The Will of Hannah Fudge

 

In the Name of God Amen I Hannah ffudge of the Parish of Backwell in the County of Somerset Widow do make and Publish this my last Will and Testament in manner and form following that ........ I direct that my debts ffuneral expences & the costs of proving this my Will shall be paid by my Executor hereinafter named as soon as conveniently may be after my decease I give and bequeath unto my Neighbour James Vowles of Backwell aforesaid and to his heirs all that my Messuage Tenement or Dwellinghouse with the offices and Land thereto adjoining or belonging situate at and being near Mount Hill in the Parsih of Bitton in the County of Gloucester and in the Occupations of Isaac .... Bargeman and Thomas Meades as tenants thereof upon trust as soon as conveniently can be after my decease to absolutely sell and dispose thereof and every part to the best purchaser and purchasers that can be procured for the same and as to the monies to arise from such Sale or Sales to be made either by private Contract upon trust in the first place to pay all costs and charges attending such Sale or Sales and in the next place to pay off and discharge all Principal and interest monies due and owing upon Security of the same premises or any part thereof unto any Person or Persons and after full Payment and satisfaction of charges and Incumbrances then upon trust to pay divide and distribute the surplus of the monies arising from such Sale or Sales unto and equally amongst my eight Children namely Job Solomon Sampson Daniel & Aaron ffudge and Amy Wife of Joseph Gowen Anne Wife of John Jones and Maria Wife of Joseph Jones with the benefit of Survivorship amongst my said Children if any of them should die in my lifetime and in exclusion of the Children of such of my Children as as may happen to die in my lifetime and in case of any of my Children who are now abroad or otherwise about from me shall not return home and claim their share under this my Will within the space of twelve Calendar Months after my decease and in such case my mind and Will is that the share of him or her so absent and not making claim as aforesaid shall be distributed to and equally shared amongst my other Children and I hereby declare that the Receipt alone of my said trustee James Vowles or his heirs for the whole or any Part of the said Purchase Monies for all or any Part of the said Premises so devised to be sold as aforesaid shall be good valid and effectual discharges to the purchasers thereof to all intents and purposes nor shall such purchasers be in any manner bound to see the purchase monies applied or be answerable any loss or misapplication nor shall the Signature of any other person than the said James Vowles or his heirs be necessary to vest the legal title in all and every such purchasers or purchaser and all and singular the rest and Residue of Estate and effects whatsoever I give devise and bequeath unto my aforesaid three Daughters equally between them share and share alike and I do hereby nominate the said James Vowles sole Executor of my said Will In Witness whereof I have hereunto set my hand and seal this fourth day of August one thousand eight hundred and twenty four the mark & Seal X of Hannah Fudge
