Upon the twenty second day of the sixth month
called August in the year of our lord one thousand seven hundred and
twenty nine, I Joseph Files of Bickerstaffe in the county of
Lancaster, husbandman, being weak of body but sound of mind and
memory thanks be to god almighty for the same, do now make this my
last will and testament in manner & form following that is to say.
First & principly I commit my soul into the hand of almighty god my
creator having hope of eternal life in & through his beloved son our
lord & saviour Jesus Christ. Then I commit my body to decent burial
at the discretion of my execs hereafter named . And as to my
worldly estate I dispose of it as follows.
I give unto my eldest son, Thomas Files, that three parts of my real
estate which I was first possessed of to have & to hold to him, his
heirs, execs, administrators or assigns for & during all the rest,
residue & remainder of the term to me granted in the indenture of
lease together with the indenture itself by & under payment of the
rent boons & services due & payable for the same and also first
paying or well & sufficiently securing to be paid the full & just
sum of twenty four pounds of good and lawful money of Great Britain
unto Edward Rycroft of Liverpool & Elizabeth Rye of Lathom that is
to say twenty pounds to Edward & four pounds to the said Elizabeth
it being a debt owing by me to them..
Item I give unto my second son James Files my real estate which I
purchased from widow Rigby of Wigan to have & to hold to him & to
his heirs, execs, admins & assigns, for & during all the remainder &
of the term to me granted in the indenture of lease together with
the indenture itself by & under the rent, boons & services due &
payable for the same, first paying or otherwise well & sufficiently
securing to be paid unto my execs the sum of twenty pounds of good &
lawful money of Great Britain for and towards the payment of my
other debts.
Item I give unto my youngest son John Files all that part of my real
estate that was formerly in the possession of one Ann Holland
together with all the premises & privileges thereto belonging which
she enjoyed, he paying that part of the rent, boons, leyes & taxes &
expenses which the said Ann formerly paid & did, and also paying &
discharging all my other debts, funeral expenses & probate of this
my will.
Item I give unto my son-in-law Richard Pool the sum of one shilling
in fide of all gifts, bequests & hilds? part whatsoever.
Item I give unto my daughter Margaret late wife of Henry Fog the sum
of forty shillings.
Item I give unto my grandchildren Joseph & Elizabeth Pool to each of
them the sum of one guinea when or as they shall successly? attain
to the age of one & twenty years if the lives in the indenture of
lease so long continue.
Item I give unto my youngest son John Files (for & in consideration
of the discharge of the small & last mentioned legacies & expenses
as aforesaid) all my good & chattels & reditts? whatsoever.
And lastly revoking & making void all former wills & testaments by
me howtofore made I hereby nominate, constitute & appoint my
aforesaid loving sons Thomas & John Files to be my true & lawful
executors of this my last will & testament hoping they will see the
same truly performed as far as in them lyeth. In witness whereof I
have unto set my hand and seal the day & day first above written.
