The Will of Nicholas Dunning

 

In the name of God Amen I Nicholas Dunning of Beere Regis in the County of Dorsett Yeoman being Sick and weake but of Sound Mind and Memory (praised be God) Do this Eleventh Day of August in the Year of our Lord One Thousand Seven Hundred and Eleven make and ordaine this my last Will and Testament in manner following (Viz) I commend my Soule to God that gave it hopeing to have forgiveness of All my Sins and to Inherit Life Everlasting thro my Lord and Saviour Jesus Christ And I desire my body may have Xtian burial And as touching my Worldly Estate I dispose thereof as follows Imprimis I desire my just Debts and funeral Expences may be paid and Discharged Item I give unto my Daughter in Law Sarah Whemcell the Sume of twenty pounds to be paid to her when she shall Attaine her full Age of One and twenty Years provided that She doth then Clearly release acquit and discharge her mother and my Heirs Exrs and Adrs of and from all Legacies Claimes and Demands whatsoever from the beginning of the World until the day of the Date of Such Release And in such case I do order that upon her giving such Release as aforesaid her Mother and my Executors and Admrs shall also release and discharge my said Daughter in law of and from all Debts Claimes and Demands whatsoever for or touching her maintenance and education and all other things whatsoever but if my said Daughter in Law will not give such release and discharge as aforesaid then my will is that the Legacy hereinbefore given her shall cease determine and be utterly Voyd. And that her Mother and my Executors shall not Release my said Daughter in Law as aforesaid Item my Will is that my loveing Wife Elizabeth shall have hold and enjoy all the rest of my Estate both real and personall dureing her life And shall Apply the Rents Issues and profits thereof for and towards the Maintenance education and pferment of my Children Item Imediately from and after my Said Wifes decease I give the Tenements wherewith I now dwell with the Lands and Appurtenances thereto belonging unto my Son Charles Dunning for the Residue of my terme and Estate therein which shall be then to come and unexpired Provided he do then pay or Sufficiently secure to be paid the Sume of twenty pounds apiece to each of his three Sisters Mary Elizabeth and Elianor as shall be then living but if he shall refuse or neglect so to doe then I doe order the same Tenement to be Sold for the best price can be gotten therefore And the Moneys thereby Ariseing to be equally Divided amongst my said Children Item All the Rest and residue of my Estate which shall remaine at my Wifes Decease shall be for the Use and benefit of my Said Children in Such manner as my Said Wife by her Will or any other Writeing shall appoint & in default of her Appointment then for the use of All my Said Children Equally And I do nominate and Appoint my Said Wife to be my ffull and Sole Executrix of this my last Will and Testament And I desire my good friend Robert Frampton of Beere to be Overseer hereof And I do revoke all former Wills by me heretofore made And do Declare these psents to be my last Will and Testamt In Witness whereof I have hereunto set my hand and seale the Day and Year first above written The Narke of Nicholas Dunning Signed Sealed published and Declared in the psence of John Perkins Geo: Young
