THOMAS FALSHAW WILL DATED 17 JUNE 1831
PROVED 31 AUGUST 1832
In the Name of God I Thomas Falshaw of Ilton
in the Parish of Masham in the County of York Farmer do make my Last
Will and Testament as follows.
I give and bequeath to my dear Wife Eleanor
all my Household furniture also the live and dead Stock upon my
little farm with all my implements of Husbandry for her own use
benefit and disposal.
I give and devise to my said Wife All my
Messuages Dwellings Lands and Tenements with their Hereditaments
situated in Coverdale and elsewhere in the County of York to Hold to
her and Assigns for and during the term of her natural life and from
and after her decease I give and devise the said Messuages Dwellings
Lands and Tenements with their Hereditaments to my Son in Law
William Dixon and my friend Shadrack Robson to Hold to them the said
William Dixon and Shadrack Robson their Heirs and Assigns
Nevertheless upon the Trusts with the powers and to and for the
objects ends and purposes hereinafter expressed or declared
concerning the same that is to say Upon Trust and with a power that
they my said Trustees their Heirs or Assigns shall and do as soon as
conveniently may be after the decease of my said Wife make sale and
absolutely dispose of the said Trust estate and premises either
together or in parcels by public Auction or private Contract at
discretion and for the most money that can be fairly had and
obtained for the same.
And upon Trust and with a power that they my
said Trustees their Heirs or Assigns shall and do upon payment and
receipt of the purchase money sign seal and deliver the necessary
deeds and execute good and sufficient Tile to any purchaser lend
shall and do give sign or withall? effectual Receipts for the
purchase or consideration money which receipts shall upon every
construction of Law or Equity operate and be a good and effectual
discharge to the purchaser thereof.
And upon Trust and it is my direction and Will
that my said Trustees shall and do dispose of pay and apply the
money to arise by the sale ways and means aforesaid as hereinafter
is mentioned.
I also give and bequeath unto the said William
Dixon and Shadrack Robson their executors administrators and assigns
All my money Securities for money and all other my personal Estate
not herein before disposed of on this special Trust and confidence
that they call in all such sum or sums of money as may be due to me
and thereout pay all my just debts funeral and testamentary expences
also the Sum of Ten pounds to each of my daughters namely Margaret
Jane Eleanor Ann Joanna and Elizabeth the said Sum of Ten pounds
each to be paid to them respectively or their personal
representatives at the expiration of twelve months after my decease
and place the clear residue out on government or other good and
sufficient security and pay the Dividends or Interest thereof as the
same may become due and received to my dear Wife for and during the
term of her natural life and after her death I direct and order my
said Trustees to divide the said clear residue of my personal estate
together with the monies to arise or to be produced from such sale
of my aforesaid Real Estate and premises to and amongst my aforesaid
six daughters in equal Shares and it is my will that each respective
share shall be a vested interest in each and every way of my
daughters at my decease.
And it is my Will and meaning that my said
Trustees or either of them shall not be liable to answer or make
good any loss or losses that shall or may happen to the aforesaid
residue of my estate and effects in placing out the Trust money
unless the same shall appear to happen by or through their or either
of their wilful neglect or default.
And I do hereby direct that my Trustees shall
and may pay and reimburse themselves and himself out of the
aforesaid residue of my estate and effects all reasonable and
necessary costs charges and expences whatsoever that they or either
of them shall or may bear pay or sustain in or about the execution
of this my Will.
And lastly I nominate and appoint my said
Trustees the said William Dixon and Shadrack Robson executors of
this my Last Will and Testament hereby revoking and making void all
former Wills and Testaments at any time heretofore by me made and do
declare this to be my Last Will and Testament .
In witness whereof I have hereunto set my hand
and Seal this seventeenth day of June in the year of our Lord one
thousand eight hundred and thirty one.

William Dixon and Shadrack Robson the
Executors named in the within last Will and Testament of Thomas
Falshaw of Ilton in the parish of Masham and peculiar and special
jurisdiction of the Church late of the Prebend of Masham in the
covaty of York Farmer deceased appeared personally and were sworn
truly and faithfully to execute and perform the said will and so
forth and that the said Goods Chattels and Credits of the deceased
at the time of his death did not in their real value amount to the
sum of Two Hundred pounds before me
