The Will of Richard Evans
In the Name of God Amen This nineteenth Day of
December in the year of our Lord One thousand seven hundred and ninety I
Richard Evans of Poulton cum Seacome in the Parish of Wallezey and County of
Chester yeoman Do make and declare this my last Will and Testament in Manner
and form following, id ut, First and principally I commend my Soul into the
hands of Almighty God hoping and believing in Remission of all my Sins thro’
the Merits of Jesus Christ: My Body I commit to the Earth to be buried at
the Discretion of my Executors herein after named And my worldly Estate I
give devise and bequeath as follows -
First I give and bequeath into the Hands of William Groom of Liscard and the
Reverend Edward Newton of Poulton cum Seacome both of the Parish and County
aforesaid all my Personal estate of what Nature or Kind soever or
wheresoever Upon Trust , that is to say, Upon Trust that they the said
William Groom and Edward Newton Do sell and dispose of my said personaltu as
shall in their Discretion seem best and apply the Monies thereof arising and
also other Monies that may or shall in anywise be due to me at my Decease
towards the Payments of my Funeral Expences and my bonded and other Debts
together with the Legacies herein after bequeathed so far as the said Monies
shall go towards satisfying the same
Also I give and devise unto my son John Evans, all that my Messuage and
Tenement with the Appurtenances situate lying and being at Poulton aforesaid
To have and to hold (Subject nevertheless to, and Charged and Chargeable
with the Annuity, yearly rent or Sum of six pounds hereinafter mentioned) to
him the said John Evans to and for his own use and Benefit absolutely And I
do hereby give devise and bequeath unto my wife Anne Evans and her Assigns
for and during the Term of her natural Life One Annuity or clear yearly
rents or Sum of Six Pounds of lawful Money of Great Britain free of all
Taxes and other Deductions, parliamentary or otherwise, to be issuing and
payable out of the said Messuage and Tenements and to be payable by equal
and quarterly payments the first payment thereof to be on such Quarter Day
as shall first next happen after my Decease, and I do hereby charge and
subject the said Messuage and Tenement to and with the payment of the said
Annuity yearly Rent or sum of Six Pounds: and my will is and I do hereby
give full Power and Authority to the said Anne Evans and her Assigns to
enter into and distrain upon the said Premises or any Part thereof for the
said Annuity or such Part thereof as shall at any time become due and not be
discharged after Rent Arrear
Also I give and bequeath unto the said Anne Evans my Wife the sum of One
Pound Ten Shillings to be paid at my Decease
And moreover I give and bequeath unto my said Wife Anne Evans the full Use
and Possession of the Parlour and Rooms over the same with the furniture
thereto belonging being in my House at Poulton aforesaid for her sole and
separate use for and during the Term of her natural Life
Also I give and devise unto William Groom aforesaid all that my Right Title
and Interest in Three Pasture Gates on the Commons Pasture of Wallazey in
the County aforesaid whereof he is now in Possession and the Writings
whereof I have delivered to him in my Life Time To have and to hold to him
the said William Groom to and for his own use and Benefit Also I give devise
and bequeath unto John Young Son of Thomas Young of Liscard aforesaid the
sum of Ten Pounds to be paid to the said John young or his Assigns when he
shall attain the Age of twenty one Years
Also I give and bequeath to Molly Coventry Wife of Thomas Coventry of
Seacome aforesaid the sum of five pounds five shillings to be paid at the
disposal of my personal Estate
Also I give and bequeath to the said Molly Coventry one large round Mahogany
Small Table at my wife’s Decease
Also I give and bequeath to Hannah Young Wife of Thomas Young aforesaid and
Jane Groom Wife of William Groom aforesaid each Six Mahogany Sitting Chairs
at my Wifes Decease
Also I give to Elizabeth Brown Daughter of the late Henry Brown of Poulton
aforesaid my House Clock at my wifes Decease
And I do hereby make chargeable my said Messuage or Tenement before
mentioned with the payment of all or so many of the said debts Legacies or
sums of money herein before particularly mentioned and bequeathed as my said
Personal Estate shall of all short of fully satisfying and paying
And I nominate ordain and appoint the said William Groom and Edward Newton
Executors of this my last Will and Testament And my Will is and I do hereby
expressly declare that my said Executors or their Executors shall not be
charged or chargeable with or accountable for more of the aforesaid Monies
or estate than he or they shall actually receive or shall come to their
respective Hands by virtue of this my Will, nor with or for any Loss of the
said Monies or Estate by me bequeathed, so as such Loss happen without their
wilfull Default or Neglect
And also that it shall and may be lawful for my Executors or their Executors
in the first Place out of the said Premises respectively to deduct and
reimburse themselves respectively all such Loss, Costs, Charges and Expences
as they shall sustain expend or be put unto for or by Reason of the
|Performance of this my Will or the Management or Execution thereof
respectively or any thing in any wise relating thereunto
And I do hereby revoke disanull and make void all former or other Wills by
me heretofore made and likewise I declare this to be my last Will and
Testament In Witness whereof I the said Richard Evans the Testator have to
this my Will set and put my Hand and Seal the Day and Year first above
