The Will of James Dunning
This is the last Will of me James Dunning of the City
of Liverpool Master Carter I appoint my daughter Emily the Wife of Henry
Hansen and my sons in law John Verity and Arthur Cabot Trustees and
Executors of this my Will I give to my brother John the sum of Twenty Pounds
To the Friends Institute Islington Liverpool the sum of Five Pounds To
Charles Range if living at my decease the sum of Five Pounds and to any
Carter who shall have been in my employ at the time of my decease for two
years the sum of One Pound each of the foregoing legacies to be free of duty
And I devise and bequeath all the rest of my property both real and personal
unto the said Emily Hansen John Verity and Arthur Cabot Upon trust that they
or the survivor of them or other the trustees or trustee for the time being
hereof (hereinafter called my trustees) do as and when they shall in their
absolute discretion think fit sell call in and convert into money such parts
thereof as shall not consist of money and shall with and out of the moneys
pay my funeral and testamentary expences and debts and shall hold the
residue of the said moneys In trust for such of my children living at my
death or having died in my lifetime leaving issue living at my death as
being sons attain twenty one or being daughters attain twenty one or marry
and if more than one in equal shares and so that the share of any child
having died in my lifetime leaving issue as aforesaid shall devolve on his
her or their personal representatives as part of his or her personal estate
in the same manner as if he or she had survived me and died immediately
after me Provided always that my trustees may in their absolute discretion
raise any part or parts not exceeding in all of one half of the then
expectant presumptive or vested share of any child under the trusts
hereinbefore declared and apply the same for his or her advancement or
benefit Provided always and I hereby declare that my trustees may in their
absolute discretion postpone the sale and conversion of all or any part of
my estate so long as they shall think fit I direct that they may permit my
household furniture and effects which may be in or about the house occupied
by me at my death to remain there so long as any of my children remain
unmarried and continue to reside there In witness whereof I have hereunto
set my hand this Eighth day of December One thousand nine hundred and eleven
