The Will of John Emmett
In the Name
of God Amen I John Emmett of the Parish of Trowbridge in
the County of Wilts Broad weaver being very Weak and
infirm in body, but of Sound mind and memory thanks be
given to God for the same, Therefore calling unto mind
the Mortality of my body and knowing it is Appointed for
all men Once to die do make and ordain this my last Will
and Testament in manner and form following (that is to
say)Principally and first of all I Give and recommend my
Soul into the hands of Almighty God that gave it. And my
body, I recommend to the Earth to be decently buried at
the discretion of my Executrix hereinafter named And as
touching my Worldly Effects wherewith God hath blessed
me in this life, I Give and Dispose of the Same in the
following manner ffirst I Give and bequeath to my Eldest
Son Ralph Emmett all this my ffreehold Estate together
with the backsides Garden Ground and Houses or Tenements
thereon Standing and likewise the House wherein I now
live Nevertheless I will that the Rents Profits or
Issues thereof be reserved for the use of my Wife Ann
Emmett during her Widowhood (and no longer) for the
Maintenance or breeding up of my family And likewise if
Occasion or Necessity requires to Advance or take up
Twenty Pounds on my Estates let my Wife have it Six or
Eight Pounds at a time as Necessity requires it for
carrying on business for the Support of my family I
likewise Give and bequeath to my Youngest Son John
Emmett the Sum of Twenty Pounds of Legal money of Great
Britain to be paid him out of my ffreehold Estate when
he shall Attain the full age of Twenty one Years I
likewise Give to my Said Son John Emmett my Broad Loomes
(with all the Materials or Utensils belonging to it) to
be Sold and the Money thence Arising to be laid out
towards the binding him an Apprentice at the discretion
of my Executors in trust (hereinafter named) And I also
will that if my Son Ralph Emmett should happen to die
without Male Issue Then I will that the above said
ffreehold Estate immediately devolve to my Son John
Emmett and his Heirs for ever I likewise Give and
bequeath unto my Daughter Ann Emmett the Sume of One
Guinea of Lawfull money of Great Britain to be paid to
her out of mine Effects And lastly all the rest and
residue of my Effects of what Nature kind or quality
soever and wheresoever the same be I Give and bequeath
to Ann Emmett my Welbeloved Wife whom I likewise make
Sole Executrix of this my last Will and Testament for
She peaceably and quietly to Occupy Possess and enjoy
the same And I do hereby Nominate and appoint my true
and trusty friends Mr John Hooper James Whatley and
Thomas Coombes Executors in trust of this my last will
and testament And do give to each of them the Sume of
Two Shillings and Six Pence to buy them Gloves with And
I do Give them full Power and Authority to take or
receive all Rents and Profits of the above said Estate
and therewith to bind my Son Ralph and my Son John
Apprentice According to the best of their discretion And
after they are bound the Rents and profits of the
abovesaid Estate to be made use of towards the payment
of the above said Twenty Pounds and for the discharging
of other Incumbrances (if any) And the residue to be
applied to the uses above mentioned for the benefit of
my Son Ralph Emmett And whatsoever Charge or Expence
they are at in fulfilling the trust reposed in them
According to the true intent and meaning hereof Shall be
allowed them out of mine Effects And I do hereby utterly
revoke and make void all former Wills by me made
ratifying and confirming this and no other for to be my
last Will and Testament In Witness whereof I have
hereunto Set my hand and seal the Twenty Ninth day of
October in the year 1745 John Emmett his mark This Will was kindly transcribed and sent in by Ros.
