The Will of Henry Fellows

 

This is the last Will and Testament of me Henry Fellows of the Town and County of Southampton a Sergeant in the Southampton Dock Police. I Direct all my just debts funeral and testamentary expenses to be paid as soon as may be after my decease. I devise all my real estates which shall be vested in me as Trustee or Mortgagee to my Trustees hereinafter named subject to the equities affecting the same respectively I give devise and bequeath all the residue of my real and personal estate whatsoever and wheresoever to which I shall be entitled at my decease unto Thomas Crocker of the Town and County of Southampton Assistant Wharfinger in the Southhampton Docks and Thomas Taylor of the same place Custom House Officer Their heirs executors administrators and assigns according to the nature and quality thereof upon trust to permit the same to be enjoyed by my dear wife Maria during her life she keeping all such parts thereof as may be liable to loss or damage by fire properly insured and in tenantable repair and after her death to stand possessed of the same upon trust for and towards the maintenance and education of my children during their respective minorities and to pay and divide the same unto and between all such of my children or child who shall attain the age of twenty one years or die under that age leaving lawful issue in equal shares if more than one and to pay assign and transfer the same to them respectively when and as he she or they shall attain the said age of twenty one years and I declare that it shall be lawful for the Trustees for the time being of this my Will (with the consent of my wife during her life and after her decease at their own discretion) to assign transfer or dispose of any part or parts or of the whole of the presumptive share of any such children for their advancement in life or on the marriage of any such children ? daughters notwithstanding their minorities I empower the Trustees or Trustee for the time being of my Will if necessary or expedient but not otherwise to sell convert and get in my said real and personal estate or any part or parts thereof in any manner they may think expedient with power to make any special or other conditions of sale as to title or evidence of title or otherwise and with power to buy in the premises at any sale by public auction and to rescind any contract for sale and resell the premises without being answerable for any loss and to invest the money so to arise therefrom upon any stocks funds or securities they may deem advisable or upon any real leasehold or copyhold securities in England or Wales without being answerable or liable for any loss that may be sustained by reason of any such investments and with liberty to vary and transpose the

investment from time to time for any other of the description aforesaid and I also empower the Trustees or Trustee for the time being of my Will to obtain the renewal of any lease or leases of any leasehold estate which are or have been usually renewed and to raise the fines and expences of such renewal I further empower my trustees for the time to give receipts for all monies and effects to be paid or delivered to them by virtue of my Will and declare that such receipts shall exonerate the persons taking the same from all liability to see to the application or disposition of the money and effects therein mentioned I declare that my trustees for the time being shall only be answerable for their own respective wilful defaults and not for the other of them and in particular that no trustee in good faith paying over money to his co-trustee or doing any act fascilitating receipt thereof for the purposes of the trust shall be answerable for the misapplication or non application thereof and I authorise them to retain and allow all expences incidental to the Trusteeship. I appoint my dear wife Maria and the said Thomas Crocker and Thomas Taylor to be Executrix and Executors of this my Will and lastly revoking all former Wills I declare this to be my last Will and Testament in witness whereof I have hereunder set my hand this fifteenth day of April One thousand eight hundred and sixty five.

Proved at Winchester the tenth Day of January 1878 by the Oaths of Maria Fellows Widow the Relict Thomas Crocker and Thomas Taylor the Executors to whom administration was granted.

The Testator Henry Fellows was late of No 127 Saint Marys Road in the Town and County of Southampton a Sergeant in the Southampton Dock Police and died on the fifteenth Day of October 1877 at the Royal South Hants. Infirmary Southampton aforesaid.
