London one of the Clerks of the Bank of England Hester Hanna Scales of Stoke Newington in the County of Middlesex Gentlewoman Spinster and John Fullager of Newport in the Isle of Wight Esquire And first the said Samuel Jones and Hester Hanna Scales for themselves made oath and say that they knew and were well aquainted with Ann ffullagar formerly of Homerton in the parish of Saint John in Hackney in the County of Middlesex but late of Newport in the Isle of Wight Widow deceased for several years before and at the time of her death and having seen her write and subscribe her name are thereby become well aquainted with the manner and character of her handwriting and subscription and having now carefully viewed and persused the word "hundred" written upon an ---- upon  the twntieth line form the toop of the first page of the said will also the word 'part' written upon an --- upon the same line and also the same word written upon an ---- in the twenty second line of the same page of the said will and having now also viewed and perused the three codicils annexed to the said will the first of said Codicils beginning thus Ann Fullagar of newport in the Isle of Wight ----- ------ witness my hand the 18th day of May 1807 and ------ subscribed "Ann Fullagar" the second of said codicils beginning thus "John Fullagar" of Newport in the Isle of Wight ----- thus witness my hand the 3rd day of March 1809 and thus subscribed "Ann fullagar" the third Codicil being in the ---- following to wit Ann Fullagar revoking the duplicate of my will dated April 1802 confirming will as altered by my codicils dated May 1807 and March 1809 and they do verify in their consideration the said ---- written upon ---- upon the first page of the said will also the whole ----- and contents of the said three codicils beginning ----- and subscribed as aforesaid also the subscription of her the said Ann Fullagar widow deceased And the said John Fullagar Esq. for himself made oath that having now carefully viewed the several erasures in the said will of the said deceased ----- the erasures upon the ---- line of the first page  then two erasures on the twentieth line of the same page also the erasure in the 22nd line of the same page also the erasure in the last line of the same page of the said will also the erasure in the first line of the second page of the said will also the erasure on the eighteenth line from the top of the said second page of the said will also the erasure in the eighth thirteenth 15th 17th 18th 19th and last line of the third page or sheet of the said will also the erasures in the 11th and 17th lines of the fourth page of the said will and likewise the erasure in the tenth line of the fifth page or sheet of the said will this Deponent says that  the paper and ------ aforesaid purporting to be the last Will and Testament of the said Deceased together with the first said ----- first Codicils thereto remained sealed up in a tin Box in the Dwelling House of the said Deceased until the day of her death ------ in an envelope or cover and the Deponent having proceeded to open the said envelope or cover where the same were contained sealed up therein found the said will and two codicils and having looked at and viewed the same observed the several erasures now appearing in the said will and hereinbefore particularly described he lastly says that the said will is now in the very same ------ and condition in every respect as ----- he the Deponent attested ----- of the said deceased first and saw  the said will

Proved at London with the three Codicils 22nd April 1814 before the Worshipful Joseph Phillimore Dr. of Laws and Surrogate by the oath of John Fullagar the Son and Sole Executor to whom Administration was granted being first sworn duly to Administer. // A further Codicil proved 13th May 1814 //
