The Will of Robert Dunning
This is the last Will and Testament of me Robert
Dunning of the City of Chester Shoemaker I give and devise All those my
three several Dwellinghouses with their appurtenances situate in Saint Ann’s
Street within the Liberties of the said City of Chester, and all other my
Real Estate whatsoever, unto William Lowe of the City of Chester Draper,
John Lowe of the same City Gold-smith and Charles Owens of the same City
Painter their heirs and assigns Upon the Trusts nevertheless herein after
declared (that is to say) Upon Trust to permit and suffer my dear wife
Catherine Dunning and her assigns to receive and take the Rents Issues and
profits of the said premises for and during so many Years of her natural
life as she shall continue my widow and unmarried, to be applied by her for
or towards the maintenance and support of herself and such of my Children as
she shall choose to reside with her And from and after the decease or
marriage again of my said wife, whichever of those events shall first
happen, Then Upon further Trust that they my said Trustees and the Survivor
of them and the Heirs and Assigns of such survivor do and shall stand
possessed of my said Dwellinghouse and real Estate Upon Trust for my five
children Robert, John, Henry, William and Emma equally as Tenants in Common
and for their several and respective heirs and assigns for Ever and in case
any of them my said Children shall happen to die under the age of twenty one
Years and without lawful Issue him or her surviving Then as to the part or
share of him or so dying of and in my said Dwellinghouses and real Estate
Upon Trust for the survivors of them my said Children equally as Tenants in
Common and for their several and respective heirs and assigns for Ever And I
direct that all my just debts and funeral and testamentary expences shall be
paid and discharged out of my personal Estate as soon as conveniently may be
after my decease and subject thereto I do hereby give and bequeath unto the
said William Lowe, John Lowe and Charles Owens their Executors and
administrators All my Household Goods and Furniture, Stock in Trade, ready
money, Securities for money, and other my personal Estate and Effects
whatsoever Upon the Trusts hereinafter declared (that is to say) Upon Trust
to continue , or place out at Interest, all my ready money upon such
Securities as they, in their discretion, shall from time to time think
proper, and to pay and apply the yearly Interest and proceeds thereof unto
my said dear wife Catherine Dunning and permit her to have the use and
enjoyment of all my household Goods and Furniture And also to continue and
carry on the Trade or Business in which I am now engaged, in case the same
shall in my judgment of them my said Trustees be attended with profit and
advantage, but not otherwise, for and during so many years of her natural
life as she shall continue my Widow and unmarried, for the maintenance of
herself and such of my said Children as she shall choose to reside with her
And from and after the decease or marriage again of my said wife Upon Trust
that they my said Trustees shall sell and dispose of my said Household Goods
and Furniture and all other my personal Effects and pay and divide the money
arising therefrom And Also all the money which shall then be out at Interest
unto and amongst my said five Children or such of them as shall then be
living equally share and share alike Provided Always that in case any one or
more of my said Children shall have died before my wife’s life Interest in
my personal Estate shall have determined leaving lawful Issue then I direct
that the Sum of One hundred pounds shall be paid out of my Effects to and
amongst the lawful Issue of each such deceased Child on such Issue attaining
the Age of twenty one Years, in lieu of the share which their Parent would
have taken if they had been then living Provided Also and I further direct
that it shall and may be lawful for my Trustees with the consent of my wife
during her life, and after her death of their own proper authority, to apply
any part of the presumptive shares of my Children or Grandchildren in the
presents hereby intended for them respectively, or the interest or proceeds
of such shares, during the minority of such Children or Grandchildren, for
or towards their maintenance or advancement And I nominate and appoint the
said William Lowe, John Lowe and Charles Owens Executors of this my last
Will and Testament And I declare and direct that my said Trustees and
Executors shall not be answerable or accountable for any more of my estate
and Effects than shall actually come to their respective hands by virtue
hereof nor for any loss or damage which may happen in placing out at
Interest any money or otherwise in the execution of the Trusts aforesaid
unless the same shall happen through their willful neglect, nor for the acts
or defaults of each other, but each of them for himself and his own acts and
defaults only, and that they shall and may deduct and retain all reasonable
charges and expences to be incurred by them in and about the execution of
this my will In Witness whereof I have hereunto set my hand and seal this
twenty seventh day of June in the Year of our Lord one thousand eight
hundred and thirty two Robt Dunning
