In the Name of God Amen I MARY FOSSICK of
Bishopsgate street London widow being in good health and of sound
mind and memory and understanding thanks be to God But considering
the certainty of Death and the uncertainty of the time thereof do
make and publish and declare this my last Will and Testament in
manner and form following that is to say I commend my soul unto the
hands of Almighty God exhorting Mercy thro' the Merits of my Saviour
and I desire to be decently interred in Edmonton Church in the same
Vault my late Husband THOMAS FOSSICK lyes in and as to such worldly
Estate wherewith it hath pleased God to bless me I dispose thereof
as followeth In the first place I direct all my just debts and
Funeral Charges to be paid and satisfied
I give and bequeath unto MARY CARTER daughter
of THOMAS CARTER of Lime
Street Square London Ship broker the sum of
£500 and I also give to her the said MARY CARTER all my household
goods and Furniture in the front dining room of my dwelling house in
Bishopsgate Street London And my Crimson silk Bed and everything
belonging thereto And my Harpsichord in my house at Chigwell Row in
Essex and also my Gold Watch and all my Buckles Diamond Rings and
trinkets that I may die posessed of
Also I give and bequeath unto MARY NELSON
daughter of my sister JANE the wife of GEORGE NELSON of South
Shields the sum of £500 and I also give to her the said MARY NELSON
all my plate and the rest of my household goods and furniture
wherever situate and being and also all my wearing apparel
Also I give and bequeath unto all and every
the son and daughter and daughters of my sister BETTRASS the wife of
MOSES WALKER £100 a piece
Also I give and bequeath unto all and every
the son and sons and daughter of my sister ELSE the wife of
MARMADUKE JOHNSON £100 a piece
Also I give and bequeath unto the three
children of my brother JOHN HEAD £100 a piece
Also I give and bequeath unto the three
children of my brother THOMAS HEAD £100 apiece
Also I give and bequeath unto MARY FOWLER and
to her brothers THOMAS FOWLER and WILLIAM ?.NDACK who are all three
now under the care of my said Brother THOMAS HEAD at Sorrowsikes In
Yorkshire £100 a piece
Also I give and bequeath unto all and every
the son and sons daughter and daughters of my said sister JANE
NELSON the above named MARY NELSON excepted £100 a piece
Also I give and bequeath unto the two
daughters of my sister ROSAMUND COWLING deceased late the wife of
BENJMAIN COWLING £100 a piece But in case MARY COWLING one the
daughters does not appear at or shortly after my decease Then it is
my will and desire and I do hereby order and direct my Executors
hereinafter named to cause the said MARY COWLING to be advertized in
some or one of the Publick News Papers four times a year for two
succesive years And in case the same MARY COWLING shall not appear
within that time then I do hereby order and direct my said executors
or the survivors or survivor of them to pay her said Legacy of £100
to her sister MARY GREENHOUGH her .... To whom I do hereby give and
bequeath the same And it is my will and I do hereby direct that all
the before mentioned sums of Money shall be paid to the several
persons intitled to receive the same within twelve months after my
decease
I give and bequeath to my servant WILLIAM
BAILES the sum of £50 if he living with me at the time of my decease
and not otherwise
Also I give and bequeath to my servant ANN
MARRIOTT the sum of £20 is she be living with me at the time of my
decease and not otherwise
Also I give and bequeath unto my brother
WILLIAM HEAD of Gayles in Yorkshire Gentleman 100 Guineas for his
trouble that he will be put to in the Execution of this my Will
Also I give and bequeath unto my Nephew EDWARD
JOHNSON School Master at Newsham in Yorkshire £100 for the like
trouble over and above the £100 hereinbefore given to him along with
his Brothers and Sisters
Also I give and bequeath tot he said THOMAS
CARTER £20 for the like trouble and a Mourning Ring
Also I give and bequeath to Mr JOHN FOSSICK of
Bishopsgate Street aforesaid Cheesemonger £20 for the like trouble
and Mourning Ring
Also I give and bequeath to Mrs MARY SMITH and
Mr FRANCIS HEMSWORTH both of Bishopsgate Street aforesaid a Mourning
Ring a piece
I do hereby give and bequeath unto the said
WILLIAM HEAD, EDWARD JOHNSON, THOMAS CARTER and JOHN FOSSICK the sum
of £300 upon Trust that they the said WILLIAM HEAD, EDWARD JOHNSON,
THOMAS CARTER and JOHN FOSSICK do and shall with all convenient
speed after my decease lay out the same in the purchase of any of
the Publick Stocks or Government securities in their Names or the
Name of the survivor of them .... And do and shall well and truly
pay the dividends interest and other profits which shall arise.....
with the said
£300 unto RACHAEL POWELL now living with me by
equal half yearly payments for and during the term of her natural
life and from and immediately after her decease then upon this
further Trust and Confidence in them the said WILLIAM HEAD, EDWARD
JOHNSON, THOMAS CARTER and JOHN FOSSICK .... that they do transfer
and... dispose of the stocks or securities ... with the £300 ....
amongst such persons and in such manner and form and to the like
uses intents and purposes as I have hereinafter directed and
appointed the residue of my estate and Effects that is to say .....
All the Rest and residue of my Goods and Chattells Lands Tenements
and Hereditaments stock ... Securities.. and other my Real and
Personal Estate of what nature or kind soever and wheresoever I do
hereby give and devise and bequeath unto the said WILLIAM HEAD,
EDWARD JOHNSON, THOMAS CARTER and JOHN FOSSICK upon Trust in the
first place to sell and dispose of the same and to collect my debts
as soon as conveniently can be after my decease And that all the
Moneys that shall arise ... shall be laid out by them in the
purchase of any of the Publick Stocks or in Government Securities in
their names But upon the Trusts hereinafter mentioned and
declared... that is to say upon Trust that they the said WILLIAM
HEAD, EDWARD JOHNSON, THOMAS CARTER and JOHN FOSSICK ... do and
shall well and truly pay the dividends and profits .... equally unto
and amongst my said three sisters BETTRASS WALKER, ELSE JOHNSON and
JANE NELSON for and during their joint lives.... and from and
immediately after the decease of the survivor of my said three
sisters Then upon this further Trust ..... amongst all my nephews
and nieces and to the said MARY FOWLER THOMAS FOWLER and WILLIAM ?INDACK
equally to be divided between them share and share alike And I do
make nominate constitute and appoint the said WILLIAM HEAD, EDWARD
JOHNSON, THOMAS CARTER and JOHN FOSSICK joint executors of this my
last will and I do hereby revoke all former wills by me at any time
heretofore made and declare this only to stand and be as and for my
last will In Witness whereof I the said MARY FOSSICK have to this my
last will and testament... set my hand and seal... 4 March 1776

I MARY FOSSICK of Lowlayton widow do make this
a Codicil unto my will in manner following that is to say I nominate
and appoint my brother WILLIAM HEAD and THOMAS CARTER of Lime Street
Square merchant Executors of my last will and testament jointly with
my executors therein named and I hereby give and bequeath unto the
said WILLIAM HEAD and THOMAS CARTER the sum of £100 a piece for
their trouble.... also I give and bequeath unto my brother THOMAS
HEAD the sum of £100 dated this 6th January 1780
The mark X of Mary Fossick. The within written
Codicil was drawn up from directions given by the within named Mary
Fossick was read over unto and declared by her as a Codicil... and
her mark was set thereto in the presence of Isaac Mallinson, Mary
Head, Alice Johnson, Richard Jaques.
This Will was proved at London with a codicil
the 24 January 1780 ... by the oaths of William Head, Edward
Johnson, Thomas Carter and John Fossick the executors......
