The Will of James Gasking Ellery
This is the last Will and testament of me James
Gasking Ellery of Plymouth in the County of Devon Solicitor ffirst I direct
that all my just debts be paid by my Executor herein after named out of my
residuary Estate I give and devise my freehold dwelling house and premises
in Atheneum Terrace Plymouth in which I reside to my brother in law John
Nicholas Bennett and my brothers Edward Crisp Ellery and Edmund Roger Ellery
share and share alike as tenants in common and to their respective and
several heirs and assigns for ever I give and bequeath to my Sisters
Caroline Emma Ellery and Mary Anna Bayer Ellery the sum of forty pounds each
and to my said sister Caroline I give the further sum of ten guineas to be
laid out in the purchase of a brooch or some other Article at her selection
as a small acknowledgement of her assiduous and affectionate attendance on
me during my illness I give to my said brother Edward the sum of twenty
pounds I give to my Aunt Eliza Body now living with my family the sum of ten
pounds for mourning I give to my friend William Richard Berryman a handsome
cornelian seal of the finest gold in remembrance of me and as a small token
of my esteem I give the Revd John Hawker five guineas I give Martha Kean the
sum of nineteen guineas in acknowledgement of her constant and kind
attentions to me from my youth and to Agnes( Mrs Gasking’s other servant)
the sum of three pounds I give to my servant Sarah Lawrence the sum of ten
guineas as an acknowledgement of her kind attention to me during my illness
and of her faithful services in my family and to Sally Palmer I give the sum
of three pounds as a similar acknowledgement I give to my Nephew John Peter
Bennett a Watch of the value of six guineas when he shall attain the age of
sixteen years And all the Rest and Residue of my Estate and Effects I give
devise and bequeath to the said John Nicholas Bennett his heirs Exors Admors
and Assigns Upon trust to sell the same And to give good receipts to the
purchasers thereof and to apply the proceeds of such sales first in
satisfaction of all my just debts and after satisfaction thereof then Upon
trust for my said Sisters Caroline and Mary share and share alike and their
respective heirs Exors and Admors And I hereby appoint the said John
Nicholas Bennett sole Executor of this my Will Sealed with my Seal dated
this ninth day of April 1837 _ Jas G Ellery
