In the Name of God Amen this 15 August 1746 I
ANN FOGERTHWAITE of Middleham in the County of York spinster being
indisposed in body but of sound mind and memory do make this my Last
Will and Testament in manner following that is to say first to my
Dear Mother ANN DIXON during her natural life I give and devise all
my messuages and dwelling houses and malt kiln and all other my
tenements and hereditaments in Middleham and I will that my said
mother shall receive the rents and profits thereof to her own sole
and separate use and that the same shall not be subject to the
content or engagement of her husband and that her receipt alone
shall from time to time be a sufficient discharge for such rent or
rents.
To SIMON PLACE, JOHN PLACE and ISABELL PLACE
sons and daughter of my cozen MARY PLACE deceased I give the sum of
£20 apiece and to my cozen THOMAS ROOKSBY of Stockton upon Tees and
JOHN ROOKSBY of Swaledale I give the sum of £5 apiece All which
said legacies I will shall be paid at the end of 12 calendar months
next after the decese of my said mother and with the payment thereof
I do hereby charge all that my messuage or tenement in Middleham in
the possession of FRANCIS THOMPSON (except the cellar) with the
stable and garden and all other Buildings which lye upon the
Highside of the yard and which are in the possession of the said
FRANCIS THOMPSON And also all that dwelling house wherein my father
in law [step father] CHRISTOPHER DIXON now lives that is to say that
part which lyes on the high or west side of the entry and from or
after the decease of my dear mother and subject unto and charge and
chargable with the before mentioned legacys.
I Give and devise the aforementioned dwelling
house and all the other premises (except the cellar) .... in the
possession of FRANCIS THOMPSON and that part of my other dwelling
house which lyes on the high or west side ..... to my cozen THOMAS
HAW of Middleham his heirs and assigns .... And from and after the
decease of my said dear Mother I give and devise to my father in law
CHRISTOPHER DIXON all that shop or warehouse lying on the low side
of the Entry with the chamber over the same and also the cellar in
the possession of Francis Thompson with the chamber over the same
and the malt kiln and the garden lying on the low or east side of
the yard and also all other my messuages and tenements ... to my
said cozen THOMAS HAW ..... and I will that the said THOMAS HAW and
CHRISTOPHER DIXON shall have and enjoy the yard and Little house in
common and my mind and will is that is case any of the said SIMPON
PLACE, JOHN PLACE and ISABELL PLACE shall happen to dye .... the
legacy to go to the survivor or survivors .... I give all my
cloaths and wearing apparel to my dear mother and I constitute my
said father in law CHRISTOPHER DIXON and THOMAS HAW executors.....
