In the Name of God Amen I ROBERT FALSHAW of
Coverhead in the Parish of Coverham and the County of York yeoman
being sick and weak of Body but of sound mind and perfect memory
Praised be Almighty God for the same Calling to Mind the Certainty
of Death and the Uncertainty of the time thereof Do make this My
Last Will and Testament in manner and Form following first and
principally I recommend and Recomitt my soul into the Hands of
Almighty God that Gave it And my Body to Ground from whence it was
taken to be decently buried in such place and order as it shall
please my Executors hereafter Named to appoint And as to the
following ordering and disposing of my temporal Estate the which it
hath pleased Almighty to bestown upon me I do give bequeath order
and dispose of the same in manner and form as followeth First I
will and order that all my just debts funerall expences and
legacies shall be well and truly paid and discharged out of the
whole of mine effects and to the intent and discharge and payment
thereof I do make constitute and appoint my Trusty and Well beloved
Friends HENRY HAMMOND of Low Dovescarr in Walden in the parish of
Aisgarth and County aforesaid yeoman (and my father in law) And
JOSIPH SIMPSON of Burley in the parish of Otley and County aforesaid
yeoman and CHRISTOPHER PRESTON of Hanlith in the parish of Kerby
Mallamdale and County aforesaid to be joyntly executors to this my
last will and testament But and only in Trust and for the intent and
purposes as hereafter is mentioned settforth exprest and intended
and for which the intent and purpose I do give grant and Impower the
said HENRY HAMMOND and JOSIPH SIMPSON and CHRISTOPHER PRESTON (my
said executors in trust) full power and authority to take sell and
dispose of my goods and chattells cattles and creditts both moveable
and immoveable And also all my messuages lands and tenements or
hereditaments whatsoever both real and personal situate standing
laying and being at Coverhead aforesaid or elsewhere Imediately
after my decease or as soon after as they or the Major part of them
shall think proper and convenient And in as full and Ample manner as
myself might have done being then liveing But to and for this Use
Intent and Purpose And I do will and order that the said HENRY
HAMMOND JOSIPH SIMPSON and CHRISTOPHER PRESTON ... shall and do
forth and out of the moneys that shall be raised or made forth and
out of my estate and effects both real and personal as aforesaid pay
and discharge or cause to be paid and discharged all my Just debts
and Funeral Expences ... And the remainder or remainders or
overplus after such payment as aforesaid I will and order my said
trustees HENRY HAMMOND JOSIPH SIMPSON and CHRISTOPHER PRESTON shall
dispose of the same at interest and that such interest profitts or
Income as shall arise from thence shall be yearly paid or
surrendered by them to my dear and loveing wife SARAH FALSHAW for
and towards the mentaining educating and bringing up of my three
daughters ANNE MARY and HELLIN for and during and so long and untill
my youngest daughter shall attaine the age of 21 years ...... the
yearly sum of £5 provided and in case she shall continue and remain
unmarried and my widdow But if she shall hapen to Marrie that then
and from thenceforth I will and order that my said trustees shall
then take the Tuition mentaining Educating and bringing up of my
said Three daughters or such of them as shall then be hapen to be
liveing And for such use shall take and receive the interest income
and profitts of such moneys as shall then be raised or made out of
my effects as aforesaid ..... Only paying out of the same unto SARAH
my said wife the yearly sum of £5 from and after such marraige as
aforesaid during the term of her natural life only for and in lieu
of her title of dower or Widdow Right into or out of my said real
estate Upon the account of her Resignation and Assignment thereof
and thereupon and not otherwise And also I wish and order that my
said trustees when and so soon as the youngest of my said daughters
shall then happen to be liveing shall have attained the age of 21
years they also paying he said daughter the yearly sum of £5 my said
trustees shall surrender and deliver up and unto my said daughters
or such of them as shall then happen to be liveing the whole of such
moneys interest or effects as shall be then in their power ?cosiede?
or authority (saving and reserving all such reasonable charges and
expences as my said trustees shall have been put to....) to be
equally divided amongst them or such of them as shall then hapen to
be liveing ... yearly paying unto SARAH my wife and their Natural
Mother the said eyarly sum of £5 during the term of her natural life
.... and likewise I will and order that my said trustees and
executors in trust ... shall and do yearly pay or cause to be paid
unto ANNE HAMOND my Natural Mother the sum of £5 during the term of
her natural life or during and until the time that the youngest of
my said daughters shall attain the age of 21 years and that from
and after that time I will and order that my said daughters or such
of them as shall be then liveing shall then pay unto the said ANN
HAMOND the yearly sum of £5 during the term of ehr natural life
equally amongst them in lieu of a yearly legacy or payment of the
sum of £5 given and bequeathed to her by the last will and
testament of JOHN FALSHAW my father late of Coverhead deceased. In
Witness whereof I have hereunto sett my hand and seal this 14 May
1755 revoking and annulling all former or other wills....
